BE A M M IN E I N N D G MAECNTT ~ ~ ~ ~ F [ASSENTED TO 14TH DECEMBER, 1915.J it enacted by the King's Most Excellent :Majesty, _ by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title 1. This Act may be cited as "The lllining Act A mend- and t t' ment Act of 1 H15," and shall be read as one with "The ~ ~~ e~e Ion Mining Act of 1898,"* herein referred to as the Principal Act. Amendment 2. The last paragraph of section twenty-eight of the of 8. 28. Principal Act is repealed, and the foll~ wing provision is inserted in lieu thereof :- And every such gold-mining lease shall contain a con- dition that for any breach of any of the covenants therein contained the Minister may either forfeit the lease or in his discretion impose upon the lessee a fine not exceeding one hundred pounds, and on 'non-payment of any such fine may forfeit the lease. Amendment 3. Subsection seven of section thirty-four of the of s. 34. Principal Act is repealed, and the following subsection is inserted in lieu thereof :- (7) A condition that for any breach of any of the covenants therein .contained the Minister may either forfeit the lease or in his discretion impose upon the lessee a fine not exceeding one hundred pounds, and on non-payment of any such fine may forfeit the lease. 4. Section forty-five of the Principal Act is repealed, and the following section is inserted in lieu thereof :- Reeov~ ry of [45.J In case any mining lease granted under the p~ ~ lOn of authority of this Act or the Regulations, or of any Act ~ = ~ authorising the granting of leases for mining purposes, is or is liable to be forfeited or determined by any breach of condition or otherwise, or in case the term thereby granted has expired, possession of the land demised shall and may be taken on behalf of His Majesty immediately and without suit or process of any kind by posting a notice in the prescribed form outside the warden's or mining registrar's office; and a certificate purporting tq * 62 Vie. This Act may be cited as "The Petroleum .Act Short title. of 1915." 2. In this Act- Definitions. . "Minister" means the Secretary for Mines or other Minister. Minister of the Crown charged for the time being with the administration of this Act; "Petroleum" means mineral oil occurring in a free Petroleum. state and which may be obtained by borings or wells; and natural gas: the term does not include mineral oil which may be extracted from coal, shale, or other rock by some industrial process. 3 This Act does not apply to mineral oil which may Applioa.tion be extracted from coal, shale,. or other rock by some of Aot. industrial process. 4.
