ANNO VICESIMO ELIZABETHAE SECUNDAE REGINAE No. 82 of 1971 An Act to Amend the MiningAct 1968-1971 in certain particulars and for other purposes [ASSENTED TO 22ND DECEMBER, 1971 ] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- 1. Short title . ( 1) This Act may be cited as the Mining ActAmendment Act1971 ( No. 2). (2) The Mining Act 1968-1971 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Mining Act1968-1971. 2. Amendment of s. 7 . Section 7 of the Principal Act is -amended by, in subsection ( 1) in the definition " owner ", omitting the word " where " where it occurs in subparagraph (a) and inserting in its stead the word " were ". 35

Section 21 of the Principal Act is amended by, in subsection (1), inserting after the word " who " the words ", in the case of a natural person,". 5. Amendment of s. 22 . Section 22 of the Principal Act is amended by adding the following paragraph: " The provisions of this section do not apply in respect of the granting of a mining lease over land referred to in subparagraph (b) upon an application made prior to the date of commencement of this Act.". 6. Amendment of s. 51. Section 51 of the Principal Act is amended by, in subsection (1), omitting the word "not" where it occurs in subparagraph (c) after the word " should ", and inserting in its stead no the word " ". 7. Amendment of s. 91 . Section 91 of the Principal Act is amended by, in subparagraph (c), omitting the word "paragraph " and inserting in its stead the word " subparagraph ". 8. Amendment of s. 111 . Section 111 of the Principal Act is amended by, in subsection ( 3), inserting after the word " case " the words ", other than in the case of land alienated pursuant to an enactment specified in subparagraph (a), (b) or (c) of subsection (2) of section 110 of this Act,". 9. Amendment of s. 127 . Section 127 of the Principal Act is amended by, in subsection ( 3), inserting after the word " lease " the words " or perpetual lease ". 10. Operation of specified Acts. (1) Notwithstanding the provisions of section 33 of the Mining Act Amendment Act1971 the provisions of the Acts specified in the schedule to this Act or, in the case of The Mining Acts Amendment Act of 1929, of the Part therein specified- . (a) shall be deemed to have had full force and effect at all times on and from the date of passing of the Mining Act AmendmentAct1971; and (b) shall be deemed to continue to have full force and effect until the date when the Mining Act1968, as subsequently amended, comes into operation, as if that.section had not been enacted. (2) The provisions of the Acts and of the Part of The Mining Acts Amendment Act of 1929 specified in the schedule to this Act are in this section referred to as the repealed provisions. (3) Every act and thing done or suffered or omitted to be done, and every permit issued under any of the repealed provisions since the date of passing of The Mining Act Amendment Act 1971 are declared to be and shall be deemed to be and always to have been good and valid.
