REGULATIONS UNDER THE DEFENCE ACT 1903–1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903–1970.

Amendments of the Military Financial Regulations 

Consolidated rates of payGeneral officers.

1. Regulation 11 of the Military Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “Fifteen thousand four hundred and sixty-nine dollars” and inserting in their stead the words “ Sixteen thousand three hundred and ninety-seven dollars”; and

(b)by omitting from sub-regulation (2.) the words “Thirteen thousand and thirty-eight dollars” and inserting in their stead the words “Thirteen thousand eight hundred and twenty dollars”.

7.—(1.) Regulation 12e of the Military Financial Regulations is amended by omitting from sub-regulation (1.) the words “Subject to the next succeeding sub-regulation” and inserting in their stead the words “Subject to the succeeding sub-regulations of this regulation”.

(2.) Regulation 12e of the Military Financial Regulations is amended by inserting after sub-regulation (1.) the following sub-regulations:—

“(1a.) Where the conditions specified in the next succeeding sub-regulation are complied with in relation to the service of a female soldier on a particular day, the rate of pay of the soldier in respect of her service on that day is the rate per day specified in the following table in relation to the rank that she holds and the length of her service in that rank, if relevant:—

“(1b.) For the purpose of the last preceding sub-regulation, the conditions are—

(a) that the soldier has passed a test in operating switchboards conducted by the Military Forces;

(b) that—

(i) the soldier holds, on that day, a position of switchboard operator on the Establishment of the Military Forces; or

(ii) the soldier has held such a position within the period of six months ending on that day and the rate of pay that would, but for the last preceding sub-regulation, be applicable to her service in respect of that day is less than the rate specified, in relation to the rank that she holds and her length of service in that rank, if relevant, in the table in the last preceding sub-regulation; and

(c) if the soldier has, within the period of six months ending on that day, held a position, other than a position of switchboard operator, on the Establishment, of the Military Forces—the rate specified, in relation to the rank which she holds and her length of service in that rank, if relevant, in the Table in the last preceding sub-regulation is the same as, or is greater than, the rate of pay that would be applicable to her service in respect of that day if she were holding that other position.

“(1c.) (ii) the soldier has held such a position within the period of six months ending on that day and the rate of pay that would, but for the last preceding sub-regulation, be applicable to her service in respect of that day is less than the rate specified, in relation to the rank that she holds and her length of service in that rank, if relevant, in the table in the last preceding sub-regulation; and

(c) if the soldier has, within the period of six months ending on that day, held a position, other than a position of accounting machine operator, on the Establishment of the Military Forces—the rate specified, in relation to the rank which she holds and her length of service in that rank, if relevant, in the Table in the last preceding sub-regulation is the same as, or is greater than, the rate of pay that would be applicable to her service in respect of that day if she were holding that other position.”.

Marriage allowance.

8. Regulation 19 of the Military Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “One dollar fifteen cents” and inserting in their stead the words “One dollar twenty-five cents”;

(b)by omitting from sub-regulation (3.) the words “One dollar seventy cents” (wherever occurring) and inserting in their stead the words “One dollar eighty cents”;

(c)by omitting from sub-regulation (3.) the words “Two dollars eighty-five cents” (wherever occurring) and inserting in their stead the words “Three dollars five cents”;

(d)by omitting from sub-regulation (5.) the words “One dollar seventy cents” (wherever occurring) and inserting in their stead the words “One dollar eighty cents”; and

(e) by omitting from sub-regulation (5.) the words “Two dollars eighty-five cents” (wherever occurring) and inserting in their stead the words “Three dollars five cents”.

Qualifying allotment for payment of full rate of marriage allowance.

9. Regulation 22 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a)of sub-regulation (1.) the words “Two dollars eighty-five cents” and inserting in their stead the words “Three dollars five cents”; and

(b) by omitting from paragraph (b)of that sub-regulation the words “Three dollars fifty-five cents” and inserting in their stead the words “Three dollars seventy-five cents”.

General provisions relating to eligibility for certain allowances.

10. Regulation 27 of the Military Financial Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (a)of sub-regulation (3.) the words “One dollar ninety-five cents” and inserting in their stead the words “Two dollars fifteen cents”;

(b) by omitting from sub-paragraph (ii) of paragraph (a)of that sub-regulation the words “Two dollars sixty-five cents” and inserting in their stead the words “Two dollars eighty-five cents”;

(c) by omitting from sub-paragraph (i) of paragraph (b)of that sub-regulation the words “One dollar fifteen cents” and inserting in their stead the words “One dollar twenty-five cents”; and

(d) by omitting from sub-paragraph (ii) of paragraph (b)of that sub-regulation the words “One dollar eighty-five cents” and inserting in their stead the words “One dollar ninety-five cents.”

Application.

18.—(1.) The rates of pay and rates of allowances provided for in the Military Financial Regulations as amended by regulations 1 to 12 (inclusive), 14, 15, 16 and 17 of these Regulations apply in respect of service in the Permanent Military Forces or the Citizen Military Forces, as the case may be, on and after the first day of January, 1971.

(2.) The rate of allowance provided for in regulation 225 of the Military Financial Regulations as amended by regulation 13 of these Regulations applies to marriage allowance payable to an officer of cadets in respect of the first day of January, 1971, or any subsequent day.

(3.) Where, but for this sub-regulation, a male member would, by virtue of the application of the. amendments of sub-regulation (3.) or (5.) of regulation 19 or the amendments of regulation 22 or 27, of the Military Financial Regulations as from the first day of January, 1971, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance, or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations,

(4.) Where an allotment made by a male member was in force inrespect of the period from and including the first day of January, 1971, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar fifteen cents per day but would not entitle him to marriage allowance at the rate of One dollar twenty-five cents per day under the Military Financial Regulations as amended by these Regulations, the member may increase his allotment in respect of, the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Military Financial Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.

Transitional officers and chaplains.

19.—(1.) Where a male officer of the Military Forces was in receipt of pay in respect of service in those Forces at any time during the period from and including the eighteenth day of December, 1970, to and including the thirty-first day of December, 1970, in accordance with—

(a) sub-regulation (1.) of regulation 12 of the Military Financial Regulations;

(b) sub-regulation (3.) of that regulation; or

(c) sub-regulation (4.) of that regulation,

the officer is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to him in respect of that service if he had been entitled to be paid pay—

(d) in the case of an officer referred to in paragraph (a)of this sub-regulation—at the rate per day specified, in relation to his rank and his length of service in his rank, in the First Schedule to these Regulations;

(e) in the case of an officer referred to in paragraph (b)of this sub-regulation—at the rate of Fifteen dollars four cents per day; or

(f) in the case of an officer referred to in paragraph (c) of this sub-regulation—at the rate of Nineteen dollars sixty-seven cents per day.

(2.) Where a chaplain of the Military Forces was in receipt of pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with regulation 12a of the Military Financial Regulations, the chaplain is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to him in respect of that service if he had been entitled to be paid pay at the rate per day specified, in relation to his classification and length of service in his classification, in the Second Schedule to these Regulations.

(3.) Where a female officer of the Military Forces was in receipt of pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (1.) of regulation 12d of the Military Financial Regulations, the officer is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to her in respect of that service if she had been entitled to be paid at the rate per day specified, in relation to her rank and her length of service in her rank, in the Third Schedule to these Regulations.

(4.) Where an officer of the Military Forces was in receipt of pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with regulation 12f of the Military Financial Regulations and the sum of the pay that would have been payable to the officer in respect of that service if the officer had been entitled to be paid pay at the rate specified in relation to the officer’s rank and length of service in that rank—

(a) in the case of a male officer—in the First Schedule to these Regulations; or

(b) in the case of a female officer—in the Third Schedule to these Regulations,

exceeds the sum of the pay paid or payable to the officer, but for this sub-regulation, in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional pay in respect of that service.

(5.) In the application of the last preceding sub-regulation in relation to the service of an officer on a day in the period specified in sub-regulation (1.) of this regulation, where the period for which the officer was to be deemed to have served in a rankon that day by virtue of sub-regulation (2.) of regulation 12f of the Military Financial Regulations exceeded the period for which the officer had actually served in that rank on that day, the officer shall be deemed to have served in that rank on that day for that longer period.

(6.) Where a male officer of the Citizen Military Forces was in receipt of pay in respect of service in the Military Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (1.) of regulation 190 of the Military Financial Regulations, the officer is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to him in respect, of that service if he had been entitled to be paid pay at the rate specified in the Fourth Schedule to these Regulations.

(7.) Where a chaplain of the Citizen Military Forces was in receipt of pay in respect of service in theMilitary Forces at any time during the period specified in sub-regulation(1.)of this regulation in accordance with sub-regulation (3.) of regulation 190 of the Military Financial Regulations, the chaplain is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to him in respect of that service if he had been entitled to be paid pay at the rate per day specified in relation to his classification in the Fifth Schedule to these Regulations.

(8.) Where a female officer of the Citizen Military Forces was in receipt of pay in respect of service in the Military Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (5.) of regulation 190 of the Military Financial Regulations, the officer is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to her in respect of that service if she had been entitled to be paid pay at the rate per day specified in relation to her rank in the Sixth Schedule to these Regulations.

(9.) Where an officer of the Citizen Military Forces was in receipt of pay in respect of service in those Forces at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (7.) of regulation 190 of the Military Financial Regulations and the sum of the pay that would have been payable to the officer in respect of that service if the officer had been entitled to be paid pay at the rate per day specified in relation to the officer’s rank—

(a) in the case of a male officer—in the Fourth Schedule to these Regulations;

(b) in the case of a chaplain—in the Fifth Schedule to these Regulations; or

(c) in the case of a female officer—in the Sixth Schedule to these Regulations,

exceeds the sum of the pay paid or payable to the officer, but for this sub-regulation, in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional pay in respect of that service.

Transitionalservicewomen.

20.—(1.) In this regulation “servicewoman” means a female member of the Military Forces, other than a female officer of those Forces.

(2.) For the purpose of the next succeeding sub-regulation, each of the following periods is a period to which that sub-regulation applies:—

(a)the period from and including the first day of October, 1969, to and including the eighteenth day of December, 1969;

(b)the period from and including the nineteenth day of December, 1969, to and including the thirty-first day of December, 1969;

(c) the period from and including the first day of January, 1970, to and including the tenth day of September, 1970; and

(d)the period from and including the eleventh day of September, 1970, to and including the thirty-first day of December, 1970.

(3.) Subject to the next succeeding sub-regulation, where a servicewoman was in receipt of pay in respect of service in the Military Forces in a, period to which this sub-regulation applies in accordance with the Third Schedule to the Military Financial Regulations or sub-regulation (1.) of regulation 12g of those regulations and the sum of the pay that would have been payable to her in in respect of that service if she had been entitled to be paid pay at the rate per day specified, in relation to her rank and length of service in her rank (where relevant) and to the group in which she was included—

(a) in the case of the period referred to in paragraph (a) of the last preceding sub-regulation—in the Seventh Schedule to these Regulations;

(b) in the case of the period referred to in paragraph (b)of the last preceding sub-regulation—in the Eighth Schedule to these Regulations;

(c) in the case of the period referred to in paragraph (c) of the last preceding sub-regulation—in the Ninth Schedule to these Regulations; or

(d) in the case of the period referred to in paragraph (d)of the last preceding sub-regulation—in the Tenth Schedule to these Regulations,

exceeds the sum of the pay paid or payable to her, but for this sub-regulation, in respect of that service, the servicewoman is entitled to be paid an amount equal to the excess as additional pay in respect of that service.

(4.) Where a servicewoman served in a position of switchboard operator or accounting machine operator on the Establishment of the Military Forces during a period to which the last preceding sub-regulation applies and was in receipt of pay in respect of that service at the rate per day ordinarily applicable to a servicewoman posted a position of switchboard operator or accounting machine operator, as the case may be, the last preceding sub-regulation does not apply in relation to that service.

(5.) Where the last preceding sub-regulation applies to any service of a servicewoman during a period specified in sub-regulation (2.) of this regulation, being service within six months after she commenced or last commenced to serve in the position of switchboard operator or accounting machine operator, as the case may be, and the sum of the pay that would havebeen payable to her in respect of that service if she had been entitled to be paid pay at the rate per day specified in the Seventh, Eighth, Ninth or Tenth Schedule to these Regulations, whichever is applicable to that service, in relation toher rank and length of service in her rank (where relevant) and to the group in which she was included immediately before she commenced, or last commenced, to serve in that position exceeds the sum of the pay paid or payable to her, but for this sub-regulation, in respect of that service, the servicewoman is entitled to be paid an amount equal to the excess as additional pay in respect of that service.

(6.) Sub-regulation (2.) of regulation 12e of the Military Financial Regulations applies to the service of a servicewoman in the Permanent Military Forces during a period which sub-regulation (3.) of this regulation applies as if the reference to the rate per day specified in Part I. of the Third Schedule to the Military Financial Regulations were read as a reference to the rate of pay specified in the Seventh, Eighth, Ninth or Tenth Schedule to these Regulations, whichever is applicable to that period.

(7.) For the purpose of the next succeeding sub-regulation each of the following periods is a period to which that sub-regulation applies:—

(a) the period from and including the first day of October, 1969, to and including the ninth day of November, 1969;

(b)the period from and including the tenth day of November, 1969, to and including the eighteenth day of December, 1969;

(c)the period from and including the nineteenth day of December, 1969, to and including the thirty-first day of December, 1969;

(d)the period from and including the first day of January, 1970, to and including the tenth day of September, 1970; and

(e) the period from and including the eleventh day of September, 1970, to and including the thirty-first day of December, 1970.

(8.) Where a servicewoman was in receipt of pay in respect of service in the Citizen Military Forces at any time during a period to which this sub-regulation applies in accordance with the table in sub-regulation (5.) of regulation 190 of the Military Financial Regulations, the servicewoman is entitled to be paid in respect of that service, as additional pay, an amount equal to the amount by which the sum of the pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the pay that would have been payable to her in respect of that service if she had been entitled to be paid pay—

(a) in the case of the period referred to in paragraph (a)of sub-regulation (7.) of this regulation—in accordance with the Eleventh Schedule to these Regulations;

(b) in the case of the period referred to in paragraph (b)of sub-regulation (7.) of this regulation—in accordance with the Twelfth Schedule to these Regulations;

(c) in the case of the period referred to in paragraph (c)of sub-regulation (7.) of this regulation—in accordance with the Thirteenth Schedule to these Regulations;

(d) in the case of the period referred to in paragraph (d) of sub-regulation (7.) of this regulation—in accordance with the Fourteenth Schedule to these Regulations; or

(e) in the case of the period referred to in paragraph (e)of sub-regulation (7.) of this regulation—in accordance with the Fifteenth Schedule to these Regulations.
