No. 38, If the lessee makes default in complying with any covenant with respect to work to be carried out in or on the land comprised in his special gold- mining lease within the time prescribed, or, if the time is extended as aforesaid, within such extended time, or if he makes default in complying with any other covenant contained in his lease, then, without any authority or process other than this Act, the special gold- mining lease shall be liable to forfeiture. Except in the case of a gold- mining lease granted for the purposes or any of the purposes mentioned in paragraphs ( 2) , ( 3) , ( 4) , and (5) of section twenty- four of this Act and in the case of a gold- mining lease granted for the purpose of stacking or otherwise storing any earth or ore containing gold, all gold- mining lt1eh9ae4s8eps ( a N sas o nin . dg2)sop" fecai * na " dl T ign h o e lfd M o-rmc in ein in oin g ng A thl c ee t a s sde A ast m eg en oraf d n m tth e e n ed t p A baes c sf t ionr o ge f of that Act shall be deemed to contain a covenant to bona fide and continuously work the land comprised in the lease by carrying on mining operations for the purposes for which the land is demised with reasonable diligence and skill and atall times to comply withthe labour covenants contained in the lease unless exemption or partial exemption is granted under this Act and the Regulations, and shall be readand construed accordingly. Every applicant for a special mineral lease shall, if thereunto required by the Minister, deposit with the Minister a sum fixed by the Minister to be held by the Minister as a guarantee that the provisions of this Act and the Regulations hereunder and (if granted) the covenants of the lease will be duly observed or performed by him.
