MRS. IRVIN:  May it please the Court, I appear on behalf of

the Director of Public Prosecutions. (of Director

of Public Prosecutions New South Wales)

MR MANN:  The matter has been listed today, Your Honour, as

an application by my firm to be removed as the

solicitors on the record.

HIS HONOUR:  What is the date of the summons?
MR MANN:  10 August, Your Honour.
HIS HONOUR:  What affidavit do you move on?
MR MANN:  I seek to rely on the affidavits of myself, David

Brian Mann, sworn both 9 August 1993 and also the further affidavit sworn on 19 August 1993.

HIS HONOUR:  I have read the affidavits. Do you wish to say

anything about this, Mr Irvin?

MR IRVIN: Only that I have seen no papers at all,

Your Honour, in this matter, including the

originating summons. We have not been served.
HIS HONOUR:  I am sure if you are very anxious the applicant

will supply them to you. It is a summons, not an

originating summons. But have you any interest in
the application?
MR IRVIN:  No, Your Honour, we do not.
HIS HONOUR:  You ask for the order as sought in the summons,

Mr Mann?

MR MANN:  Yes, I do, Your Honour.
HIS HONOUR:  Very well. I make the order as sought in the

summons.
