AN ACT to amend the Mines Regulation Act 1946.

[Assented to 29 November 1984.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

(1) This Act may be cited as the Mines

Section 23C

amended.

3. Section 23C of the principal Act is amended

(a) in paragraph (c) of subsection (2)-

(i)

by deleting "three" and substituting

the following-

(ii)   by deleting "and" at the end of sub- paragraph (ii);

(iii)   by deleting the full stop at the end of subparagraph (iii) and substitut- ing a semi-colon; and

(iv)

by inserting after subparagraph (iii)

the following subparagraphs

(iv) one shall be a person who is experienced in ventilation technology and is nomin- ated by the body known as the Chamber of Mines of Western Australia (Inc.);

and

(v)    one shall be a person who is experienced in ventilation technology and is nominated by the Mining Division of the body known as the Australian Workers' Union. ";

(b)

by inserting after subsection (2) the following subsections

(2a) Whenever a nomination is required for the purpose of filling an office referred to in subsection (2) (c) the Minister shall, in writing, request the person or body referred to in the appropriate subparagraph to nominate

in writing, within a period specified in the notice, a person qualified and willing to be appointed to that office.

(2b) Where a request is made pursuant to subsection (2a) the Min- ister may, if no nomination is made in accordance with the request, appoint as member such person, being a person who is experienced in ventilation technology, as he thinks fit.

(2c) A member appointed under sub- section (2) (c) may resign his office at any time by notice in writing delivered to the Minister. "; and

in subsection (4) by deleting "two" and
