s1 2 s3 Mineral Resources Amendment (No. 4) No. 247, 1997 ˙ Short title 1. This regulation may be cited as the Mineral Resources Amendment Regulation (No. 4) 1997 . ˙ Regulation amended 2. This regulation amends the Mineral Resources Regulation 1990 . ˙ Replacement of ss 21 and 22 3. Sections 21 and 22— omit, insert— ˙ ‘ Permitted equipment and prohibited machinery on mining claims ‘ 21.(1) The following equipment may be used for prospecting or hand mining on land in a mining claim— (a) a pick, shovel, hammer, gad or sieve; (b) powered machinery that is not prohibited machinery. ‘ (2) Prohibited machinery must not be used for prospecting or hand mining on land in a mining claim. ‘ (3) Prohibited machinery may only be used to— (a) transport— (i) mineral bearing ore or wash; or (ii) equipment (including machinery), materials or water, that is used in connection with mining operations; or (b) build storage facilities for water that is used in connection with mining operations; or (c) rehabilitate the surface area of land in a mining claim. ‘ (4) In this section— “powered machinery” — (a) means a mechanical device powered by air, electricity, gas, internal combustion, steam or water; and
s4 3 s4 Mineral Resources Amendment (No. 4) No. 247, 1997 (b) includes the following— (i) a classifier, compressor, drier, drill (other than a vehicle mounted drill), elevator, feeder, filter, hoist, jack-pick, puddler, pulsator, pump, separator, shaker, shute, trommel, vibrator, willoughby, winch and windlass; (ii) for land within the Mareeba mining district—an eductor dredge that— (A) has a maximum inlet nozzle diameter of 200 mm; and (B) is used when water flows in the Palmer river, Mitchell river or their tributaries; (iii) for land in restricted area 25 within the Quilpie mining district— (A) a vehicle mounted drill with a maximum diameter of 25 cms used for exploration drilling; and (B) a vehicle mounted drill with a maximum diameter of 1 m used for drilling access shafts. “prohibited machinery” means any of the following powered machinery— (a) a backhoe, bobcat, bucket excavator, bulldozer, clamshell, continuous miner, dragline, dredge, end-loader, excavator, grader, loader, ripper, rooter, scarifier, scoop, scoopmobile, scraper, tractor or traxcavator; (b) a cart, crane, locomotive, monorail, motor vehicle (with or without a trailer) or ropeway.’. ˙ Amendment of sch 4 (Restricted areas) 4. Schedule 4, part 2, restricted area 25, section 2— insert— ‘ (6) An access shaft must not have a diameter of more than 1 m. ‘ (7) No more than 3 access shafts may be open at any time.’.
