MILK (DECIMAL CURRENCY) ACT.

An Act to make provision with respect to the con-:

version of the prices determined and fixed in relation to milk pursuant to the Milk Act, 1931-1964, upon the introduction of decimal currency; for this purpose to amend the Milk Act, 1931-1964; and for purposes connected therewith. [Assented to, 20th December, 1965.]

D E it enacted by the Queen's Most Excellent Majesty, by •*-* and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows : —

1. (1) This Act may be cited as the "Milk (Decimal Currency) Act, 1965".

(2) This Act shall be read and construed with the Milk Act, 1931-1964.

2. In this Act, unless the context or subject-matter

otherwise indicates or requires—

"Appointed day" means the day upon which Part II of the Commonwealth Act commences.
"Commonwealth Act" means the Currency Act 1965 of the Parliament of the Commonwealth of Australia and includes any Act passed in amendment of or substitution for that Act.

"Decimal currency" means the currency provided for by Part II of the Commonwealth Act.

"Old currency" means the currency provided for by the Acts repealed by the Commonwealth Act.

3.      (1) The Board may—

(a) revoke any notification under section twenty- three of the Milk Act. 1931-1964, that con- tains references to prices of milk expressed in terms or in a manner used in connection with old currency; and
(b) determine or fix, and notify under that section, in respect of milk to which the notification so revoked related

(i)   prices expressed in terms or in a manner used in connection with decimal currency calculated on the basis of the equivalents specified in subsection four of section eight

of the Commonwealth Act; or

(ii)   where in certain circumstances prices deter- mined or fixed under subparagraph (i) of this paragraph would be impracticable hav- ing regard to the provisions of the Com- monwealth Act relating to legal tender (other than any such provisions in Part VI of that Act), such prices expressed in terms or in a manner used in connection with decimal currency as may be approved by the Minister.

(2) (a) Prices may be determined or fixed by the Board under this section without holding an inquiry under section twenty-three of the Milk Act. 1931-1964.

(b) The notification of prices determined or fixed under this section shall have the like effect as a notification published under and in accordance with section twenty-three of the Milk Act, 1931-1964, after an inquiry held pursuant to that section.

(3) The prices determined or fixed under this section shall take effect upon a day not earlier than the appointed day.

(4) The revocation of a notification pursuant to this section shall not affect any right or liability acquired, accrued or incurred or any legal proceeding or remedy which might have been instituted, continued or enforced but for such revocation.
