MINING ACT 1973 - REGULATION

(Relating to plans etc. to accompany applications for mining leases

and mining purposes leases)

HIS Excellency the Governor, with the advice of the Executive

Council, and in pursuance of the Mining Act 1973, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 17 December 1990.

2. The Mining Regulations 1974 are amended by omitting

Regulation 26 and by inserting instead the following Regulation:

Plans etc. to accompany applications for certain authorities

26. (1) For the purposes of section 43 (1) (b) of the Act, a plan accompanying an application for a mining lease or mining purposes lease must be drawn in accordance with the Survey Practice Regulation 1990.

(2) Clause (1) is taken to be satisfied if the application is

accompanied by a map that clearly indicates (by means of distinctive colouring or edging and including bearings and distances on all sides and a connection by bearing and distance to a surveyed mark) the area of land concerned, being:

a cadastral map at the scale of:

(i)         1:25,000; or

(ii)       if a map at the scale of 1:25,000 is not available, 1:50,000; or

(iii)      if maps at the scale of 1:25,000 or 1:50,000 are not available, 1: 100,000,

published by the Department of Lands, the Department of Minerals and Energy or the Australian Land Information Group; or
if a map referred to in paragraph (a) is not available, a cadastral map published by a Government department or public authority, whether of New South Wales or of the Commonwealth; or
if maps referred to in paragraphs (a) and (b) are not

available, an aerial photograph or a topographic map of a
standard acceptable to the Director-General.

EXPLANATORY NOTE

The object of this Regulation is to amend the Mining Regulations 1974 to prescribe (for the purposes of section 43 of the Mining Act 1973) the kinds of plans, maps, surveys or photographs which may accompany an application for a mining lease or a mining purposes lease.
