MILK (AMENDMENT) ACT.

Act No. 49, 1936.

An Act to authorise the Milk Board to make certain payments to dairymen in respect of milk delivered by them to the Milk Board; to validate certain payments made by the Milk Board to dairymen; for these purposes to amend the Milk Act, 1931, in certain respects; and for purposes connected there-

t he same, as follows :—

1. (1) This Act may be cited as the " M i l k (Amend­

ment ) Act, 1936."

(2) The Milk Act, 1931, as amended by this Act,

m a y be cited as the Milk Act, 1931-1936.

2. (1) The Milk Act, 1931, is amended—

(a)	by omitting from subsection two of section twenty-eight the words " o n the basis of the minimum price or prices notified in re la t ion t h e r e t o " and by inser t ing in lieu thereof the words ' ' Such payments shall be made in accord­
ance with subsection (2A) of this s ec t i on" ;
(b)	by inserting next after the same subsection the following new subsection:—

(2A) (a) The Board shall p a y to each dairy­ man, at such t imes as the Board shall think fit, an amount calculated a t the r a t e of the minimum price or prices applicable to or in respect of the milk delivered by such da i ryman .

(b) Where , in respect of any per iod which the B o a r d may think fit to adopt , the Boa rd has , out of the proceeds of milk delivered by da i rymen at any par t i cu la r place a t which

milk is accepted by the Board—

(i)   made the payments referred to in para­ g r a p h (a) of this subsection; and

(ii) made such provis ion for the ma t t e r s

re fer red to in subsection two of this section (other than expenses of

adminis t ra t ion) as the Boa rd deems

reasonably appropr i a t e to and in

respect of the milk so delivered,

the Board shall dis t r ibute , among such da i rymen in propor t ion to the quant i ty of milk delivered

by

by each of thorn at such place during such period, so much of the balance, if any, of such proceeds as the Board may determine to be available for the purpose.

(2) Subsection one of this section shall be deemed to have commenced upon the first day of January, ono thousand nine hundred and thirty-two.
