REGULATIONS UNDER THE DEFENCE ACT 1903-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1966.

Amendments of the Military Financial Regulations.  

Consolidated rates of pay—General Officers.

1. Regulation 11 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (3,) the words “Twelve thousand six hundred and five dollars” and inserting in their stead the words “Twelve thousand six hundred and fifty-seven dollars; and

(b) by omitting from sub-regulation (4.) the words “Ten thousand six hundred and five dollars” and inserting in their stead the words “Ten thousand six hundred and fifty-seven dollars”.

(2.) Regulation 12 of the Military Financial Regulations is further amended by omitting sub-regulations (3.) and (4.) and inserting in their stead the following sub-regulations:—

“(3.) The rate of pay of a medical officer who is a captain in the Regular Army Supplement and holds a position as a resident medical officer at a hospital is Eleven dollars fifteen cents per day.

“(4.) The rate of pay of a chaplain is the rate per day specified in relation to his classification and length of service in the classification in the following table:—

(3.) Regulation 12 of the Military Financial Regulations is further amended—

(b) by omitting from paragraph (b) of sub-regulation (6.) the words “Fifteen dollars and fifteen cents” and inserting in their stead the words “Fifteen dollars twenty-six cents”; and

(c)by omitting from sub-regulation (7.) the words “Four dollars and forty-seven cents” and inserting in their stead the words “Four dollars fifty-eight cents”.

Marriage allowance.

3. Regulation 19 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar five cents”;

(b) by omitting from sub-regulation (3.) the words “One dollar and fifty-seven cents” (wherever occurring) and inserting in their stead the words “One dollar sixty cents”; and

(c) by omitting from sub-regulation (5.) the words “One dollar and fifty-seven cents” (wherever occurring) and inserting in their stead the words “One dollar sixty cents”.

Qualifying allotment for payment of full rate of marriage allowance.

4. Regulation 22 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “Two dollars and fifty-nine cents” and inserting in their stead the words “Two dollars sixty-five cents”; and

(b) by omitting from paragraph (b) of sub-regulation (1.) the words “Three dollars and twenty-nine cents” and inserting in their stead the words “Three dollars thirty-five cents”.

General provisions relating to eligibility for certain allowances.

5. Regulation 27 of the Military Financial Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (3.) the words “One dollar and eighty cents” and inserting in their stead the words “One dollar eighty-five cents”;

(b)by omitting from sub-paragraph (ii) of paragraph (a) of sub-regulation (3.) the words “Two dollars and fifty cents” and inserting in their stead the words “Two dollars fifty-five cents”;

(c) by omitting from sub-paragraph (i) of paragraph (b)of sub-regulation (3.) the words “One dollar and two cents” and inserting in their stead the words “One dollar five cents”; and,

(d)by omitting from sub-paragraph (ii) of paragraph (b)of sub-regulation (3.) the words “One dollar and seventy-two cents” and inserting in their stead the words “One dollar seventy-five cents”.

Marriage allowance.

8. Regulation 196 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar five cents”.

Officers of cadets—marriage allowance.

9. Regulation 225 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and two cents” and inserting in their stead the words “One dollar five cents”.

Living out allowance—unmarried members.

10. Regulation 247 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and nine cents” and inserting in their stead the words “One dollar twelve cents”.

Retention of lodgings allowance—P.M.F.

11. Regulation 251 of the Military Financial Regulations is amended by omitting from paragraph (a) of sub-regulation (4.) the words “One dollar and nine cents” and inserting in their stead the words “One dollar twelve cents”.

Retention of lodgings allowance—Regular Army Emergency Reserve and Citizen Military Forces.

12. Regulation 252 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “One dollar and nine cents” and inserting in their stead the words “One dollar twelve cents”.

Application.

13.—(1.) The rates of pay and rates of allowances provided for in the Military Financial Regulations as amended by these Regulations apply in respect of service in the Permanent Military Forces or the Citizen Military Forces, as the case may be, on and after the seventh day of July, 1967.

(2.) The rate of allowance provided for in regulation 225 of the Military Financial Regulations as amended by regulation 9 of these Regulations applies to marriage allowance payable to an officer of cadets in respect of the seventh day of July, 1967 or any subsequent day.

(3.) Where, but for this sub-regulation, a male member would, by virtue of the application of the amendment of sub-regulations (3.) or (5.) of regulation 19, or the amendment of regulation 22, of the Military Financial Regulations as from the seventh day of July, 1967, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.

(4.) Where an allotment made by a male member was in force in respect of the period from and including the seventh day of July, 1967, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar two cents per day but would not entitle him to marriage allowance at the rate of One dollar five cents per day under the Military Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Military Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.
