Ko. 25, (d) The production of a copy of the Gazette containing any order made by the Chief Secretary for the time being in force shall be conclusive evidence of the declared price of any goods or kinds of goods as set out therein. Saying. 16. No action, claim, or demand whatsoever shall lie, or be made or allowed by or in favour of any person whomsoever, against the Chief Secretary, or any officer or person acting in the execution of this Act, for or in respect of any da:rr:age or loss or injury sustained or alleged to be sustained by reason of the passing of this Act, or of its operation, or of anything done or purporting to be done thereunder. Proclamation. 17. (1.) The Governor in Council may from time to time make and publish in the Gazette all such Proclama- tions as he thinks fit for giving full effect to this Act. (2.) All Proclamations purporting to be made by the Governor in Council under and for the purposes of this Act and published in the Gazette shall be read as one with this Act and construed as being of equal validity, and shall be judicially noticed. Appropria- tl.:>n. 18. All moneys that may be required for carrying this Act into full execution shall be defrayed out of the Consolidated Revenue Fund, which is hereby appro- priated for the purpose. MINING. 5 Geo. V. No. 25. THE MINING ACT AllENDMENT ACT OF 1914. An Act to Amend "The Mining Act of 1898" by Enabling Special Gold-mining Leases to be Granted for the Encouragement of Deep Sinking. [ASSENTED TO 17TH DECE~ jBER, 1914.J B E it enacted by the King's :Most Excellent Majesty, by and with the advice and consent' of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Shurtt'tleand 1. This Act may be cited as "The Mining Act Amend- ~ f' ~ ~ t~ ction ment Act 01 1914," and shall be read as one with "The Mining Act 01 1898,"· hereinafter called the Principal Act. * 62 Vie. M I N I KG. G270 UJl4. 2. The following amendments are made III the oAfmPernindcmipeanlts Principal Act, namely;- Act. (1.) The following provision is added to section twenty-four ;- In cases where the lessee undertakes to sink a shaft on· the land to a depth of not less than three thousand feet, a lease, to be called" a special gold-mining lease," may be granted under this section; and all the provisions of this Act relating to gold-mining leases shall apply to special gold-mining leases except where otherwise expressly provided. (2.) At the beginning of the third paragraph of section twenty-six, the words "Except in the case of special gold-mining leases," are inserted. The following further proviso is added to the said section;- Provided further that the area of a special gold- mining lease shall be such (not exceeding three hundred acres) as the Governor may in any case think proper. (3.) At the beginning of paragraph three of section twenty-eight, the words "Except in the case of special gold-mining leases," are inserted. The following paragraph is inserted after the said paragraph three;- (BA.) In the case of a special gold-mining lease- (i.) A covenant to work the land demised by such number of men as is prescribed in the said lease, subject to such exemption or partial exemption as may be granted under this Act or the regulations; and (ii.) A covenant to sink a shaft on the land demised to a depth to be prescribed (not being less than three thousand feet) and within a time to be prescribed in the said lease. The lessee shall, within the said time, sink a shaft in the land comprised in such lease to the said depth. If, although the lessee before the expira- tion of such time has not sunk a shaft in such land to the said depth, the Minister is never- theless satisfied that such shaft has been so sunk to the depth of at least one thousand H

No. 25, 1914. five hundred feet, and that the delay in sinking the same to the prescribed depth has occurred through circumstances for which the lessee cannot justly be held responsible, then the Minister may extend the time prescribed for sinking such shaft to the prescribed depth for a further period of one year. The lessee or any sub-lessee from him shall, at the end of each month after commencing work, lodge with the warden the following particulars, viz. :- The distance sunk, with full details of the strata passed through in so sinking, and a full description of all veins of quartz or other lode matter passed through; and on failure so to do shall be liable to a fine for each offence of fifty pounds, and to the forfeiture of the lease on non-payment of such fine. If the lessee makes default in complying with the covenant to sink a shaft to the pre- scribed depth within the time prescribed, or, if the time is extended as aforesaid, within such extended time, then, without any authority or process other than this Act, the special gold-mining lease shall be liable to forfeiture. (4.) The following provision is added to section forty-two :- This section does not apply to special gold-mining leases. NEWSPAPERS. See PmNTING. OYSTERS. See FISHERIES.
