AN ACT to amend the Mine Workers' Relief Act

1932 -1980.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Mine =Matthew,

Workers' Relief Amendment Act 1982.

(2) In this Act the Mine Workers' Relief Act Reprinted as approved in

1932-1980 is referred to as the principal Act.

Section 48

amended. 2. Section 48 of the principal Act is amended

(a) in subsection (1), by inserting after the first proviso the following proviso-

'' Provided also that this subsection shall not apply in the case of a mine worker who has attained or who attains the age of 65 years: " ; and

(b) in subsection (2), by deleting "first proviso to the said subsection, and, where he has received a lump sum in redemption of weekly payments as mentioned in the second proviso" and substituting the following

'C first or second provisoes to the said

subsection, and, where he has received a lump sum in redemption of weekly payments as mentioned in the third proviso " .

Section 53

amended. 3. Section 53 of the principal Act is amended

(a) in subsection (1), by inserting after the first proviso the following proviso

'C

Provided also that this subsection shall not apply in the case of a mine worker who has attained or who attains the age of 65 years: " ; and

(b) in subsection (2), by deleting "first proviso to the said subsection, and where he has received a lump sum in redemption of weekly payments as mentioned in the second proviso" and substituting the following

4.    Section 56A of the principal Act is amended amended '

in subsection (2) by inserting after "mine worker"

where it first occurs the following-

" who has not attained the age of 65 years "

5.    Section 57 of the principal Act is amended by te.,;=37.

inserting after subsection (6) the following sub-

section

(7) Nothing in this section shall be construed so as to require or permit a prospector or a person who has ceased to be engaged in prospecting to contribute or continue to contribute to the Fund in respect of any period after the transitional date, and the amount of any such contribution paid into the Fund before the coming into operation of the Mine Workers' Relief Amendment Act 1982 shall be repaid by the Board. " .
