s1 2 s5 Mineral Resources Amendment (No. 3) No. 277, 1999 ˙ Short title 1. This regulation may be cited as the Mineral Resources Amendment Regulation (No. 3) 1999 . ˙ Regulation amended 2. This regulation amends the Mineral Resources Regulation 1990 . ˙ Amendment of s 21 (Permitted equipment and prohibited machinery on mining claims) 3. Section 21(4), definition “powered machinery”, paragraph (b)(iii), words before subparagraph (A)— omit, insert— ‘(iii) for land in restricted area 1 in the Emerald mining district, restricted area 25 in the Quilpie mining district or restricted area 77 in the Winton mining district—’. ˙ Amendment of sch 1 (Rate of royalties) 4. Schedule 1, section 13, definitions “open-cut coal mine” and “underground coal mine”— omit, insert— “open-cut coal mine” means a surface mine under the CoalMiningSafety and Health Act 1999 . “underground coal mine” means an underground mine under the CoalMining Safety and Health Act 1999 .’. ˙ Amendment of sch 4 (Restricted areas) 5.(1) Schedule 4, part 2, under headings ‘Restricted Area 1’ and ‘Restricted Area 25’, section 2— insert— (8) Opened access shafts must be interconnected for ventilation and egress while mining is carried on.
s5 3 s5 Mineral Resources Amendment (No. 3) No. 277, 1999 (9) Access shafts must be backfilled when mining ends.’. (2) Schedule 4, part 2, under heading ‘Restricted Area 77’, section 2— insert— (3) An access shaft must not have a diameter of more than 1 m. (4) No more than 3 access shafts may be open at any time. (5) Opened access shafts must be interconnected for ventilation and egress while mining is carried on. (6) Access shafts must be backfilled when mining ends.’. ENDNOTES 1.
