s 1 25 s 2 Mineral Resources Regulation 1990 MINERAL RESOURCES REGULATION 1990 [as amended by all amendments that commenced on or before 25 July 2003] PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Mineral Resources Regulation 1990 . 2 Deﬁnitions In this regulation— “average market price” , for a mineral, means the average settlement price for the mineral over a royalty period on— (a) for gold or silver—the London Bullion Market; or (b) for copper, lead or zinc—the London Metal Exchange. “designated fossicking land” has the meaning given by the FossickingAct 1994 . “plan” , in relation to a restricted area, means a plan held in the ofﬁce of the department. “reference price” , for copper, gold, lead, silver or zinc—see schedule 1, section 4. “reference price 1” —see schedule 1, section 4. “reference price 2” —see schedule 1, section 4. “reference price 3” —see schedule 1, section 4. “royalty base rate” , for copper, gold, lead, silver or zinc—see schedule 1, section 5. “royalty period” means— (a) the ﬁnancial year covered by a royalty return; or

s 3 26 s 7 Mineral Resources Regulation 1990 (b) if the Minister has approved a different year for a royalty return—the year approved by the Minister. “yearly rental” means the amount of rent payable for a calendar year. 3 Meaning of “block identiﬁcation map” A “block identiﬁcation map” is a map that forms part of the series of 17 maps known as ‘Block Identiﬁcation Map—Series B’ held in the ofﬁce of the department. 4 Meaning of “restricted area” A “restricted area” is the land included in an area speciﬁed by schedule 4, part 2 to be a restricted area. 5 Naming convention for restricted areas In this regulation, the portion of schedule 4, part 2 that relates to a particular restricted area may be referred to by the same designation as the restricted area. Example — The portion of schedule 4, part 2 relating to Restricted Area 1 may be referred to as ‘Restricted Area 1’. 6 Forms (1) The prescribed forms for the purposes of the Act are the forms approved by the Minister. (2) A person may request the chief executive to give the person a document setting out a form approved under subsection (1). (3) The chief executive must promptly comply with a request under subsection (2). 7 Fees (1) The fees set out in schedule 2 are the prescribed fees to be paid for the purposes specified in that schedule.

s 8 27 s 9 Mineral Resources Regulation 1990 (2) The chief executive or a mining registrar is not to record any action or dealing for which a fee is prescribed until payment of that fee is made. PART 2—MINING DISTRICTS 8 Mining districts (1) The land included in each part of schedule 5 is a mining district. (2) Each mining district is assigned the name stated in the part heading. PART 3—PROSPECTING PERMITS 9 Conditions of prospecting permit For the purposes of section 25 of the Act the prescribed conditions of a prospecting permit are that the holder of the prospecting permit and all persons acting under the authority of the permit— (a) are to use existing roads or tracks on occupied land where practicable to do so; (b) are to take every precaution to ensure there is no dispersal of parthenium weed seed or the seed of any other declared plant within the meaning of the Rural Lands Protection Act 1985 as a result of activities carried on under the authority of the permit; (c) are to gain access to occupied land only at a point or points designated by a mining registrar unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar; (d) are to restrain animals in the custody of that person or those persons on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar;

s 10 28 s 10 Mineral Resources Regulation 1990 (e) are not to discharge a ﬁrearm on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar; (f) are not to light open ﬁres unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar; (g) for unoccupied land—must ensure rubbish and human waste is disposed of in a safe and sanitary way. 10 Register of prospecting permits (1) A mining registrar must record the following particulars of each application for a prospecting permit and each prospecting permit in the register— (a) name of holder; (b) address for service of notices on the holder; (c) number of the permit; (d) category of the permit; (e) date of application for the permit; (f) date of grant of the permit or rejection of application for the permit; (g) date of commencement of the permit; (h) date of expiry, cancellation or surrender of the permit; (i) security required under section 26 of the Act; (j) description of land comprised in the permit and access to that land; (k) any special conditions upon which the permit is granted; (l) consents. (2) The register may be searched only by the owner of the land during the hours prescribed for the conduct of business at the office of the mining registrar on payment of the prescribed fee. (3) The register may be maintained manually, on computer disc or in such other form as may be adopted by direction from the chief executive.

s 11 29 s 13 Mineral Resources Regulation 1990 11 Security for prospecting permits The amount of security a mining registrar ﬁxes for a district prospecting permit must not be less than $1 000. PART 4—MINING CLAIMS 12 Conditions of mining claim For the purposes of section 81 of the Act the prescribed conditions of a mining claim are that the holder and all persons acting under the authority of the mining claim— (a) are to ensure there is no dispersal of parthenium weed seed or the seed of any other declared plant within the meaning of the RuralLands Protection Act 1985 as a result of mining activities or as a result of access to the area of the claim; (b) are to restrain animals in the custody of that person on the land comprised in the claim unless the area of the claim is fenced in such a manner as to contain those animals; (c) are not to discharge a ﬁrearm on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar. 13 Register of mining claims (1) A mining registrar must record the following particulars of each application for a mining claim and each mining claim in the register— (a) name of each holder and interest held; (b) name and address of 1 person for service of notices on the holder; (c) name of mining claim; (d) number of mining claim; (e) mining district in which the land the subject of the mining claim is situated; (f) locality;

s 14 30 s 14 Mineral Resources Regulation 1990 (g) date and time of marking out; (h) date and time of application; (i) date certiﬁcate of application issued; (j) date of grant of mining claim or abandonment or rejection of application; (k) term; (l) renewals; (m) date of expiry, cancellation or surrender; (n) area; (o) local government; (p) caveats; (q) warrants of execution; (r) annual rental; (s) security required under section 83 of the Act; (t) minerals sought. (2) The register may be searched during the hours prescribed for the conduct of business at the office of the mining registrar on payment of the prescribed fee. (3) The register may be maintained manually, on computer disc or in such other form as may be adopted by direction from the chief executive. 14 Request for registration of execution (1) A request for registration of an execution of the interest of a holder of a mining claim is to be made to the mining registrar in the approved form and is to be accompanied by— (a) an ofﬁce copy or a certiﬁed copy of the execution evidencing the authority to seize and sell the interest; and (b) the prescribed fee. (2) The assignment of the interest pursuant to registration of an execution is to be in the approved form and is to be accompanied by the prescribed assignment fee.

s 15 31 s 16 Mineral Resources Regulation 1990 15 Excavations near railway land (1) The holder of or applicant for a mining claim is not to make any excavation within a distance of 12 m in a horizontal direction or of 15 m in a vertical direction from any embankment, cutting, bridge, pier, culvert, drain or other work on a railway line passing over or near to the land comprised in the mining claim or application without the authority in writing of the chief executive of Queensland Rail. Maximum penalty—200 penalty units. (2) The request for the authority of the chief executive of Queensland Rail is to be made in the first instance to the chief executive. 16 Moving datum post after survey of contiguous land (1) Where the land the subject of an application for a mining claim is shown in the application as being contiguous with other land which is the subject of— (a) a mining claim; or (b) a mining lease; or (c) an application for a mining claim; or (d) an application for a mining lease; and that other land is not surveyed, then, within 14 days (or such longer period as the Minister in the particular case allows) after the mining registrar has notiﬁed the applicant for the mining claim in writing that a survey of that other land has been completed and that all survey marks deﬁning the boundary of the other land have been placed, the applicant for the ﬁrst mentioned mining claim may adjust the marking out of the land so that the land applied for is still contiguous with that other land as surveyed and may be surveyed accordingly. (2) Subsection (1) does not authorise the adjustment of the marking out of any land so as to include land which was not land to which the applicant’s prospecting permit applied at the date of application for the mining claim, or the surveying of that land. (3) When the marking out of the land comprised in the application has been adjusted or the land has been surveyed, the land is to be the land marked out and applied for by the applicant pursuant to the provisions of the Act.

s 17 32 s 20 Mineral Resources Regulation 1990 17 Instrument of mortgage A mining registrar is not to record particulars of a mortgage over a mining claim unless 2 copies of the executed instrument of mortgage are lodged with the mining registrar in the approved form and accompanied by the prescribed fee. 18 Sale by mortgagee (1) When a mortgagee exercises a power of sale contained or implied in a mortgage over a mining claim the mortgagee is to— (a) furnish the mining registrar with satisfactory evidence that the power of sale has been properly exercised; and (b) submit the assignment of the interest pursuant to the exercise of the power of sale in accordance with the provisions of section 96 of the Act; and (c) pay the prescribed assignment fee. (2) An assignment by a mortgagee exercising a power of sale under a mortgage over a mining claim is to be made in the approved form and is to be accompanied by— (a) a copy of the government gazette and of a newspaper circulated in the locality, containing the notice of the mortgagee’s intention to sell; and (b) the certiﬁcate of grant of the mining claim; and (c) the duplicate of the mortgage under which the sale was made. 19 Rental payable on a mining claim The yearly rental payable on a mining claim is prescribed in schedule 3. 20 Area of mining claim land The area of a mining claim over speciﬁed land in a mining district speciﬁed in schedule 6 must not be more than the area speciﬁed for the land in schedule 6.

s 21 33 s 21 Mineral Resources Regulation 1990 21 Permitted equipment and prohibited machinery on mining claims (1) The following equipment may be used for prospecting or hand mining on land in a mining claim— (a) a pick, shovel, hammer, gad or sieve; (b) powered machinery that is not prohibited machinery. (2) Prohibited machinery must not be used for prospecting or hand mining on land in a mining claim. (3) Prohibited machinery may only be used to— (a) transport— (i) mineral bearing ore or wash; or (ii) equipment (including machinery), materials or water, that is used in connection with mining operations; or (b) build storage facilities for water that is used in connection with mining operations; or (c) rehabilitate the surface area of land in a mining claim. (4) In this section— “powered machinery” — (a) means a mechanical device powered by air, electricity, gas, internal combustion, steam or water; and (b) includes the following— (i) a classiﬁer, compressor, drier, drill (other than a vehicle mounted drill), elevator, feeder, ﬁlter, hoist, jack-pick, puddler, pulsator, pump, separator, shaker, shute, trommel, vibrator, willoughby, winch and windlass; (ii) for land within the Mareeba mining district—an eductor dredge that— (A) has a maximum inlet nozzle diameter of 200 mm; and (B) is used when water ﬂows in the Palmer river, Mitchell river or their tributaries; (iii) for land in restricted area 1 in the Emerald mining district, restricted area 25 in the Quilpie mining district or restricted area 77 in the Winton mining district—

s 23 34 s 23 Mineral Resources Regulation 1990 (A) a vehicle mounted drill with a maximum diameter of 25 cm used for exploration drilling; and (B) a vehicle mounted drill with a maximum diameter of 1 m used for drilling access shafts. “prohibited machinery” means any of the following powered machinery— (a) a backhoe, bobcat, bucket excavator, bulldozer, clamshell, continuous miner, dragline, dredge, end-loader, excavator, grader, loader, ripper, rooter, scariﬁer, scoop, scoopmobile, scraper, tractor or traxcavator; (b) a cart, crane, locomotive, monorail, motor vehicle (with or without a trailer) or ropeway. PART 5—EXPLORATION PERMITS 23 Conditions of exploration permit For the purposes of section 141 of the Act the prescribed conditions of an exploration permit are that the holder of an exploration permit and all persons acting under the authority of the permit— (a) are to use existing roads or tracks on occupied land where practicable to do so; (b) are to take every precaution to ensure there is no dispersal of parthenium weed seed or the seed of any other declared plant within the meaning of the Rural Lands Protection Act 1985 as a result of activities carried on under the authority of the permit; (c) are to gain access to occupied land only at a point or points designated by the mining registrar unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive; (d) are to restrain animals in the custody of that person or those persons on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with

s 24 35 s 24 Mineral Resources Regulation 1990 the mining registrar and forwarded a copy of that consent to the chief executive; (e) are not to discharge a ﬁrearm on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive; (f) are not to light open ﬁres unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive. 24 Register of exploration permits (1) The chief executive must record the following particulars of each application for an exploration permit and each exploration permit in the register— (a) name of each holder and interest held; (b) name and address of 1 person for service of notices on the holder; (c) number of the permit; (d) mining district in which land over which the permit is granted or sought is situated; (e) locality; (f) date of application for the permit; (g) date of grant of the permit or abandonment or rejection of application; (h) date of commencement of the permit; (i) term; (j) area and reductions; (k) renewals; (l) date of expiry, cancellation or surrender of the permit; (m) annual rental; (n) security required pursuant to section 144 of the Act;

(2) The register may be searched during the hours prescribed for the conduct of business at the office of the mining registrar for the mining district of Brisbane on payment of the prescribed fee. (3) The register may be maintained manually, on computer disc or in such other form as may be adopted by the chief executive. 25 Land subject to exploration permit For the purposes of section 127(4) of the Act, the area prescribed is— (a) in respect of coal—300 sub-blocks; and (b) for all minerals other than coal—100 sub-blocks. 26 Application for exploration permit (1) For the purposes of section 133(f) of the Act the office prescribed for the receipt of applications for exploration permits is any office of a mining registrar. (2) Where a mining registrar refuses to accept the lodgment of a document as an application for an exploration permit the mining registrar is to retain a copy of the document and inform the person lodging the document that the lodgment has not been accepted and of the reasons therefor. 27 Numbering of application (1) The mining registrar is to allocate to each application for the grant of an exploration permit the next available number by reference to the last number allocated to an exploration permit or application for an exploration permit of that type recorded in the register maintained by the chief executive. (2) The number allocated to an exploration permit is to include identification of the type of exploration permit by reference to coal or mineral other than coal or specified minerals the subject of the permit by a consistent method approved by the chief executive.

s 28 37 s 29 Mineral Resources Regulation 1990 28 Rental payable on exploration permit The rental payable on an exploration permit is prescribed in schedule 3. PART 6—MINERAL DEVELOPMENT LICENCES 29 Conditions of mineral development licence For the purposes of section 194 of the Act the prescribed conditions of a mineral development licence are that the holder of the mineral development licence and all persons acting under the authority of the licence— (a) are to use existing roads or tracks on occupied land where practicable to do so; (b) are to take every precaution to ensure there is no dispersal of parthenium weed seed or the seed of any other declared plant within the meaning of the Rural Lands Protection Act 1985 as a result of activities carried on under the authority of the licence; (c) are to gain access to occupied land only by the access approved by the Minister; (d) are to restrain animals in the custody of that person or those persons on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive; (e) are not to discharge a ﬁrearm on occupied land unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive; (f) are not to light open ﬁres unless the holder has obtained the consent in writing of the owner and has lodged that consent with the mining registrar and forwarded a copy of that consent to the chief executive.

(2) An assignment by a mortgagee exercising power of sale under a mortgage over a mineral development licence, is to be made in the approved form and is to be accompanied by— (a) a copy of the government gazette and of a newspaper circulated in the locality, containing the notice of the mortgagee’s intention to sell; and (b) the instrument of mineral development licence; and (c) the duplicate of the mortgage under which the sale was made.
