s1 2 s6 Mineral Resources Amendment Regulation (No. 2) No. 11, 2005 2005 1 Short title This regulation may be cited as the Mineral Resources Amendment Regulation (No. 2) 2005 . 2 Regulation amended This regulation amends the MineralResourcesRegulation 2003. 3 Commencement This regulation commences on 1 July 2005. 4 Amendment of s 34 (Threshold for particular minerals) (1) Section 34(1)(c)— renumber as section 34(1)(d). (2) Section 34(1)— insert— ‘(c) manganese or a rare earth or tantalum;’. 5 Replacement of pt 9, div 2, sdiv 5, hdg (Discounts for base prescribed minerals) Part 9, division 2, subdivision 5, heading— omit, insert— ‘Subdivision 5 Discounts for particular minerals processed in Queensland’. 6 Amendment of s 39 (Royalty discounts for base prescribed minerals) (1) Section 39, heading, after ‘minerals’— insert — ‘, manganese and tantalum’. (2) Section 39(1) and (3), ‘base prescribed’—

(6) Section 39(3)(c), after ‘for’— insert— ‘manganese, tantalum and’. (7) Section 39— insert — ‘(4) In this section— relevant mineral means each of the following— (a) a base prescribed mineral; (b) manganese; (c) tantalum.’. 7 Amendment of sch 4 (Royalty payable for minerals) (1) Schedule 4, part 2, section 1, item 2— omit, insert— ‘2 Bentonite— (a) from 1 July 2005 to 30 June 2006 . . . . . . . . . . . . . . . . (4) Schedule 4, part 2— insert — ‘5A Manganese, rare earths and tantalum ‘The royalty rate for manganese, rare earths and tantalum is 2.7% of the value of the manganese, rare earth or tantalum.’. (5) Schedule 4, part 2, section 9— omit, insert— ‘9 Silica—1 July 2005 to 30 June 2006 ‘(1) This section provides for the royalty rate for silica from 1 July 2005 to 30 June 2006. ‘(2) If 50c for each tonne of the silica is higher than 5% of the value of the silica, the rate is $0.70 for each tonne of the silica. ‘(3) If subsection (2) does not apply, the rate is the lower of the following— (a) $0.90 for each tonne of the silica; (b) the total of— (i) 5% of the value of the silica; and (ii) 50% of the difference between 5% of the value of the silica and 90c for each tonne of the silica.
s8 5 s8 Mineral Resources Amendment Regulation (No. 2) No. 11, 2005 2005 Example for paragraph (b) — 5% of the value of silica is equivalent to 80c for each tonne of the silica. 50% of the difference between 80c and 90c for each tonne of the silica is 5c. The royalty rate would be 85c for each tonne of the silica.’. 8 Amendment of sch 7 (Dictionary) Schedule 7— insert— ‘ rare earth means each of the following— (a) cerium; (b) dysprosium; (c) erbium; (d) europium; (e) gadolinium; (f) holmium; (g) lanthanum; (h) lutetium; (i) neodymium; (j) praseodymium; (k) promethium; (l) samarium; (m) scandium; (n) terbium; (o) thulium; (p) ytterbium; (q) yttrium.’.
