93 ANNO VICESIMO OCTAVO ELIZABETHAE SECUNDAE REGINAE No. 8 of 1979 An Act to amend the Miners' Homestead Leases Act 1913-1978 in certain particulars and for another purpose [ASSENTED TO 20TH APRIL, 1979] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Miners' Homestead Leases Act Amendment Act 1979. (2) The Miners' Homestead Leases Act 1913-1978 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Miners' Homestead Leases Act 1913-1979.
94 Miners ' Homestead Leases Act Amendment Act 1979, No. 8 2. New s. 5A. The Principal Act is amended by inserting after section 5 the following section:- " 5A. Variation of mining field not to affect miners ' homesteads. Where the Governor in Council varies the boundaries of a mining field whereby any area of land is excluded from the field it is hereby declared that- (a) any miner's homestead lease or miner 's homestead perpetual lease granted or any application for or purchase of a miner's homestead lease or miner's homestead perpetual lease approved in respect of land within the limits of that area shall continue in force and be subject to the provisions of this Act; and (b) the rights and liabilities of the lessee of or, as the case may be, applicant for or purchaser of a miner's homestead lease or miner's homestead perpetual lease under this Act shall continue, as if that area had not been excluded from the field.". 3. Amendment of s. 21. Section 21 of the Principal Act is amended by omitting subsection (3). 4. Negation of s. 21 ( 3) of Principal Act. It is hereby declared that, notwithstanding the provisions of the repealed section 21 (3) of the Principal Act, where at any time prior to the commencement of this Act the applicant for or purchaser of a miner's homestead failed to comply with the provisions of section 21 of the Principal Act he shall not be deemed to have abandoned the miner's homestead.
