This Act may be cited as " The Miners' Homestead :!truction. Leases Acts Amendment Act of 1947," and shall be read as one with *" The Miners' Homestead Leases Acts, 1913 to 1939," herein referred to as the Principal Act. All miners' homestead leases granted under the principal Act and subsisting at the date of the passing of this Act shall, until the same are surrendered or resumed or the existing title thereto is otherwise deter- mined, continue to be subject to *" The JJliners' Homestead Leases Acts, 1913 to 1947," as if this section had not been passed. ( 3~) Any application for a miner's homestead lease made and recommended by the warden under the Principal Act but not finally approved at the date of the passing of this Act may, at the option of the applicant, be treated and finally dealt with as an application for a miner's homestead perpetual lease. * 4 G. 5 No. 14 and amending Acts.
MINING. 255 1947. Miners' Homestead Leases, Etc., Act. A mendments of the Principal Act. 3. In section three of the Principal Act the Amendment definitions "Miner's Homestead Lease" and "Miner's of s. 3. Homestead Perpetual Lease" are repealed and the following definitions are inserted in lieu thereof, namely:- " " Miner's homestead lease "-Any miner's home- Miner's stead lease granted under this Act or under romestead Part VIII. of the Principal Act or under any ease. Section 19A of the Principal Act is amended as Amendment follows :- of s. 19A. (a) In the first paragraph thereof the words and brackets" a miner's homestead lease or miner's home- stead perpetual lease (as the case may be) " are repealed and the words "a miner's homestead perpetual lease" are inserted in lieu thereof. (b) In the third paragraph thereof the words and brackets" miner's homestead leases or miner's homestead perpetual leases (as the case may be) " are repealed and the words "miners' homestead perpetual leases" are inserted in lieu thereof. 7. Section twenty-one of the Principal Act is Amendment amended as follows :- of s. 21. (i.) The following paragraph is inserted after paragraph (b) of subsection one thereof, namely:- "(c) If the land is situated within any city, town, or township and the Minister has by the notification declaring the land open for sal~

No. 30,1947. as a miner's homestead by public auction imposed a condition that improvements of a value in excess of twenty-five pounds shall be made thereon, within six months after the date of the notice or such longer period of time thereafter as the Minister shall have specified in the notification, make improve- ments on the land of a value of not less than the amount in excess of twenty-five pounds specified in the notification. An applicant or purchaser required to comply with the provisions of this paragraph (c) shall, in addition, comply with the condition of residence where such lastmentioncd condition is applicable in his case." (ii.) The last paragraph of, being the proviso to, subsection one thereof is amended by inserting the words "or any of them" after the words "foregoing conditions. " (iii.) In subsection six thereof the words and brackets" a miner's homestead lease or miner's home- stead perpetual lease (as the case may be) " are repealed and the words" a miner's homestead perpetual lease" are inserted in lieu thereof. Amendment 8. Subsection one of section twenty-five of the ofa. 25 (1). Principal Act is amended by adding the following paragraph thereto, namely :- "Any sublessee may, with the approval of the Minister and the consent of the lessee, transfer or sublet his sublease: Provided that every such transfer or sublease shall be in writing, and in duplicate, and one copy thereof shall be registered at the warden's office."
