In subsection one of section seventeen of the Amendment Principal Act, after the word "prescribed" the words of 8.17. "or in complying with any other provision of this Act" are inserted. 12. The following provision is added to section Amendment eighteen of the Principal Act :_ of s. 18. When the business of a registered firm is carried on in any building, the registered firm name of such firm shall be kept cQnspicuously exhibited on or near the main door or principal entrance thereof. 13. The following provision is added to section Amendment twenty-two of the Principal Act:- of 8.22. Notwithstanding any provision to the contrary in any Act, proceedings for the recovery of penalties imposed by this Act may be commenced at any time within six months next after the fact of the commission of the offence charged came to the knowledge of the complainant. THE MIJ;ES REGULATION [ASSENTED TO 23HD SEPTEMBER, 1912.J ACT AMENDMENT B E it enacted by the King's :Most Excellent Majesty, ACT OF 1912. by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and hy the authority of the same, as follows : - 1. This Act may be cited as "The Mines Regulation shoi·t title Act Amendment A.ct of 1912," and shall be read as one and . with "The Mines Regulation Act of 1910,"* hereinafter construction. • 1 Geo. V. The rrincipal Act and this Act may be cited together as "The Mines Regulation Aats~ 1910 to 1912." Amendment 2. After the word "certificates," in subsection one of s. 26. of section twenty-six of the Principal Act, the words "and licenses" are inserted; and at the end of the said sub- section, the words" Winding licenses" are inserted. After subsection six of the said section, the following subsections are inserted:- (7.) A winding license shall entitle the holder thereof to operate or drive the winding machinery by means 'whereof persons or materials are drawn up; down, or along any shaft, pit, or inclined plane or level in any mine. (8.) Winding licensE'S shall be granted under such conditions as may be prescribed, and shall apply to such class or classes of winding machinery as are respectively specified in such licemes. Winding licenses may be suspended or cancelled on the grounds and in the manner prescribed. No winding license in resl)ect of any machinery to which " l1he Inspection of Machinery and SccifJolding Aat of 1908"* applies shall be grant~ d to any person who does not hold a certificate under that Act entitling him to take and have charge of such machinery; but every extra first-class engine-driver's certificate and winding engine- driver's certificate granted under the said Act, and subsisting at the passing of this Act, shall have the force and effect of a winding' license granted under this Act, and shall be subject in all respects to this Act. Amendment 3. Subsection one of section thirty-three of' the of B. 33. l>rincipal Act is repealed, and the following subsection is inserted in lieu thereof:- (1.) Any person who takes or has charge of Ol~ operates or drives any winding machinery or any winding engine by means whereof persons or materials are drawn up, down, or along any shaft, pit, or inclined plane or level in any mine, and who does not hold the winding license issued under this Act applicable to the clitss of winding machinery in question or such winding engine, shall be guilty of an offence. In subsection two of the said section, the word " uncertificated " is repealed, and the word "unlicensed" is inserted. * 8 Edw. VII. No. 9, infra, page 5761.

In subsection one of section thirty-four of the Amendment Principal Act, the words "certificated engine-driver" are of s. 34. repealed, and the words "licensed winding engine-driver" are inserted. In subsections two and three of the said section, the word" engine-driver" is repealed wherever it occurs, and the words "winding' engine-driver" are respectively in- serted in lieu thereof. 5, After section forty-six of the Principal Act, the following section is inserted : - [46A, ] Before working any coal under Ol~ near any Mininf under road , permanent water , or natural watercourse ,. the owner , rwoaatdesrcaonudrses agent, or manager of the colliery shall give due notice to . the inspector of his intention to work such coal, and the inspector, if he considers that such working is likely to result in damage or danger to such road or to the workings of the same or any other colliery from subsidence whether vertical or lateral, influx of water, or other cause, may, by notice in writing addressed to such owner, agent, or manager, prohibit the working of such coal or limit the working thereof to such extent as he considers necessary. If sueh owner, agent, or manager objects to comply with such notice, he may, within fourteen days after the receipt thereof, make an objection in writing to the Minister; and the Minister, after considering the objec- tion, may confirm the notice, or cancel the same, or modify the same to such extent as he thinks proper.
