1. To obta in a lease for m i n i n g purposes of any k ind provided
for in t h e A c t th i r ty-seven Vic tor ia n u m b e r th i r t een possession of t h e
land shal l be t aken and appl icat ion to lease m a d e in the m a n n e r form

a n d period prescribed by t h e regula t ions m a d e unde r t h e said A c t E v e r y por t ion of land open to lease of which possession shal l have been t a k e n as aforesaid shal l be deemed to be held unde r promise of lease a n d to be exempt from sale unless or u n t i l default has occurred in m a k i n g the prescribed appl icat ion to lease or u n t i l t h e appl icat ion has been abandoned or t he Governor has refused the appl icat ion a n d not ice of such a b a n d o n m e n t or refusal has been publ i shed in t h e Gazette.
