24 Mineral Resources Amendment (No. 1) No. 46, 1993 ˙ Short title 1. This regulation may be cited as the Mineral Resources Amendment Regulation (No. 1) 1993 . ˙ Commencement 2. This regulation commences on 1 March 1993. ˙ Amended regulation 3. The Mineral Resources Regulation 1990 is amended as set out in this regulation. ˙ Replacement of s.1.1 (Short title) 4. Section 1.1— omit, insert— ˙ ‘Short title ‘1.1 This regulation may be cited as the Mineral Resources Regulation1990 . ’. ˙ Replacement of s.1.4 (Interpretation) 5. Section 1.4— omit, insert— ˙ ‘Definition ‘1.4 In this regulation— ‘ “plan” , in relation to a restricted area, means a plan held in the office of the department; “yearly rental” means the amount of rent payable for a calendar year. ’. ˙ Insertion of new ss.1.4A–1.4C 6. After section 1.4—

25 Mineral Resources Amendment (No. 1) No. 46, 1993 insert— ˙ ‘Meaning of “block identification map” ‘1.4A A “block identification map” is a map that forms part of the series of 17 maps known as ‘Block Identification Map—Series B’ held in the office of the department. ˙ ‘Meaning of “restricted area” ‘1.4B A “restricted area” is the land included in an area specified by Part 2 of Schedule 5 to be a restricted area. ˙ ‘Naming convention for restricted areas ‘1.4C In this regulation, the portion of Part 2 of Schedule 5 that relates to a particular restricted area may be referred to by the same designation as the restricted area. Example— The portion of Part 2 of Schedule 5 relating to Restricted Area 1 may be referred to as ‘Restricted Area 1’. ’. ˙ Insertion of new s.11.4A 7. After section 11.4— insert— ˙ ‘Restrictions on grants ‘11.4A(1) In this section and in Part 2 of Schedule 5— “restriction” means a restriction of a kind specified in Part 1 of Schedule 5. ‘(2) Land within a restricted area is subject to the restrictions that are specified in Part 2 of Schedule 5 for the restricted area. ‘(3) If a restriction prohibits the grant, or application for the grant, of— (a) a prospecting permit; or (b) a mining claim; or (c) an exploration permit; or

26 Mineral Resources Amendment (No. 1) No. 46, 1993 (d) a mineral development licence; or (e) a mining lease; in relation to land within a restricted area, the restriction does not affect the grant of a permit, claim, licence or lease on an application made, but not finally dealt with, before the day on which the area was included in Part 2 of Schedule 5 or the restriction was applied to the area. ’. ˙ Insertion of new Schedule 5 8. After Schedule 4— insert— ‘SCHEDULE 5 ‘RESTRICTED AREAS sections 1.4B, 11.4A ‘PART 1—RESTRICTIONS THAT MAY BE APPLIED TO RESTRICTED AREAS ˙ ‘Restrictions on grants ‘1.(1) The grant, and application for the grant, of a prospecting permit is prohibited. ‘(2) The grant, and application for the grant, of a mining claim is prohibited. ‘(3) The grant, and application for the grant, of an exploration permit is prohibited. ‘(4) The grant, and application for the grant, of a mineral development licence is prohibited. ‘(5) The grant, and application for the grant, of a mining lease is prohibited.

27 Mineral Resources Amendment (No. 1) No. 46, 1993 ˙ ‘Restriction on area of grant ‘2.(1) The grant of a prospecting permit must not be over an area that exceeds the area specified in Part 2 for the restricted area. ‘(2) The grant of a mining claim must not be over an area that exceeds the area specified in Part 2 for the restricted area. ‘(3) The grant of an exploration permit must not be over an area that exceeds the area specified in Part 2 for the restricted area. ‘(4) The grant of a mineral development licence must not be over an area that exceeds the area specified in Part 2 for the restricted area. ‘(5) The grant of a mining lease must not be over an area that exceeds the area specified in Part 2 for the restricted area. ˙ ‘Restriction on number of grants ‘3.(1) A single person must not, at any time, be the holder (whether alone or with others) of more than the number of exploration permits specified for the restricted area. ‘(2) A single person must not, at any time, be the holder (whether alone or with others) of more than the number of mineral development licences specified for the restricted area. ‘(3) A single person must not, at any time, be the holder (whether alone or with others) of more than the number of mining leases specified for the restricted area. ˙ ‘Restriction on aggregate areas ‘4.(1) A single person must not, at any time, be the holder (whether alone or with others) of exploration permits the aggregate area of which exceeds the area specified in Part 2 for the restricted area. ‘(2) A single person must not, at any time, be the holder (whether alone or with others) of mineral development licences the aggregate area of which exceeds the area specified in Part 2 for the restricted area. ‘(3) A single person must not, at any time, be the holder (whether alone or with others) of mining leases the aggregate area of which exceeds the area specified in Part 2 for the restricted area.
