1  Name

This is the Military Superannuation and Benefits (Eligible Members) Declaration 2015.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under paragraph (f) of the definition of eligible member in subsection 30(1) of the Military Superannuation and Benefits Act 1991, as it continues to apply under item 4 of Schedule 4 to the Defence Legislation Amendment Act (No. 1) 2005.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

5  Definitions

In this instrument:

Act means the Military Superannuation and Benefits Act 1991, as it continues to apply under item 4 of Schedule 4 to the Defence Legislation Amendment Act (No. 1) 2005.

commencement day means the day this instrument commences.

retention benefit means a retention benefit mentioned in subsection 32(1) or (3) of the Act.

6  Eligible members

For paragraph (f) of the definition of eligible member in subsection 30(1) of the Act, a person is an eligible member if:

(a)  the person:

(i)  is included in an employment category specified in an item in the table in clause 1, 2 or 3 of Schedule 1; and

(ii)  holds a rank specified for the category in that item; and

(iii)  meets the conditions specified for the category in that item; or

(b)  the person is an individual specified in Schedule 2.

Schedule 1—Eligible members—employment categories

1  Navy

The following table specifies employment categories, ranks and conditions for the Navy.
