REGULATIONS UNDER THE DEFENCE ACT 1903-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1965.

Amendments of the Military Financial Regulations 

1. Regulations 11 and 12 of the Military Financial Regulations are repealed and the following regulations inserted in their stead:—

Consolidated rates of pay—General Officers.

“11.—(1.) The rate of pay payable to the Chief of the General Staff is a consolidated rate of pay of Fifteen thousand five hundred dollars per year.

“(2.) The rate of pay payable to a member who holds the appointment Chairman, Chiefs of Staff Committee is a consolidated rate of pay of Sixteen thousand dollars per year.

“(3.) The rate of pay payable to a Major-General is a consolidated rate of pay of Eleven thousand five hundred and twenty-three dollars per year.

“(4.)Subject to the next succeeding sub-regulation, the rate of pay payable to a Brigadier is a consolidated rate of pay of Nine thousand eight hundred and nineteen dollars per year.

“(5.) The rate of pay payable to a medical officer or dental officer who holds the rank of Brigadier is a consolidated rate of pay of Ten thousand six hundred and seventy-one dollars per year.

Members other than General Officers.

“12.—(1.) Subject to the succeeding sub-regulations of this regulation and to the next two succeeding regulations, the rate of pay of a male member, other than a member referred to in the last preceding regulation, is the rate per day specified in relation to his rank and, where specified, his classification and length of service in the rank, in the following table:—

“(5.) The rate of pay per day of an officer holding the appointment of Quartermaster, being an officer who holds the rank of lieutenant and was appointed a Quartermaster before the twenty-sixth day of June, 1964, is—

(a)if he has less than 2 years’ service in the rank—Nine dollars and forty-eight cents; or

(b)if he has not less than 2 years’ service in the rank—Nine dollars and seventy-four cents.

“(6.) The rate of pay per day of an officer (being an officer holding the rank of Captain and having not less than 8 years’ service in that rank) who is qualified for promotion to the rank of Major and holds an appointment of Quartermaster is—

(a) if he has less than 12 years’ service in the rank of Captain—Fourteen dollars and twenty-six cents; or

(b)if he has not less than 12 years’ service in the rank of Captain—Fourteen dollars and seventy-six cents.

“(7.) Where a member is appointed a lieutenant while undergoing a medical course at a University, the rate of pay of the member from and including the date of commencement of his service in accordance with sub-regulation (2.) of regulation 15 of these Regulations to and including the day immediately before the day as from which he is promoted to the rank of captain in the Regular Army Supplement is Four dollars and thirty-four cents per day.

“(8.) Where a member is appointed a lieutenant while undergoing a course, other than a medical course, at a University or Technical College, the rate of pay of the member from and including the date of commencement of his service in accordance with sub-regulation (3.) of regulation 15 of these Regulations to and including the day immediately before the date as from which he becomes eligible for pay at the rate of a lieutenant, is the rate per day specified, in relation to the nature of his course of studies and his stage of training, in the following table:—

“(10.) The rate of pay of a Warrant Officer, Class I, of the Royal Australian Survey Corps who possesses the technical qualifications determined by the Military Board for the purposes of this sub-regulation is the

rate per day specified in relation to his length of service in that rank in the following table:—

“(11.) The rate of pay of a member who is a student at the Officer Cadet School or an Officer Training Unit is—

(a)the rate per day specified in Part B of the table in sub-regulation (1.) of this regulation in relation to a member holding the rank of corporal and the classification Group 1; or

(b)the rate per day specified in that table in relation to a member holding the rank and classification (if any) held by the member immediately before he became such a student,

whichever is the greater.

“(12.) Subject to the next two succeeding sub-regulations, the rate of pay and the rate of deferred pay of an army apprentice during his apprentice training are the respective rates per day or per week, as the case may be, specified in relation to his classification, stage of training and, where specified, his age, in the following table:—

“(13.) The rate of pay of an apprentice tradesman in his fourth year of apprentice training is the rate applicable to a private of such classification as the Military Board determines.

“(14.) Deferred pay at the appropriate rate per day specified in the table in sub-regulation (12.) of this regulation shall be retained as an accumulating credit in the pay account of an army apprentice and is payable on the termination of his service or—

(a)in the case of an apprentice tradesman—on completion of his third year of apprentice training; or

(b)in any other case—on completion of his apprentice training, whichever is the earlier.

“(15.) Subject to the next succeeding sub-regulation and the next succeeding regulation, the rate of pay of a female member is the rate per day specified in relation to her rank and length of service in the rank in the following table:—

“(17.) For the purposes of this regulation—

(a) if the rate of pay of a member immediately before he is appointed to commissioned rank is higher than the rate that would, but for this sub-regulation, be applicable to the member upon that appointment, the rate of pay of the member is the next higher rate applicable to the rank to which he is appointed and, for the purpose of incremental advancement, he shall, immediately before the day as from which he is so appointed, be deemed to have completed the service in that rank entitling him to payment at that next higher rate;

(b)an incremental advancement in the rate of pay of a member in respect of length of service in a rank or classification is subject to such conditions as are approved by the Military Board;

(c) a rate of pay prescribed in relation to a classification applies to such members as the Military Board designates as holding that classification for the purposes of this regulation; and

(d)a member’s length of service in a rank includes such period of service in another rank as is approved by the Military Board as service in that first-mentioned rank for the purpose of determining his incremental advancement.

“(18.) Where—

(a)a person who has served on continuous full time service in the Naval Forces or the Air Force of the Commonwealth or with the Naval Military or Air Forces of another part of the Queen’s dominions is appointed an officer of or enlisted in the Permanent Military Forces; or

(b)a person who has special qualifications or experience is appointed an officer of the Permanent Military Forces,

the Military Board may determine that the member is to be deemed, upon appointment or enlistment, to have served for a specified period in a specified rank, being the rank held by him upon being so appointed or enlisted and, for the purpose of determining the member’s rate of pay upon appointment or enlistment and his incremental advancement, he shall, immediately before the day as from which he is so appointed or enlisted, be deemed to have completed the period of service in that rank so specified.”.

Calculation of pay.

2. Regulation 15 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (2.) the word “sub-regulation (6.)” and inserting in its stead the word “sub-regulation (7.)”; and

(b)by omitting from sub-regulation (3.) the word “sub-regulation (7.)” and inserting in its stead the word “sub-regulation (8.)”.

Marriage allowance.

3. Regulation 19 of the Military Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “Ninety-five cents” and inserting in their stead the words “One dollar and two cents”; and

(b)by omitting from sub-regulations (3.) and (5.) the words “One dollar and fifty cents” (wherever occurring) and inserting in their stead the words “One dollar and fifty-seven cents”.

Qualifying allotment for payment of full rate of marriage allowance.

4. Regulation 22 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “Two dollars and forty-five cents” and inserting in their stead the words “Two dollars and fifty-nine cents”; and

(b) by omitting from paragraph (b)of sub-regulation (1.) the words “Three dollars and fifteen cents” and inserting in their stead the words “Three dollars and twenty-nine cents”.

General provisions relating to eligibility for certain allowances.

5. Regulation 27 of the Military Financial Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (3.) the words “One dollar and seventy cents” and inserting in their stead the words “One dollar and eighty cents”;

(b)by omitting from sub-paragraph (ii) of that paragraph the words “Two dollars and forty cents” and inserting in their stead the words “Two dollars and fifty cents”;

(c) by omitting from sub-paragraph (i) of paragraph (b)of sub-regulation (3.) the words “Ninety-five cents” and inserting in their stead the words “One dollar and two cents”; and

(d) by omitting from sub-paragraph (ii) of paragraph (b)of sub-regulation (3.) the words “One dollar and sixty-five cents” and inserting in their stead the words “One dollar and seventy-two cents”.

Rates of pay for members other than senior appointments.

6. Regulation 190 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

“190.—(1.) Subject to the succeeding sub-regulations of this regulation, the rate of pay of a male member, other than a member holding, or performing the duties of, an appointment specified in the table in sub-regulation (1.) of the last preceding regulation, in respect of a period of service in the Citizen Military Forces, not being a period of continuous full time military service in relation to which the next succeeding regulation applies, is the rate per day specified in relation to his rank in the following table:—

“(7.) The rate of pay of a member who, not being a member holding, or performing the duties of, an appointment specified in the table in sub-regulation (1.) of the last preceding regulation—

(a) is a staff officer; or

(b)holds an appointment designated as a part-time appointment in a Permanent Military Force Establishment,

is the rate per day specified in relation to his rank, or the rate specified in relation to the rank for the appointment, in whichever of the tables in sub-regulations (1.), (3.) and (5.) of this regulation is appropriate, whichever is the less.

“(8.) The rate of pay of a medical officer or a dental officer who holds an honorary rank but not a substantive rank is the rate per day specified in relation to the rank of captain in the table in sub-regulation (1.) of this regulation, whatever may be his honorary rank.

“(9.) The rate of pay of a member in respect of an attendance at a parade designated as an attendance at a half-day parade under the Australian Military Regulations is one-half of the rate otherwise applicable under this regulation.

“(10.) The rate of pay of a member in respect of an attendance at a parade designated as an attendance at a night parade under the Australian Military Regulations is one-third of the rate otherwise applicable under this regulation.

“(11.) Where, during the period of a programme of training prepared in accordance with regulation 488 of the Australian Military Regulations, a member is promoted and after his promotion the member attends a number of home-training parades equal to the number of obligatory home-training parades in the period of the programme of training, the rate of pay applicable to the member in respect of his attendance at the home-training parades in that period is the rate applicable to his rank on promotion.”.

Marriage allowance.

8. Regulation 196 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Ninety-five cents” and inserting in their stead the words “One dollar and two cents ”.

Officers of cadets—marriage allowance.

9. Regulation 225 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Ninety-five cents” and inserting in their stead the words “One dollar and two cents”.

Living out allowance—unmarried members.

10. Regulation 247 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Retention of lodgings allowance—P.M.F.

11. Regulation 251 of the Military Financial Regulations is amended by omitting from sub-regulation (4.) the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Retention of lodgings allowance—Regular Army Emergency Reserve and Citizen Military Forces.

12. Regulation 252 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar and nine cents”.

Transitional.

13.—(1.) Where, on a day during the period from and including the eighth day of November, 1965, to and including the twenty-first day of July, 1966, an officer held the rank of captain, had not less than eight years’ service in that rank and held the appointment of Quartermaster, unless the officer is not entitled to pay in respect of that day, the officer is, by virtue of this sub-regulation, entitled to additional pay in respect of that day at a rate equal to the amount by which the rate of pay applicable to the officer in respect of that day under the Military Financial Regulations as in force on that day was less than—

(a)if he had less than twelve years’ service in that rank on that day—Fourteen dollars and four cents; or

(b) in any other case—Fourteen dollars and fifty-four cents.

(2.) The Military Board may make a determination under sub-regulation (18.) of regulation 12 of the Military Financial Regulations as amended by these Regulations in respect of a member who was appointed an officer of or enlisted in the Permanent Military Forces on or after the twenty-second day of March, 1966, and before the commencement of these Regulations as if that sub-regulation had come into force on that day and, where the Military Board makes such a determination, the Military Financial Regulations as otherwise in force apply in respect of the member as if that sub-regulation and that determination also had been, in force on the day on which the member was so appointed or enlisted.

(3.) A determination, approval or designation made or given by the Military Board, being a determination, approval or designation that was in force for the purposes of a provision of regulation 12 of the Military Financial Regulations immediately before the commencement of these Regulations, continues in force after the commencement of these Regulations as if it had been made or given by the Military Board for the purposes of the corresponding provision of regulation 12 of the Military Financial Regulations as amended by these Regulations.

Application.

14.—(1.) The rate of pay and rates of allowances provided for in the Military Financial Regulations as amended by regulations 1, 2, 3, 4, 5, 10 and 11 of these Regulations apply in respect of service in the Permanent Military Forces on and after the twenty-second day of July, 1966.

(2.) Subject to the next succeeding sub-regulation, the rates of pay and rates of allowances provided for in the Military Financial Regulations as amended by regulations 6, 7, 8 and 12 of these Regulations apply in respect of service in the Citizen Military Forces on and after the twenty-second day of July, 1966.

(3.) The rates of pay specified in sub-regulation (4.) of regulation 190 of the Military Financial Regulations as amended by regulation 6 of these Regulations apply in respect of service in the Papua and New Guinea Volunteer Rifles to which that sub-regulation applies on and after the first day of July, 1966.

(4.) The rate of allowance provided for in regulation 225 of the Military Financial Regulations as amended by regulation 9 of these Regulations applies to marriage allowance payable to an officer of cadets in respect of the twenty-second day of July, 1966, or any subsequent day.

(5.) Where, but for this sub-regulation, a male member would, by virtue of the application of the amendment of sub-regulations (3.) or (5.) of regulation 19, or the amendment of regulation 22, of the Military Financial Regulations as from the twenty-second day of July, 1966, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.

(6.) Where an allotment made by a male member was in force in respect of the period from and including the twenty-second day of July, 1966, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of Ninety-five cents per day but would not entitle him to marriage allowance at the rate of One dollar and two cents per day under the Military Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Military Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.
