Mineral Resources (Sustainable Development) (Mineral Industries) Amendment Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Mineral Resources (Sustainable Development) (Mineral Industries) Regulations 2019 to require minor variations to work plans and associated information to be recorded in the mining register under Part 6 of the Mineral Resources (Sustainable Development) Act 1990.

2Authorising provision

These Regulations are made under section 124 of the Mineral Resources (Sustainable Development) Act 1990.

3Commencement

These Regulations come into operation on 20 October 2025.

4Principal Regulations

In these Regulations, the Mineral Resources (Sustainable Development) (Mineral Industries) Regulations 2019[1] are called the Principal Regulations.

5Definitions

(1)In regulation 4 of the Principal Regulations, in the definition of work plan area, for "carried out." substitute "carried out;".

(2)In regulation 4 of the Principal Regulations insert the following definition—

"work plan minor variation, in relation to an approved work plan, means a variation to the work plan that the Department Head determines to be a minor variation under section 41AAA of the Act.".

6New regulation 64S inserted

After the heading to Part 6 of the Principal Regulations insert

"64S   Documents required to be recorded in the mining register

For the purposes of section 69(2)(a)(xvii) of the Act, an instrument setting out a work plan minor variation is a prescribed document.".

7Information in documents required to be recorded in the mining register

After the last item in the table in Schedule 13 to the Principal Regulations insert

"section 69(2)(a)(xvii) Instrument of work plan minor variation of a licence Licence type/number, Name/s of licensee/s, Address/es of licensee/s, Date of variation, Description of the general nature and purpose of the minor variation, Stratum of land (if relevant)".
