MINERS' ACCIDENT RELIEF
(SUPPLEMENTAL) ACT.
Act No. 13, 1928.
An Act to provide for the grant of certain allow ances in addition to those already provided for under the Miners' Accident Relief (Repeal) Act, 1916; and for the payment thereof out of the Consolidated Revenue Fund ; and for purposes connected therewith. [Assented to, 16th June, 1928.]
lative Council and Legislative Assembly of New South BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis Wales in Parliament assembled, and by the authority of the same, as follows :—
1 . (1) This Act may be cited as the "Miners ' Accident Relief (Supplemental) Act, 1928," and shall be read and construed with the Miners' Accident Relief (Repeal) Act, 191(3.
(2) This Act shall be deemed to have commenced on the first day of April, one thousand nine hundred and twenty-eight.
2 . (1) Subject to this section, there may be granted under the provisions of the Miners' Accident Relief (Repeal) Act, 1916 —
(b) (a)
to each male person who by reason of his dis ablement is for the time being in receipt of an allowance under the Miners' Accident Belief (Repeal) Act, 1916, an additional allowance not exceeding five shillings per week;
(b)
to each female person who by reason of any fatal accident is at any time in receipt of an allowance under the said Miners' Accident Relief (Repeal) Act, 1910, a like additional allowance.
(2) Such additional allowance shall not be paid—
(a) to any person during residence outside the Commonwealth of Australia; (b) to any person who is in receipt of such a pension or allowance under any Act of the Parliament of the Commonwealth of Australia or any Act of the Legislature of New South Wales or from the National Relief Fund of New South "Wales as when taken with the allowance payable under the Miners' Accident Relief (Repeal) Act, 1910, equals or exceeds in respect of himself alone the sum of— (i) one pound per week in the case of a male person ;
(ii) fifteen shillings per week in the case of a female person;
(c) to any person in receipt of an allowance only in respect of a child.
(3) Allowances granted in pursuance of this Act shall ho granted for the period of one year, and shall be reviewed by the Minister annually.
(1) During the period for which an allowance granted in pursuance of this Act is granted, the allow ance shall not be affected by reason of the fact that within that period the person to whom the allowance
| has been granted has also been granted such a pension or allowance as is referred to in paragraph (b) of subsection | two of this section. |
| 3 . Allowances granted in pursuance of this Act may be paid out of the Consolidated Revenue Fund upon the certificate of the Minister without any further or other appropriation than this Act. |
