REGULATIONS UNDER THE DEFENCE ACT 1903-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1966.

Amendments of the Military Financial Regulations 

Certain determinations &c., subject to the approval of the Treasurer.

1. Regulation 9 of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “The Schedule” and inserting in their stead the words “the First Schedule”.

Members other than General Officers.

2. Regulation 12 of the Military Financial Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“(1.) Subject to this regulation, the rate of pay of a male member who is an officer, other than an officer referred to in the last preceding regulation, is the rate per day specified, in relation to his rank and his length of service in his rank, in the following table:—

“(1a.) Subject to this regulation and to the next two succeeding regulations, the rate of pay of a male member who is a soldier is the rate per day specified in Part I., Part II., Part III. or Part IV., whichever is appropriate, of the Second Schedule to these Regulations in relation to his rank, the group in which he is classified and, if relevant, his length of service in his rank.”;

(b) by omitting sub-regulation (10.);

(c) by omitting sub-regulation (11.) and inserting in its stead the following sub-regulations:—

“(11.) The rate of a member who is a student at the Officer Cadet School or an Officer Training Unit is—

(a) the rate per day specified in Part I. of the Second Schedule to these Regulations in relation to a member holding the rank of corporal and the classification Group 1; or

(b) the rate per day applicable to a like member who is not a student,

whichever is the higher.

“(11A.) For the purposes of the last preceding sub-regulation, a like member, in relation to a student, is a member—

(a) who holds the like rank as the student held immediately before he became a student;

(b) who has completed the like service in that rank as the student has completed, or would have completed if he had continued to hold that rank; and

(c) who is classified in the group in which the student was classified immediately before he became a student or, if the Military Board determines that the student is to be deemed to have been classified in another group for the purpose of this sub-regulation, in that other group.”.

(d) by omitting sub-regulation (15.) and inserting in its stead the following sub-regulations:—

 “(15.) Subject to sub-regulations (16.), (16a.) and (16b.) of this regulation, the rate of pay of a female member who is an officer is the rate per day specified, in relation to her rank and her length of service in her rank, in the following table:—

“(15a.) Subject to sub-regulations (16c.), (16d.), (16e.) and (16f.) of this regulation and to the next succeeding regulation, the rate of pay of a female member who is a soldier is the rate per day specified in Part I., Part II., Part III. or Part IV., whichever is appropriate, of the Third Schedule to these Regulations in relation to her rank, the group in which she is classified and, if relevant, her length of service in her rank.”;

(e) by inserting after sub-regulation (16.) the following sub-regulations:—

“(16a.) Where the daily rate of pay of a member who was appointed to commissioned rank from warrant or non-commissioned rank before the commencement of this sub-regulation would, but for this sub-regulation, be less than the daily rate of pay applicable to

 him on the day immediately preceding the date of his appointment to commissioned rank, the daily rate of pay of the member is—

(a) if he were appointed to commissioned rank on or after the second day of March, One thousand nine hundred and sixty-eight—that higher rate or the rate applicable to an officer holding the rank to which he was appointed and having two years’ service in that rank, whichever is the higher rate; or

(b) if he were appointed to commissioned rank before that date—the rate applicable to an officer holding the rank to which he was appointed and having two years’ service in that rank.

“(16b.) Where an officer who was appointed to a particular rank, is, under the last preceding sub-regulation, entitled to be paid at the rate applicable to an officer holding that rank and having two years’ service in that rank, the member shall, for purposes of pay, be deemed to have completed two years’ service in that rank immediately before the day as from which he was appointed to commissioned rank.

“(16c.) Subject to the next three succeeding sub-regulations, where—

(a) a member was serving as a soldier on the twenty-ninth day of February, One thousand nine hundred and sixty-eight (hereinafter called ‘the specified date’);

(b) the member holds on a day (hereinafter called ‘the relevant day’) the same rank that he held on the specified date; and

(c) the rate of pay that was applicable to the member in respect of the specified date is higher than the rate of pay that would, but for this sub-regulation, be applicable to the member under these Regulations in respect of the relevant day,

the rate of pay of the member in respect of the relevant day is that higher rate.

“(16d.) The last preceding sub-regulation does not apply to or in relation to a member if—

(a) a change in the duties to be performed by the member occurred after the twenty-ninth day of February, One thousand nine hundred and sixty-eight, and before the commencement of this sub-regulation, being a change effected for a prescribed reason; and

(b) as a result of the change, the member is, on the date of commencement of this sub-regulation, classified in a group lower than the group in which he would have been classified if the change had not occurred.

“(16e.) Sub-regulation (16c.) of this regulation ceases to apply to a member if, after the commencement of this sub-regulation, the

 member is, for a prescribed reason, designated as holding a classification in a group lower than the group in which he was classified immediately before being so designated.

“(16f.) For the purpose of the last two preceding sub-regulations, each of the following reasons is a prescribed reason in relation to a member:—

(a) that the member has ceased to hold a qualification held by him;

(b) that the member has been inefficient in or unsuited for duties to be performed by him; or

(c) that the change in the duties to be performed by the member was effected at his own request otherwise than on grounds approved by the Military Board as compassionate grounds.”;

(f) by omitting paragraph (a) of sub-regulation (17.); and

(g) by inserting after sub-regulation (17.) the following sub-regulations:—

“(17a.) An instrument designating members as holding a classification for the purpose of this regulation made by the Military Board under paragraph (c) of the last preceding sub-regulation may be expressed to take effect from the first day of March, One thousand nine hundred and sixty-eight, or any subsequent date not earlier than two years before the date on which it is made and, if it is expressed to take effect from any date except the date on which it is made, members are, subject to the next succeeding sub-regulation, entitled to be paid pay as if it had been made on the day from which it is expressed to take effect, it had come into force immediately it had been made and the amendments of the Military Financial Regulations effected by the Statutory Rule by which this sub-regulation was inserted in those Regulations had come into effect on the first day of March, One thousand nine hundred and sixty-eight.

“(17b.) Regulation 8 of these Regulations, other than paragraph (a) of sub-regulation (3.) of that regulation, applies to and in relation to an instrument referred to in the last preceding sub-regulation as if it were a determination of the Military Board.”.

3.Regulation 84 of the Military Financial Regulations is amended by inserting after sub-regulation (3.) the following sub-regulation:—

“(3a.) Where—

(a) a member, having been granted recreation leave, has travelled in the first six months of a financial year at the expense of the Department under this regulation upon his return to Australia from oversea service; and

(b) the period of recreation leave granted to him was, by reason of the exigencies of the service, less than the period to which the member was entitled,

the member may, with the approval of the Military Board, travel at the expense of the Department on one additional occasion in that financial year.”.

(4.) In the last preceding sub-regulation, “member” has the same meaning as in Part IV. of the Military Financial Regulations.

Transitional.

7.—(1.) In this regulation, “the relevant period” means the period from and including the first day of March, One thousand nine hundred and sixty-eight, to and including the day immediately before the commencement of these Regulations.

(2.) Where, if these Regulations had come into force on the first day of March, One thousand nine hundred and sixty-eight, the rate of pay that would have been applicable, on a day in the relevant period, to an officer to whom sub-regulation (16a.) of regulation 12 of the Military Financial Regulations as amended by these Regulations would have applied exceeds the rate of pay that was applicable to the officer on that day under the Military Financial Regulations as in force on that day, the rate of pay applicable to the officer on that day is, by virtue of this sub-regulation, that higher rate.

Application.

8.—(1.) In this regulation—

“member” has the same meaning as in Part II. of the Military Financial Regulations;

“the relevant period” has the same meaning as in the last preceding regulation.

(2.) The Military Board may determine, in respect of a member who was a soldier during the relevant period or a part of the relevant period, that he shall be deemed to have been classified, on each day during the relevant period or on each day during a specified part of that period, in a particular group, being a group specified in the Second Schedule or the Third Schedule to the Military Financial Regulations as amended by these Regulations, and that member shall then for the purposes of sub-regulation (4.) of this regulation, be deemed to have been classified accordingly on that day.

(3.) Subject to the last preceding sub-regulation, a member who was a soldier on a day in the relevant period shall, for the purposes of the next succeeding sub-regulation, be deemed to have been classified on that day in the group specified in the Second Schedule or Third Schedule to the Military Financial Regulations as amended by these Regulations distinguished by the same number as the number that distinguished the group in which he was classified on that day under the Military Financial Regulations as in force on that day.

(4.) Subject to the next succeeding sub-regulation, the rates of pay provided for in sub-regulations (1a.) and (15a.) of regulation 12 of the Military Financial Regulations as amended by these Regulations apply to and in relation to service by members as soldiers on a day in the relevant period as if each member on that day had been classified in the group in which he is to be deemed to have been classified on that day under the preceding sub-regulations of this regulation.

(5.) The last preceding sub-regulation does not apply to or in relation to service of a member as a soldier on a day in the relevant period if the rate of pay applicable in the case of a member under regulation 12 of the Military Financial Regulations as in force on that day is higher than the rate that would be applicable, but for this sub-regulation, in the case of the member by virtue of the last preceding sub-regulation.
