MINES INSPECTION (AMENDMENT) ACT, 1977

An Act to amend the Mines Inspection Act, 1901, in relation to the employment of certain persons in or about mines, and for certain other purposes. [Assented to, 7th September, 1977.]

Council and Legislative Assembly of New South Wales in BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative

Parliament assembled, and by the authority of the same, as follows: —

1. This Act may be cited as the "Mines Inspection

(Amendment) Act, 1977".

2. The Mines Inspection Act, 1901, is amended in the

manner set forth in Schedule 1.

SCHEDULE 1.

AMENDMENTS TO THE MINES INSPECTION ACT, 1901.

(1) Section 16 (2)—

Omit "(not exceeding four dollars)".

(2) Section 22—
Omit "but not exceeding four dollars,".

(3) Section 26 (1), (2 )—

Omit the subsections, insert instead :—

(1) Subject to subsection (2) , no person under the age of 16 years shall be employed in or about a mine.

( 2 ) Male persons under the age of 1 6 years but not under the age of 1 5 years may be employed above ground at a mine as probationers, trainee apprentices or indentured apprentices within the meaning of the

Apprentices Act, 1 9 6 9 .
( 4 ) Section 2 8 —

Before section 2 9 , insert :—

2 8 . ( 1 ) The owner or manager of a mine shall keep records indicating, in respect of persons under the age of 1 8 years employed or working in the mine below ground—

(a)

the dates of birth of those persons, duly certified wherever possible; and

(b)

the dates at which those persons were employed or worked in the mine below ground for the first time.

( 2 ) The owner or manager of a mine shall,

on request—

(a)

make available to inspectors the records referred to in subsection ( 1 ) ; and

(b)

make available to representatives of persons who work at the mine lists show­ ing the names of persons under the age of 1 8 years who are employed or work in the mine below ground and the dates recorded in respect of them pursuant to subsection ( 1 ) .

( 5 ) Section 3 1 ( 1 ) —

Omit "this Act with respect to the time for which persons shall not be employed below ground, or to the time for which persons in charge of machinery shall not be employed, or to the employment of persons in contravention of section 26", insert instead "this Division".
