AN ACT to amend the Milk Act, 1946-1965.

[Assented to 20th May, 1970.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

1. (1) This Act may be cited as the Milk Act	Short title
and citation.

Amendment Act, 1970.

(2) In this Act the Milk Act, 1946-1965 is approved for reprint, 23rd

referred to as the principal Act. October, 1968.

(3) The principal Act as amended by this Act

may be cited as the Milk Act, 1946-1970.

amended. 2. Subsection (1) of section 26 of the principal

Act is amended

(a) by adding immediately after the first proviso to paragraph (I) the following proviso

Provided, notwithstanding the provi- sions of the first proviso to this para- graph, that a separate price or prices may be fixed for milk used for the production of cream. ; and

(b) by adding after paragraph (La) the following paragraph

(Lb) Fixing the minimum price or prices at which milk may be sold to the State or the Commonwealth, any department, authority, agency or instrumentality of the State or the Commonwealth, any public or private hospital, or to any school or other institution approved by the Minister for the purposes of this paragraph:

Provided that a different mini-

mum price or prices may be fixed

(a)	in respect of milk delivered or sold in different dairy areas, or parts thereof, and
(b)	according to differences in grade, quality, description or quantity, and
(c)	according to whether the milk is sold in bulk, or in bottles, or in containers other than bottles. .

amended. 3. Section 30 of the principal Act is amended by adding after subsection (1) the following sub- section

(la) Notwithstanding the provisions of sub-

paragraph (a) of paragraph (ii) of subsection

(1) of this section, the Board may issue a milk

vendor's license in the form of a milkman's license which shall entitle the licensee to sell milk only to such bodies or persons or class or classes of bodies or persons as are specified in the license, in such district or districts as are so specified. .
