  1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Queensland.  As to the first, second and third proposed grounds of appeal, there is no reason to doubt the correctness of the Court of Appeal's construction of the guarantee.  As to the fourth proposed ground of appeal, the matter is not a suitable vehicle for the consideration of the legal principle that is advanced by the applicant.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
