s1 3 s6 Mineral Resources Amendment (No. 4) No. 148, 1994 ˙ Short title 1. This regulation may be cited as the Mineral Resources Amendment Regulation (No. 4) 1994 . ˙ Regulation amended 2. This regulation amends the Mineral Resources Regulation 1990 . ˙ Amendment of s 1.4 (Definition) 3. Section 1.4— insert— “designated area” has the meaning given by the Mining (Fossicking) Act1985 ;’. ˙ Amendment of s 3.2 (Register of prospecting permits) 4. Section 3.2(1), from ‘is to record’ to ‘therefor’— omit, insert— ‘must record the following particulars of each application for a prospecting permit and each prospecting permit’. ˙ Amendment of s 4.2 (Register of mining claims) 5. Section 4.2(1), from ‘is to record’ to ‘therefor’— omit, insert— ‘must record the following particulars of each application for a mining claim and each mining claim’. ˙ Insertion of new ss 4.9–4.11 6. After section 4.8— insert—
s6 4 s6 Mineral Resources Amendment (No. 4) No. 148, 1994 ˙ Area of mining claim land 4.9 The area of a mining claim over land in a designated area or restricted area in a mining district specified in Schedule 7 must not be more than the area specified for the land in Schedule 7. ˙ Use of machinery on mining claim land 4.10(1) The following types of machinery, mechanical devices or other equipment may be used for prospecting or hand mining on land in a mining claim— (a) picks, shovels, hammers, gads, sieves; (b) internal combustion, gas, air, electricity, water or steam powered mechanical devices. (2) The mechanical devices mentioned in subsection (1)(b) include windlasses, winches, shutes, feeders, pulsators, trommels, jack-picks, compressors, hoists, pumps, drills, elevators, shakers, vibrators, willoughbys, driers, separators, filters, classifiers and puddlers. ˙ Prohibited machinery on mining claim land 4.11(1) The following types of internal combustion, gas, air, electricity or steam powered machinery, mechanical devices or other equipment may not be used in, on or under land in a mining claim in any part of the State— (a) rippers, bulldozers, tractors, graders, loaders, end-loaders, draglines, excavators, bobcats, traxcavators, backhoes, scrapers, bucket excavators, continuous miners, scoopmobiles, scoops, scarifiers, rooters, dredges, clamshells; (b) cranes, locomotives, ropeways, monorails, carts and motor vehicles, including trucks and trailers. (2) Subsection (1) does not apply to machinery, mechanical devices or other equipment mentioned in the subsection used to— (a) transport mineral bearing ore or wash, water, machinery, mechanical devices, other equipment and materials used in connection with mining operations; or (b) build storage facilities for water used in connection with mining

Section 5.2(1), from ‘The Director-General’ to ‘therefor’— omit, insert— ‘The chief executive must record the following particulars of each application for an exploration permit and each exploration permit’. ˙ Amendment of s 6.2 (Register of mineral development licences) 8. Section 6.2(1), from ‘The Director-General’ to ‘therefor’— omit, insert— ‘The chief executive must record the following particulars of each application for a mineral development licence and each mineral development licence’. ˙ Amendment of s 7.2 (Register of mining leases) 9. Section 7.2(1), from ‘is to record’ to ‘therefor’— omit, insert— ‘must record the following particulars of each application for a mining lease and each mining lease’. ˙ Amendment of Sch 5 (Restricted areas) 10.(1) Schedule 5, Part 2, Restricted Area 1, clause 2— insert— (2) Restrictions 2(5) and 3(3) also apply to land within the boundaries shown on Plan Nos 34340 and 40862. (3) For restriction 2(5), the area is— (a) for a mining lease for specified minerals for land within the boundaries shown on—
s 10 6 s 10 Mineral Resources Amendment (No. 4) No. 148, 1994 (i) Plan No. 34340—20 ha; and (ii) Plan No. 40862—100 ha; and (b) for a mining lease for specified purposes (other than mining or diverting or appropriating water)—4 ha. (4) For restriction 3(3), the number of mining leases for specified purposes (other than mining or diverting or appropriating water) is 2.’. (2) Schedule 5, Part 2, Restricted Area 25, clause 2— insert— (2) Restriction 1(5) also applies to land within the boundaries shown on Plan No. 30692. (3) Restrictions 2(5) and 3(3) also apply to land within the boundaries shown on Plan No. 30953 (other than land within the boundaries shown on Plan No. 30692). (4) For restriction 2(5), the area is— (a) for a mining lease for specified minerals—2 ha; and (b) for a mining lease for specified purposes (other than mining)—4 ha. (5) For restriction 3(3), the number of mining leases is— (a) for a mining lease for specified minerals—2; and (b) for a mining lease for specified purposes (other than mining)—2.’. (3) Schedule 5, Part 2, Restricted Area 26, clause 2— insert— (2) Restriction 1(5) also applies to land within the boundaries shown on Plan Nos 31027 and 31028.’. (4) Schedule 5, Part 2, Restricted Area 35, clause 2— insert— (2) Restriction 1(5) also applies to land within the boundaries shown on Plan No. 41144.’. (5) Schedule 5, Part 2, Restricted Area 77, clause 2—
