The Military Rehabilitation and Compensation Commission:
(a) under subsection 258(4) of the Military Rehabilitation and Compensation Act 2004 (the MRCA), makes the variations to the Military Rehabilitation and Compensation Act Education and Training Scheme 2004 (Instrument 2015 No. MRCC43) set out in Schedule 1; and (b) under subsection 67(3) of the MRCA, amends the Guide to Determining Impairment and Compensation 2016 (Instrument 2016 No.MRCC37) set out in Schedule 2. 1. Name

This instrument is the Military Rehabilitation and Compensation Legislative Instruments Omnibus Variation Determination 2022.

1. Commencement

This instrument commences on the day after it is registered.

1. Schedules

Each instrument that is specified in a Schedule to this instrument is amended or varied as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1

Military Rehabilitation and Compensation Act Education and Training Scheme 2004 (Instrument 2015 No. MRCC 43)

1          Paragraph 1.2.2 (definition of disability pension)

            Repeal the definition.

2          Paragraph 3A.10.1(1)(e)

Omit “disability pension”, substitute “a pension payable under Part II or IV of the VEA at a rate determined under or by reference to Division 4 of Part II of the VEA”.

Schedule 2

Guide to Determining Impairment and Compensation 2016 (Instrument 2016 No.MRCC37)

1. Chapter 25 (definition of "VEA percentage")

Omit "of disability pension".

2           Chapter 25 (definition of "weekly disability pension")       

Repeal the definition.

3           Chapter 25 (Method Statement - Step (6))

Omit "disability pension", substitute "pension under Part II or IV of the VEA".
