MINE SUBSIDENCE (AMENDMENT) ACT.
Act No. 66, 1957.
An Act to make provision for the appointment to the Mine Subsidence Board of an additional representative of owners of im- provements on land affected or likely to be affected by subsidence; for this purpose to amend the Mine Subsidence Act, 1928-1951; and for purposes connected therewith. (2) The Mine Subsidence Act, 1928, as amended by subsequent Acts and by this Act, may be cited as the Mine Subsidence Act, 1928-1957.
2. (1) The Mine Subsidence Act, 1928-1951, is amended—
(a) by omitting from subsection two of section seven the words " t w o other m e m b e r s " and by inser t ing in lieu thereof the words " t h r e e o ther m e m b e r s " ; (b) by omitting from the same subsection the words " t h e other r e p r e s e n t a t i v e " and by inser t ing in lieu thereof the words " t w o of whom shall be r e p r e s e n t a t i v e s ' ' ; (c) by omitting from subsection five of the same section the word " t h r e e " and by inser t ing in
lieu thereof the word " f o u r " . (2) (a) F o r the purposes only of the appoin tment of the addi t ional represen ta t ive of owners of improve ments on land affected or likely to be affected by subsi dence as a member of the Mine Subsidence Boa r d p u r s u a n t to the amendments made by subsection one of th i s section and of any m a t t e r s necessary for or incidental to such appoin tment the provis ions of t ha t subsection shall commence on the day upon which H e r Majes ty ' s assent to this Act is signified.
(b) The person so appoin ted shall assume
office as a member of the Mine Subsidence Boa r d upon a day to be appoin ted by the Governor and notified by proc lamat ion published in the Gazette and shall, subject to the Mine Subsidence Act, 1928, as amended by subse quent Acts , hold office unt i l the first day of March, one thousand nine hundred and fifty-nine, and shall be eligible for re-appointment .
As on and from the day so appointed by the Governor the provis ions of subsection one of this section shall come into force for all purposes .
(3)
(3) Nothing contained in this section shall
prejudice or affect in any way—
(a)
the continuity of office as a member of the Mine Subsidence Board of any person who was appointed by the Governor and held office as such immediately before the day appointed by the Governor pursuant to paragraph (b) of sub- section two of this section; or
(b)
the continuity of the body corporate constituted under the Mine Subsidence Act, 1928, as amended by subsequent Acts, but the same shall continue notwithstanding the provisions of this section.
