PROVISIONAL REGULATIONS UNDER THE “DEFENCE ACTS 1903-1904.”

I, THE GOVERNOR GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that, on account of urgency, the following Regulations under the Defence Acts 1903-1904 should come into immediate operation, and make the Regulations to come into operation on and from the 12th January, 1905, as Provisional Regulations.

Regulations for the Military Forces of the Commonwealth.

The following Regulations are added to the Regulations for the Military Forces:—

Part I.

At end of paragraph 9 Insert—

Notwithstanding the above exception, the Inspector-General shall be entitled to assume command at any parade of the Military Forces not being a parade held in time of war.

Part IV.

Insert, under part IV., the following:–

The Council of Defence shall inquire into, discuss, and record opinions upon matters submitted to it by the Minister affecting—

(a) The general policy of the Naval and Military Defence of the Commonwealth and of the several States;

(b) Measures necessary for the defence of the Commonwealth in time of war;

(c) The total expenditure on Defence, and its distribution.

The Military Beard shall, subject to the control of the Minister, by charged with the administration of all matters relating to the Military Forces.

Members of the Board and Officers appointed in connexion therewith shall severally exercise such powers and perform such duties as are from time to time assigned to them by the Minister.

The Inspector-General of the Military Forces shall inspect the Military Forces of the Commonwealth, and the Military Forts and Defence Works and Buildings. He will report upon the results of the administration of the Forces, the efficiency of the troops, the system of training, the equipment, the preparedness of the Forces for war, and the state and condition of all Defence Works, Buildings, and Stores.

He shall furnish an annual Report to the Military Board on the 1st January, and intermediate Reports whenever he shall think fit, or is so requested by the Minister or the Board.

He shall be Chairman of a Board appointed to consider all promotions to ranks above the rank of Captain.

He shall, by virtue of his office, take rank and precedence as the senior officer of the Military Forces of the Commonwealth.
