Milk Authority (Amendment) Act (No. 2) 1992

An Act to amend the Milk Authority Act 1971

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Milk Authority (Amendment) Act (No. 2) 1992.

Principal Act

2.  In this Act, “Principal Act” means the Milk Authority Act 1971.1

Interpretation

3.  Section 4 of the Principal Act is amended—

(a)by omitting from subsection (1) the definition of “milk” and substituting the following definition:

“ ‘milk’ means liquid cow’s milk, whether processed or unprocessed, and, without limiting the generality of the foregoing, includes—

(a)liquid cow’s milk from which some or all of the cream has been removed;

(b)reconstituted liquid cow’s milk prepared by combining water with—

(i)powder, or concentrate, derived from liquid cow’s milk; or

(ii)such a powder and such a concentrate;

(c)milk of a kind referred to in this definition to which has been added one or more of the following, namely, flavouring, vitamin supplement, calcium supplement, cream, milk concentrate or any other food additive;

(d)any combination of milk of the kinds referred to in this definition; and

(e)any other product derived from liquid cow’s milk, with or without food additives, that is prescribed for the purpose of this paragraph;

but does not include a prescribed milk product unless the regulations provide that the product is to be taken to be milk for the purposes of this Act;”; and

(b)by inserting in subsection (1) the following definition:

“ ‘prescribed milk product’ means—

(a)cream, whether processed or unprocessed, derived from liquid cow’s milk;

(b)condensed milk;

(c)evaporated milk;

(d)powdered milk;

(e)yoghurt;

(f)cheese;

(g)milk concentrate;

(h)butter; or

(i)buttermilk;”.
