MINING ACT 1992—REGULATION

(Relating to ventilation shafts)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Mining Act 1992, has been pleased to make the

Regulation set forth hereunder.

Commencement

1. This Regulation commences on 10 December 1993.

Amendment

2. The Mining (General) Regulation 1992 is amended by inserting at the end of clause 6 (a) the following matter:

• any ventilation shaft

EXPLANATORY NOTE

The object of this Regulation is to prescribe the construction, maintenance or use (in connection with mining operations) of ventilation shafts as a mining purpose for the purposes of the Mining Act 1992.

References to mining purposes occur throughout that Act. One significant effect of prescribing something as a mining purpose is that it may then be carried out by the holder of a mining lease or mineral claim. Also, the Minister may make orders imposing conditions on the carrying out of mining purposes or requiring the carrying out of specified mining purposes to be discontinued for certain periods.
