MINING ACT 1973 - REGULATION

(Relating to royalty returns for gold mining)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Mining Act 1973, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 December 1990.

Amendment

2. The Mining Regulations 1974 are amended by omitting

Regulation 36 (2) and by inserting the following clause:

(2) The registered holder of a mining lease must, within 28 days after the end of each return period, lodge with the Minister a return in the form in Schedule 9A showing:

(a)

in respect of any mineral for which the rate of royalty payable under the Act is fixed by reference to quanntity - the quantity of the mineral won from the area during the return period; and

(b)

in respect of any mineral for which the rate of royalty payable under the Act is fixed by reference to value - the value of the quantity of the mineral so won.

Maximum penalty: $500.

EXPLANATORY NOTE

The object of this Regulation is to amend Regulation 36 of the Mining

Regulations 1974 so as to remove a doubt as to the effect of clause (2). The
substituted clause makes it clear that the maximum penalty for a failure to comply
with the clause is $500.
