AN ORDINANCE
To amend the Mining Ordinance 1930.
| BE it ordained by the Governor-General of the Commonwealth of Council, in pursuance of the powers conferred by the Seat of Govern-Australia, acting with the advice of the Federal Executive | ment Acceptance Act 1909 and the Seat of Government (Administration) |
| Act 1910-1931 as follows :— |
1.—(1.) This Ordinance may be cited as the Mininq Ordinance short title ana x J

(2.) The Mining Ordinance 1930 is in this Ordinance referred to
as the Principal Ordinance.
(3.) The Principal Ordinance, as amended by this Ordinance,
may be cited as the Mining Ordinance 1930-1931.
2. This Ordinance shall be deemed to have commenced on the commencement.
date fixed for the commencement of the Principal Ordinance.
3. The Principal Ordinance is amended as set out in the Schedule ^?fment8 to

4. Section five of the Principal Ordinance is amended by omitting Definitions.

from the definition of " Crown Lands " the word " free " and inserting
in its stead the word " fee ".
5. Section seven of the Principal Ordinance is repealed and the
following section inserted in its stead :—
" 7.—(1.) Notwithstanding anything contained in this Ordinance, Exemption of
| shall not, except as hereinafter provided, be granted in respect of— &c' | a miner's right, an authority to prospect or a lease under this Ordinance from mining, |
(a) any lands included in the City Area as defined in the City Area Leases Ordinance 1924-1929 or in the area described in the First Schedule to the Cotter River Ordinance 1914-1931 ; or
(b) any lands alienated or in course of alienation from the Crown
in fee simple.
" (2.) The Minister may, by notice in the Gazette, declare that an authority to prospect or lease, under this Ordinance may be granted in respect of any lands specified in paragraph (b) of the last preceding sub-section which are described in the notice.".

| (a) by omitting from paragraph (b) of sub-section (1.) the word |
" and " ; and
(b) by inserting, after paragraph (c) of that sub-section, the
following paragraph:—
" (d) all other Crown lands not referred to in the pre-
ceding paragraphs of this sub-seotion except—
(i) unleased lands ;
(ii) lands subject to an annual lease, scrublease, special lease for pastoral purposes or occupation licence within the meaning of the law of the State of New South Wales, in its application to the Territory, relating to Crown lands in force immediately- before the 1st January, 1911 ; and
(iii) lands subject to permissive occupation.".
