Mineral Resources Amendment Regulations (No. 2) 2011

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Mineral Resources Development Act 1995 .5 December 2011

1Short titleThese regulations may be cited as the Mineral Resources Amendment Regulations (No. 2) 2011 . 2CommencementThese regulations take effect on 1 January 2012. 3Principal RegulationsIn these regulations, the Mineral Resources Regulations 2006 are referred to as the Principal Regulations. 4Regulation 7 amended (Prescribed rates of royalty) Regulation 7 of the Principal Regulations is amended as follows: (a) by omitting the formula from subregulation (3) and substituting the following formula: (b) by omitting from subregulation (4) "5%" and substituting "5.35%"; (c) by omitting from subregulation (5) "1.6%" and substituting "1.9%"; (d) by omitting the formula from the definition of net sales royalty in subregulation (7) and substituting the following formula: 5Schedules 1 , 2 and 3 amended Schedules 1 , 2 and 3 to the Principal Regulations are rescinded and the following is substituted: Schedule 1Royalties

(l) building and dimension stone, per cubic metre	$5.50
(m) crushed and broken stone, per tonne	$0.66
(n) magnesite for chemical and metallurgical use, per tonne	$1.32 or 5.35% of sales value, whichever is the greater
(o) magnesite for other uses, per tonne	$0.66
(p) geothermal substance	2.75% of the value of sale at the well head
(q) iron oxide used in pigment manufacture, per tonne	$1.32

(This note is not part of the regulation) These regulations amend the

(a) the prescribed rates of royalty payable by lessees and licensees in respect of minerals; and (b) the fees specified in Schedule 2 to those regulations; and (c) the rent payable for land over which licences and leases are granted.
