An Act to amend the Act 37 Victoria No.. 13.

therefore enacted by the Queen ' s Mos t Exce l len t Majes ty by and wi th t h e advice and consent of t h e Legis la t ive Council and Legislat ive Assembly of N e w South W a l e s a n d by t h e au thor i ty of t h e same as fo l l ows :—

1. N o t w i t h s t a n d i n g a n y t h i n g to t he cont ra ry contained in t h e

M i n i n g A c t th i r ty - seven th Victoria n u m b e r th i r t een t h e land comprised in a n y t empora ry Common wi th in any gold field proc la imed or to be proclaimed shal l for t h e purposes of t h e said A c t be and be deemed Crown land Provided always t h a t lands wi th in such Commons com­ prised in any au thor i t ies g ran ted by t h e Governor unde r t h e t w e n t y - seventh section of t h e said A c t or in any permiss ion g ran ted by the Secretary for Mines u n d e r t he twen ty -e igh th section of t h e said A c t shal l n o t become Crown lands as aforesaid u n t i l such au thor i ty or permission shal l be cancelled by t h e Governor or t he Secretary for Mines as t h e case m a y be .

2. This A c t shall come in to operat ion on t h e first day of J u l y

b u t no person or persons except such as were ac tua l ly occupying for m i n i n g purposes land wi th in a t emporary Common as aforesaid u n d e r a lease from the Crown or unde r miners ' r ights or minera l licenses pr ior to a n d on the first clay of J u l y one thousand e ight h u n d r e d and e ighty shal l be ent i t led in v i r tue of any miner ' s r i g h t or minera l l icense to t ake possession of a n y such land for t he purpose of m a k i n g a t i t le there to or of min ing thereon or the re in for gold or any other me ta l or minera l un t i l this A c t shall have been in operation sixty days.
