s1 2 s4 Mineral Resources Amendment (No. 2) No. 160, 1999 ˙ Short title 1. This regulation may be cited as the Mineral Resources Amendment Regulation (No. 2) 1999 . ˙ Commencement 2.(1) Section 4(2), (3), (4) and (5) is taken to have commenced on 1 April 1999. (2) Section 4(1) commences on 1 April 2000. ˙ Regulation amended 3. This regulation amends the Mineral Resources Regulation 1990 . ˙ Amendment of sch 1 (Rate of royalties) 4.(1) Schedule 1, section 13— omit, insert— Coal 13. The royalty payable on coal mined is 7% of the coal’s value worked out by the Minister under section 51.’. (2) Schedule 1, section 13A, heading— omit, insert— Coal from certain mines—additional royalty ’. (3) Schedule 1, section 13A(1)(f)— renumber as section 13A(1)(e). (4) Schedule 1, section 13A(2)— omit, insert— (2) The royalty payable for a period on each tonne of export coal mined from a mine and hauled on or after 1 April 1999 is $3.00 for each tonne until the mine’s base tonnage for the period is reached. (3) The royalty payable under subsection (2) is additional to the royalty payable under section 13.’.
s4 3 s4 Mineral Resources Amendment (No. 2) No. 160, 1999 (5) Schedule 1, section 13A(5) to (9)— omit, insert— (5) In this section— “base tonnage” , for a period, means— (a) for the Goonyella mine— (i) for the period 1 June 1998 to 31 May 1999—the first 6 611 196 t of coal hauled in the period; or (ii) for the period 1 June 1999 to 31 May 2000—the first 6 611 196 t of coal hauled in the period; or (iii) for the period 1 June 2000 to 30 June 2000—the first 550 933 t of coal hauled in the period; and (b) for the Norwich Park mine— (i) for the period 1 June 1998 to 31 May 1999—the first 5 170 980 t of coal hauled in the period; or (ii) for the period 1 June 1999 to 31 May 2000—the first 5 170 980 t of coal hauled in the period; or (iii) for the period 1 June 2000 to 30 June 2000—the first 430 915 t of coal hauled in the period; and (c) for the Peak Downs mine— (i) for the period 1 June 1998 to 31 May 1999—the first 6 152 937 t of coal hauled in the period; or (ii) for the period 1 June 1999 to 31 May 2000—the first 6 152 937 t of coal hauled in the period; or (iii) for the period 1 June 2000 to 30 June 2000—the first 512 745 t of coal hauled in the period; and (d) for the Saraji mine— (i) for the period 1 June 1998 to 31 May 1999—the first 5 018 167 t of coal hauled in the period; or (ii) for the period 1 June 1999 to 31 May 2000—the first 5 018 167 t of coal hauled in the period; or
s4 4 s4 Mineral Resources Amendment (No. 2) No. 160, 1999 (iii) for the period 1 June 2000 to 30 June 2000—the first 418 181 t of coal hauled in the period; and (e) for the Curragh mine— (i) for the period 1 April 1999 to 31 March 2000—the first 2 100 000 t of coal hauled in the period; or (ii) for the period 1 April 2000 to 30 June 2000—the first 525 000 t of coal hauled in the period. “export coal” means coal exported to another State or a foreign country. “period” means— (a) for the Goonyella, Norwich Park, Peak Downs and Saraji mines— (i) the period 1 June 1998 to 31 May 1999; or (ii) the period 1 June 1999 to 31 May 2000; or (iii) the period 1 June 2000 to 30 June 2000; and (b) for the Curragh mine— (i) the period 1 April 1999 to 31 March 2000; or (ii) the period 1 April 2000 to 30 June 2000.
