An Act to Amend “ The Miners' Homestead Leases T he M iners ' H omestead Acts, 1913 to 1947,” in certain particulars. L eases A cts A mendment A ct op 1951. [A ssented to 18 th O ctober , 1951.] B E it enacted by tbe King’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— short title 1. This Act may be cited as “ The Miners' Homestead construction. Leases Acts Amendment Act of 1951,” and shall be read as one with * “ The Miners' Homestead Leases Acts, 1913 to 1947,” herein referred to as the Principal Act. Collective The Principal Act and this Act may collectively be tltle- cited as “ The Miners' Homestead Leases Acts, 1913 to 1951.” Amendment 2. Subsection one of section twenty-one of the of s. 2 i(i). principal Act is amended by adding to that subsection the following paragraph, namely :— “ In respect of any and every request for an extension of time as aforesaid a fee amounting to five shillings for each and every application for lease to which that request relates shall be payable.” Amendment 3. Subsection one of section twenty-two of the of s.22(i). Principal Act is amended by adding to that subsection the following paragraph, namely :— “ In respect of any and every application for the grant of exemption as aforesaid a fee amounting to five shillings for each and every lease to which that application relates shall be payable.” Amendment 4. Section twenty-five of the Principal Act is of s. 25 . amended by adding thereto the following subsection, namely:— “ (4.) In respect of any and every sublease there shall be payable a registration fee of ten shillings and, for endorsing a memorial of the sublease on each and every lease included therein, an additional fee amounting to two shillings and sixpence for each and every one «f those leases.” * 4 G. 5 No. 14 and amending Acts.

Section twenty-eight of the Principal Act is Amendments amended as follows :— ° s‘ * (а) The words “ ten shillings,” where appearing in the first paragraph of that section, are repealed and, in lieu of those repealed words, the words “ one pound ” are inserted. (б) The following paragraph is inserted after the fourth paragraph of that section, namely :— “ In respect of any and every subdivisional plan as aforesaid, an examination fee amounting to two pounds for each and every subdivision comprising an area capable of being transferred set out in that plan shall be payable.” (c) The words “ subject to and upon payment of a fee of one pound and one shilling ” are added to the fifth paragraph of that section. 6. Section twenty-nine of the Principal Act is ^® 2 ^nent3 amended as follows :— " " (a) The last paragraph of subsection three of that section is repealed and, in lieu of that repealed paragraph, the following paragraph is inserted, namely :— “ In respect of any and every registration of a mortgage as aforesaid there shall be payable a registration fee of five shillings and, for endorsing a memorial of the mortgage on each and every lease subject thereto, an additional fee amounting to two shillings and sixpence for each and every one of those leases.” (b) Subsection four of that section is repealed and, in lieu of that repealed subsection, the following subsection is inserted, namely :— “ (4.) A mortgage may be transferred. In respect of any and every registration of a transfer of a mortgage, there shall be payable a registration fee of five shillings and, for endorsing a memorial of the transfer of the mortgage upon each and every lease subject to that mortgage, an additional fee amounting to two shillings and sixpence for each and every one of those leases.”

Section thirty-nine of the Principal Act is °fs.3®. amended by adding to that section the following paragraph, namely “ In respect of any and every application for entry of transmission consequent on the death of a lessee (including any transmission to which the foregoing provisions of this section apply) a fee amounting to ten shillings for each and every lease to which that application relates shall be payable.” 15 GBO. This Act may be cited as “ The Mining Acts construction .Amendment Act of 1951,” and shall be read as one with * “ The Mining Acts, 1898 to 1948,” herein referred to as the Principal Act. Collective The Principal Act and this Act may be cited 1 e‘ collectively as “ The Mining Acts, 1898 to 1951 ”. Amendments of s. 183 b . 2. Section 183 b of the Principal Act is amended — * (a) By repealing the second paragraph (being the paragraph commencing with the words “ Upon such reference ”) of subsection one thereof and by inserting, in lieu of that repealed paragraph, the following paragraph, namely:— “ Upon such reference the Minister in his absolute discretion— (i.) May fix as conditions— (a) That, with respect to any and every method of mining carried on or intended to be carried on in or upon the land * 62 V. No. 24 and amending Acts.
