REGULATIONS UNDER THE DEFENCE ACT 1903-1966.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1966.

Amendments of the Military Financial Regulations 

Definitions.

1. Regulation 10 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

“10. In this Part, unless the contrary intention appears—

‘member’ means—

(a) a male member of the Australian Regular Army or the Regular Army Supplement, other than a Pacific Islander serving in the Australian Regular Army or a person enrolled in the Carps of Staff Cadets; or

(b) a member of the Royal Australian Army Nursing Corps or the Women’s Royal Australian Army Corps appointed or enlisted for service in the Australian Regular Army or in the Regular Army Supplement;

‘officer’ means a member who is an officer;

‘soldier’ means a member other than an officer.”.

Consolidated rates of pay—General officers.

2.Regulation 11 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (3.) the words “Fifteen thousand and eighteen dollars” and inserting in their stead the words “Fifteen thousand four hundred and sixty-nine dollars”;

(b) by omitting from sub-regulation (4.) the words “Twelve thousand six hundred and fifty-eight dollars” and inserting in their stead the words “Thirteen thousand and thirty-eight dollars”; and

(c) by omitting from sub-regulations (5.) the words “Thirteen thousand eight hundred and thirty-eight dollars” and inserting in their stead the words “Fourteen thousand two hundred and fifty-three dollars”.

3. Regulation 12 of the Military Financial Regulations is repealed and the following regulations are inserted in its stead:—

“12.—(1.) “(3.) The rate of pay of a medical officer who is a captain in the Regular Army Supplement and holds a position as a resident medical officer at a hospital is Twelve dollars seventy-three cents per day.

“(4.) The rate of pay per day of an officer, being an officer holding the rank of captain and having not less than 8 years’ service in that rank, who is qualified for promotion to the rank of major and is included on the Administrative and Technical Officers List of a Corps is—

(a) if he has less than 12 years’ service in the rank of captain—Sixteen dollars seventy-six cents; or

(b) if he has not less than 12 years’ service in the rank of captain—Seventeen dollars thirty-four cents.

“(5.) Where a person is appointed a lieutenant in the Permanent Military Forces while undergoing a medical course at a University, the rate of pay of the officer from and including the date of commencement of his service in accordance with sub-regulation (2.) of regulation 15 of these Regulations to and including the day immediately before the day as from which he is promoted to the rank of captain in the Regular Army Supplement is Five dollars twenty-four cents per day.

“(6.) Where a person is appointed a lieutenant in the Permanent Military Forces while undergoing a course, other than a medical course, at a University or Technical College, the rate of pay of the officer from and including the date of commencement of his service in accordance with sub-regulation (3.) of regulation 15 of these Regulations to and including the day immediately before the date as from which he becomes eligible for pay at the rate of a lieutenant, is the rate per day specified, in relation to the nature of his course of studies and his stage of training, in the following table:—

General rites of pay—male soldiers.

“12b.—(1.). Subject to the succeeding sub-regulations of this regulation and to regulations 12c, 12g, 13 and 14 of these Regulations, therate of pay of a male soldier is the rate per day specified in Part 1., Part II., Part III., Part IV., Part V. or Part VI., whichever is appropriate, of the Second Schedule to these Regulations in relation to his rank, the group in which he is classified and, where applicable, his length of service in his rank.

“(2.) Subject to regulations 12g, 13 and 14 of these Regulations, the rate of pay of a male soldier who is a student at the Officer Cadet School or an Officer Training Unit is—

(a) the rate per day specified in Part 1, of the Second Schedule to these Regulations in relation to a soldier holding the rank of corporal and the classification Group 1; or

(b) the rate per day applicable to a like soldier who is not a student, whichever is the higher rate.

“(3.) For the purpose of the last preceding sub-regulation, a like soldier, in relation to a student, is a male soldier—

(a) who holds the like rank as the student held immediately before he became a student;

(b) who has completed the like service in that rank as the student has completed, or would have completed if he had continued to hold that rank; and

(c) who is classified in the group in which the student was classified immediately before he became a student or, if the Military Board determines that the student is to be deemed to have been classified in another group for the purpose of this sub-regulation, in that other group.

Rates of pay-apprentices.

“12c.—(1.) Subject to the next two succeeding sub-regulations, the rate of pay and rate of deferred pay of an army apprentice during his apprentice training are the respective rates per day or per week, as the case may be, specified, in relation to his classification, stage of training and, where applicable, his age, in the following table:—

“(2.) The rate of pay of an apprentice tradesman in his fourth year of apprentice training is the rate applicable to a private classified in such group as the Military Board determines.

“(3.) Deferred pay at the appropriate rate per day specified in the table in sub-regulation (1.) of this regulation shall be retained as an accumulating credit in the pay account of an army apprentice and is payable on the termination of his service or—

(a) in the case of an apprentice tradesman—on completion of his third year of apprentice training; or

(b) in any other case—on completion of his apprentice training, whichever is the earlier.

Rates of pay—female officers.

“12d.—(1.) Subject to this regulation and to regulation 12f of these Regulations, the rate of pay of a female officer is the rate per day specified, in relation to her rank and her length of service in her rank, in the following table:—

Rates of pay—female soldiers.

“12e.—(1.) Subject to the next succeeding sub-regulation and to regulations 12g and 13 of these Regulations, the rate of pay of a female soldier is the rate per day specified in Part I., Part II., Part III., Part IV., Part V. or Part VI., whichever is appropriate, of the Third Schedule to these Regulations, in relation to her rank, the group in which she is classified and, where applicable, her length of service in her rank,

“(2.) The rate of pay of a female soldier who is a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School is—

(a) the rate per day specified in Part I, of the Third Schedule to these Regulations in relation to a female soldier holding the rank of corporal and the classification Group 1; or

(b) the rate per day applicable to a like soldier who is not a student, whichever is the higher rate.

“(3.) For the purpose of the last preceding sub-regulation, a like soldier, in relation to a student, is a female soldier—

(a) who holds the like rank as the student held immediately before she became a student;

(b) who has completed the like service in that rank as the student has completed, or would have completed if she had continued to hold that rank; and

(c) who is classified in the group in which the student was classified immediately before she became a student or, if the Military Board determines that the student is to be deemed to have been classified in another group for the purpose of this sub-regulation, in that other group.

Rates of pay—certain officers appointed from the ranks.

“12f.—(1.) Where the daily rate of pay of an officer appointed to commissioned rank from warrant or non-commissioned rank before the first day of April, One thousand nine hundred and seventy, would, but for this sub-regulation, be less than the daily rate of pay applicable to the officer on the day immediately preceding the date of his appointment to commissioned rank, the daily rate of pay of the officer is—

(a) if the officer was appointed to commissioned rank on or after the second day of March, One thousand nine hundred and sixty-eight—that higher rate or the rate applicable to an officer holding the rank to which the officer was appointed and having two years’ service in that rank, whichever is the higher rate; or

(b) if the officer was appointed to commissioned rank before that date —the rate applicable to an officer holding the rank to which the officer was appointed and having two years’ service in that rank.

“(2.) Where an officer, upon having been or being appointed to commissioned rank with a particular rank—

(a) became entitled to be paid at the rate applicable to an officer holding that rank and having two years’ service in that rank by virtue of sub-regulation (16a.) of regulation 12 of the Military Financial Regulations as in force before the commencement of this regulation; or

(b) becomes entitled to be paid at that rate by virtue of the last preceding sub-regulation,

the member shall, for the purposes of pay, be deemed to have completed two years’ service in that rank immediately before the day as from which he was or is appointed to commissioned rank.

“(3.) Where the daily rate of pay of an officer appointed to commissioned rank from warrant or non-commissioned rank on or after the first day of April, One thousand nine hundred and seventy, would, but for this sub-regulation, be less than the daily rate of pay applicable to the officer on the day immediately preceding the date of his appointment to commissioned rank, the daily rate of pay of the officer is that higher rate.

Rates of pay—certain soldiers whose classifications changed.

“12g.—(1.) Subject to the next three succeeding sub-regulations, where—

(a) a soldier was serving as a soldier on the twenty-ninth day of February, One thousand nine hundred and sixty-eight (hereinafter called ‘the specified date’);

(b) the soldier holds on a day (hereinafter called ‘the relevant day’) the same rank that the soldier held on the specified date; and

(c) the rate of pay that was applicable to the soldier in respect of the specified date is higher than the rate of pay that would, but for this sub-regulation, be applicable to the soldier under these Regulations in respect of the relevant day,

the rate of pay of the soldier in respect of the relevant day is that higher rate.

“(2.) The last preceding sub-regulation does not apply to or in relation toa soldier if sub-regulation (16c.) of the Military Financial Regulations as in force immediately before the commencement of these Regulations—

(a) did not apply to and in relation to the member on the sixteenth day of December, 1968; or

(b) ceased to apply to and in relation to the member after that date and before the commencement of this regulation.

“(3.) Sub-regulation (1.) of this regulation ceases to apply to a soldier if, after the commencement of this sub-regulation, the soldier is, for a prescribed reason, designated as holding a classification in a group lower than the group in which the soldier was classified immediately before being so designated.

“(4.) For the purpose of the last preceding sub-regulation, each of the following reasons is a prescribed reason in relation to a soldier:—

(a) that the soldier has ceased to hold a qualification held by the soldier;

(b) that the soldier has been inefficient in or unsuited for duties to be performed by the soldier; or

(c) that the change in the duties to be performed by the soldier was effected at the soldier’s own request otherwise than on grounds approved by the Military Board as compassionate grounds.

Conditions applicable to rates of pay.

“12h.—(1.) For the purposes of regulations 12 to 12g (inclusive) of these Regulations—

(a) an incremental advancement in the rate of pay of a member in respect of length of service in a rank or classification is subject to such conditions as are approved by the Military Board;

(b) a rate of pay prescribed in relation to a classification applies to such members as the Military Board designates as holding that classification for the purposes of this regulation; and

(c) a member’s length of service in a rank includes such period of service in another rank as is approved by the Military Board as service in that first-mentioned rank for the purpose of determining his incremental advancement,

“(2.) An instrument designating members as holding a classification for the purpose of this regulation made by the Military Board under paragraph (b) of the last preceding sub-regulation may be expressed to take effect from a date not earlier than two years before the date on which, it is made and, if it is expressed to take effect from any date except the date on which it is made, members are, subject to the next succeeding sub-regulation, entitled to be paid pay as if it had been made on the day from which it is expressed to take effect, it had come into force immediately it had been made and the amendments of the Military Financial Regulations effected by Statutory Rules 1968, No. 154 had come into effect on the first day of March, One thousand nine hundred and sixty-eight.

“(3.) Where an instrument referred to in the last preceding sub-regulation is expressed to take effect from a day before the commencement of this regulation, the instrument has effect in respect of the period from and including that

day to and including the day immediately before the commencement of this regulation as if it had been made by the Military Board under sub-regulation (17a.) of regulation 12 of the Military Financial Regulations as in force before the commencement of this regulation.

“(4.) Regulation 8 of these Regulations, other than paragraph (a) of sub-regulation (3.) of that regulation, applies to and in relation to an instrument referred to in the last preceding sub-regulation as if it were a determination of the Military Board.

“(5.) Where—

(a) a person who has served on continuous full time service in the Naval Forces or the Air Force of the Commonwealth or with the Naval, Military or Air Forces of another part of the Queen’s dominions is appointed an officer of or enlisted in the Permanent Military Forces; or

(b) a person who has special qualifications or experience is appointed an officer of the Permanent Military Forces,

the Military Board may determine that the member is to be deemed, upon appointment or enlistment, to have served for a specified period in a specified rank, being the rank held by him upon being so appointed or enlisted and, for the purpose of determining the member’s rate of pay upon appointment or enlistment and his incremental advancement, he shall, immediately before the day as from which he is so appointed or enlisted, be deemed to have completed the period of service in the rank so specified.”.

Calculation of pay.

4. Regulation I5 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (2.) the word “sub-regulation (7.)” and inserting in its stead the word “sub-regulation (5.)”; and (b) by omitting from sub-regulation (3.) the word “sub-regulation (8.)” and inserting in its stead the word “sub-regulation (6.)”.

Marriage allowance.

5. Regulation 19 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “One dollar ten cents” and inserting in their stead the words “One dollar fifteen cents”;

(b) by omitting from sub-regulation (3.) the words “One dollar sixty-five cents” (wherever occurring) and inserting in their stead the words “One dollar seventy cents”; and

(c) by omitting from sub-regulation (5.) the words “One dollar sixty-five cents” (wherever occurring) and inserting in their stead the words “One dollar seventy cents”.

Qualifying allotment for payment of full rate of marriage allowance.

6.Regulation 22 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “Two dollars seventy-five cents” and inserting in their stead the words “Two dollars eighty-five cents”; and

(b) by omitting from paragraph (b) of that sub-regulation the words “Three dollars forty-five cents” and inserting in their stead the words “Three dollars fifty-five cents”.

General provisions relating to eligibility for certain allowances.

7. Regulation 27 of the Military Financial Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (3.) the words “One dollar ninety cents” and inserting in their stead the words “One dollar ninety-five cents”;

(b) by omitting from sub-paragraph (ii) of paragraph (a) of that sub-regulation the words “Two dollars sixty cents” and inserting in their stead the words “Two dollars sixty-five cents”;

(c) by omitting from sub-paragraph (i) of paragraph (b) of that sub-regulation the words “One dollar ten cents” and inserting in their stead the words “One dollar fifteen cents”; and

(d) by omitting from sub-paragraph (ii) of paragraph (b) of that sub-regulation the words “One dollar eighty cents” and inserting in their stead the words “One dollar eighty-five cents”.

Rates of pay.

8. Regulation 180 of the Military Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the succeeding sub-regulations of this regulation, the rate of pay of a member of the Regular Army Emergency Reserve, in respect of military service rendered in accordance with the Act, is the rate that would be the rate of pay of the member if the member were a member of the Australian Regular Army holding the like rank and classification, if any, and having the like service in that rank, as the member has.”.

Additional pay for chaplains of the Permanent Military Forces,

18. A male member of the Permanent Military Forces, being a member who is a chaplain, who, during the period from and including the fourth day of July, 1969, to and including the eighteenth day of December, 1969 or part of that period, held the classification of Chaplain General or held a classification and had a length of service in that classification specified in the first column of the following table is, by virtue of this regulation, entitled to additional pay in respect of the period or the part of that period of an amount equal to the amount by which the pay paid or payable to him in respect of the period or the part of that period under regulation 12 of the Military Financial Regulations is less than the amount of pay that would have been payable to him if he had been entitled to be paid at the rate of pay specified in the second column of the following table in relation to his classification and, where appropriate, his length of service in the classification, instead of at the appropriate rate of pay specified in sub-regulation (4.) of regulation 12 of the Military Financial Regulations.

19. A male member of the Citizen Military Forces, being a member who is a chaplain, who, during the period from and including the fourth day of July, 1969 to and including the eighteenth day of December, 1969 or part of that period, held a classification specified in the first column of the following table is, by virtue of this regulation, entitled to additional pay in respect of the period or the part of that period of an amount equal to the amount by which the pay paid or payable to him in respect of the period or the part of that period under regulation 190 of the Military Financial Regulations is less than the amount of pay that would have been payable to him if he had been entitled to be paid at the rate of pay specified in the second column of the following table in relation to his classification instead of at the appropriate rate of pay specified in sub-regulation (3.) of regulation 190 of the Military Financial Regulations.

Transitional.

20.—(1.) A determination in force immediately before the commencement of these Regulations, being a determination made under—

(a) sub-regulation (11a.) of regulation 12 of the Military Financial Regulations;

(b) sub-regulation (13.) of that regulation; or

(c) sub-regulation (18.) of that regulation,

has effect, after the commencement of these Regulations, as if it had been made under sub-regulation (3.) of regulation 12b, sub-regulation (2.) of regulation 12c or sub-regulation (4.) of regulation 12h as the case may be, of the Military Financial Regulations as amended by these Regulations.

(2.) An approval in force immediately before the commencement of these Regulations for the purpose of paragraph (b) or paragraph (d) of sub-regulation (17.) of regulation 12 of the Military Financial Regulations has effect, after the commencement of these Regulations, as if it had been made under paragraph (a) or (c), as the case may be, of sub-regulation (1.) of regulation 12h of the Military Financial Regulations as amended by these Regulations.

(3.) A member of the Permanent Military Forces who, immediately before the commencement of these Regulations, was designated as holding a classification for the purpose of paragraph (b) of sub-regulation (17.) of the Military Financial Regulations, continues to be designated as holding that classification

after the commencement of these Regulations until he is designated as holding a different classification under the Military Financial Regulations as amended by these Regulations.

(4.) Sub-regulation (3.) of regulation 12c of these Regulations applies in relation to the amount retained, under sub-regulation (14.) of regulation 12 of the Military Financial Regulations, as an accumulated credit in the pay account of an army apprentice immediately before the commencement of these Regulations in like manner as it applies to the amount retained in the pay account of an army apprentice under regulation 12c of these Regulations.

(5.) A member is, by virtue of this regulation, entitled to be paid an amount equal to the amount by which the amount of pay paid to him, in respect of the period from and including the sixteenth day of December, 1968, to and including the day immediately before the commencement of these Regulations is less than the amount of pay that would have been payable to him in respect of that period if the words “before the commencement of this sub-regulation” had at all times, during that period been omitted from sub-regulation (16a.) of regulation 12 of the Military Financial Regulations as in force during that period.

Application.

21.—(1.) The rates of pay and rates of allowances provided for in the Military Financial Regulations as amended by regulations. 2, 3, 5, 6, 7, 9, 11, 13, 14, 15 and 17 of these Regulations apply in respect of service in the Permanent Military Forces or the Citizen Military Forces, as the case may be, on and after the nineteenth day of December, 1969.

(2.) The rate of allowance provided for in regulation 225 of the Military Financial Regulations as amended by regulation 12 of these Regulations applies to marriage allowance payable to an officer of cadets in respect of the nineteenth day of December, 1969, or any subsequent day.

(3.) Where, butfor this sub-regulation, a male member would, by virtue of the application of the amendment of sub-regulation (3.) or (5,) of regulation 19 or the amendment of regulation 22, of the Military Financial Regulations as from the nineteenth day of December, 1969, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be so reduced, as the case may be until the date of commencement of these Regulations.

(4.) Where an allotment made by a male member was in force in respect of the period from and including the nineteenth day of December, 1969, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar ten cents per day but would not entitle himto marriage allowance at the rate of One dollar fifteen cents per day under the Military Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Military Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.
