MINING ACT 1973 - REGULATION
(Relating to false information and the transfer of claims)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Mining Act 1973, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 August 1990.
Amendments
2. The Mining Regulations 1974 are amended:
(a) by inserting after Regulation 56 the following Regulation: False or misleading information 56A (1) A person must not, in or in connection with an application or other document lodged under the Act, knowingly furnish information in that application or document which is false or misleading in a material particular.
Maximum penalty: $500.
(2) In this Regulation, “application” does not include an
application to a court.

by omitting Schedule 4 and by inserting instead the following Schedule:

Transfer of a claim
Registered number of claim.
Name and address, in full, of transferor.
Name and address, in full, of transferee.
Number of claims in the mining division held by transferee.
Consideration for transfer.
Is there any building on the land the subject of the claim?
Was any such building erected after 1 February
1987?Was an approval (as required by the conditions of the claim) obtained for the erection of any such building? *

Transfer: Approved/Refused Transfer registered in claims register: * A copy of the approval if available, should accompany the transfer.
EXPLANATORY NOTE
The object of this Regulation is to amend the Mining Regulations 1974 so as:
(a) to provide for an offence of knowingly furnishing information which is false or misleading in a material particular in certain applications and documents lodged under the Mining Act 1973; and (b) to provide for further information relating to buildings on claim areas to be provided in transfers of claims.
