Military Superannuation and Benefits Declaration (No. 3)

I, GARY FRANCIS PUNCH, Minister for Defence Science and Personnel, make the following Declaration under the Military Superannuation and Benefits Act 1991.

Citation

               1.   This Declaration may be cited as the Military Superannuation and Benefits Declaration (No. 3).

Commencement

               2.   This Declaration is taken to have commenced on 1 October 1993.

Interpretation

               3.   (1)    In this Declaration, unless the contrary intention appears:

“Act” means the Military Superannuation and Benefits Act 1991.

Eligible members

               4.   A person is an eligible member for the purposes of paragraph (f) of the definition of “eligible member” in subsection 30 (1) of the Act if he or she:

             (a)   was or is a member of the Scheme; and

             (b)   was or is included in the employment category Combat System Operator.

Transitional

               5. If a person was an eligible member by virtue of the Military Superannuation and Benefits Declaration, Statutory Rules 1993 No. 142, any periods of service by the person in the employment category Radar Plot must be included for the purpose of calculating the number of years of continuous eligible service by the person.
