424 QttEEI shutz^ ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 55 of 1978 An Act to amend the Miners ' Homestead Leases Act 1913-1976 in certain particulars [ ASSENTED TO 22ND AUGUST, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Miners' Homestead Leases Act Amendment Act 1978. (2) In this Act the Miners' Homestead Leases Act 1913-1976 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Miners' Homestead Leases Act 1913-1978.

Miners' Homestead Leases Act Amendment Act 1978, No. 55 425 2. Amendment of s. 6. Section 6 of the Principal Act is amended by omitting subsection (1) and substituting the following subsection:- " (1) A person shall not hold within the same mining field a miner's homestead or miner's homesteads of an area greater than the following that is to say- (a) within the boundaries of a city, town or township, 4 000 square metres or such other area greater than 4 000 square metres as the Governor in Council, upon the report of the warden, may approve; (b) outside the boundaries of a city, town or township, 32 hectares or such other area greater or less than 32 hectares as the Governor in Council may by Order in Council declare to be the maximum area for miner's homesteads in the particular mining field or in the part of the mining field in which the miner's homestead or miner's homesteads is or are situated.". 3. Amendment of s. 19. Section 19 of the Principal Act is amended by omitting subsection (4) and substituting the following subsection:- " (4) The upset price of land within a city, town or township shall be not less than $25 per hectare.".
