REGULATIONS UNDER THE DEFENCE ACT 1903-1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia. acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1970.

Amendments of the Military Financial Regulations 

Special increase in pay.

1. Regulation 14 of the Military Financial Regulations is amended by omitting from paragraph (b)of sub-regulation (2.) the words “or apprentice clerk who has not attained the age of eighteen years”.

2.—(1.) After regulation 33 of the Military Financial Regulations the following regulation is inserted:—

Flight pay.

“33a.—(1.) An allowance, called ‘flight pay’, is payable to a member who holds the classification Operator Signals in respect of any period during which—

(a)he undergoes a course of training for the purpose of fitting him to perform airborne duties; or

(b) he is allotted for airborne duties.

“(2.) Subject to the next succeeding sub-regulation, the rate at which flight pay is payable to a member is—

(a) in respect of a period during which a member is allotted for airborne duties—One dollar sixty-four cents per day; or

(b) in the case of any other period—Eighty-two cents per day.

“(3.) Where a member is in receipt of flight pay in respect of a day and the condition specified in the next succeeding sub-regulation is fulfilled in relation to payment of increased flight pay in respect of that day, the amount of flight pay that would, but for this sub-regulation, be payable to the member in respect of that day is, by force of this sub-regulation, increased by Fifteen cents.

“(4.) For the purpose of the last preceding sub-regulation, the condition. in relation to the payment of increased flight pay in respect of a day (in this regulation called the relevant day’), is that a certificate under the hand of the member has been furnished to the member’s Commanding Officer certifying that—

(a)on a specified day, being the relevant day or a day not less than six months before the relevant day, a policy of insurance was in force in which provision was made for the payment of a benefit in the event of the member’s death by accident, or of his injury or disability caused by accident, occurring while he is flying in the course of performing his duties as a signaller in the Australian Military Force’s; and

(b)the amount of the premium payable in respect of that policy for any period was not less than the sum calculated at the rate of Fifteen cents for each day in the period.”.

(2.) Flight pay is payable, in respect of service in the Military Forces on and after the third day of July, 1970, under and in accordance with the provisions of sub-regulations (1.) and (2.) of regulation 33a of the Military Financial Regulations as amended by the last preceding sub-regulation.

(3.) Where a member in receipt of flight pay in respect of a day in the period from and including the third day of July, 1970, to and including the day immediately before the commencement of these Regulations furnishes to his Commanding Officer, within one month after the commencement of these Regulations, a certificate under the hand of the member certifying that—

(a) during a specified period, being a period in which that day was included, a policy of insurance was in force in which provision was made for the payment of a benefit in the event of the member’s death by accident, or of his injury or disability caused by accident. occurring while he was flying in the course of performing his duties as a signaller in the Australian Military Forces; and

(b) the amount of the premium payable in respect of that policy for any period was not less than the sum calculated at the rate of Fifteen cents for each day in the period,

the amount of flight pay that would, but for this sub-regulation, be payable to the member in respect of that day under the last preceding sub-regulation is increased by Fifteen cents.

Education allowance.

3.—(1.) Regulation 131 of the Military Financial Regulations is amended by omitting from paragraph (a)of sub-regulation (2.) the words “One thousand three hundred dollars” and inserting in their stead the words “One thousand four hundred and forty-five dollars”.

(2.) Education allowance is payable in accordance with the provisions of regulation 131 of the Military Financial Regulations as amended by the last preceding sub-regulation in respect of the attendance of a child at a school as a boarder during the year that commenced on the first day of January, 1971, or during any subsequent year.

Child education allowance.

4.—(1.) Regulation 159 of the Military Financial Regulations is amended by omitting from paragraph (a)of sub-regulation (2.) the words “One thousand three hundred dollars” and inserting in their stead the words “One thousand four hundred and forty-five dollars”.

(2.) Child education allowance is payable in accordance with the provisions of regulation 159 of the Military Financial Regulations as amended by the last preceding sub-regulation in respect of the attendance of a child at a school as a boarder during the year that commenced on the first day of January, 1971, or during any subsequent year.

Senior appointments.

5. Regulation 189 of the Military Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) The rate of pay of a member performing duty in an appointment specified in the following table is the rate specified in that table opposite to that appointment.

7.—(1.) An officer in receipt of pay in accordance with sub-regulation (1.) of regulation 189 of the Military Financial Regulations in respect of his service during the period from and including the first day of July, 1969, to and including the day immediately before the commencement of these Regulations or a part of that period, being an officer who would have been entitled to be paid pay in accordance with sub-regulation (1.) of regulation 189 of the Military Financial Regulations as amended by these Regulations if these Regulations had come into operation on the first day of July, 1969, is entitled to be paid an amount equal to the amount by which the pay paid or payable to him in respect of that service is less than the pay that would have been payable to him in respect of that service if these Regulations had so come into operation.

(2.) An officer who held an appointment of—

(a) Commander of an Officer Training Group;

(b)Chief of Staff, Headquarters, Northern Command;

(c) Commander, Royal Artillery in a Command, being an appointment the rank for which according to the Establishment of the Military Forces was Colonel; or

(d)Commander of a Support Group,

on or after the first day of January, 1971, is entitled to be paid an amount equal to the amount by which the pay paid or payable to him in respect of his service in the Citizen Military Forces in the period from and including the first day of January, 1971, to and including the day immediately before the commencement of these Regulations is less than the amount of the pay that would have been payable to him in respect of that service if the amendment of regulation 189 of the Military Financial Regulations effected by these Regulations had come into operation on the first day of January, 1971.

(3.) Where an officer held an appointment specified in the first column of the following table during the whole of the period specified in the second, third or fourth column of that table, the officer is entitled to be paid an amount equal to the amount by which the sum of the pay paid or payable to him in respect of his service during that period is less than the amount specified in the second, third or fourth column, as the case may be, of that table in relation to the appointment that he held in the first column.

(4.) Where an officer held an appointment specified in the table in the last preceding sub-regulation during a part of the period specified in the second, third or fourth column of that table, the officer is entitled to be paid an amount equal to the amount by which the sum of the pay paid or payable to him in respect of his service during that part of the period is less than the amount that bears the same proportion to the amount specified in the second, third or fourth column of that table, as the case may be, in relation to the appointment that he held as the number of days in the part of the period during which he held the appointment bears to the number of days in the period.

(5.) Where an officer held the appointment of Assistant Director of Dental Services. Tasmanian Command during the whole of a period specified in the first column of the following table, the officer is entitled to be paid an amount equal to the amount by which the sum of the pay paid or payable to him in respect of his service during that period is less than the amount specified in the second column of that table in relation to that period in the first column.

(6.) Where an officer held the appointment specified in the last preceding sub-regulation during a part of a period specified in the first column of the table in that sub-regulation, the officer is entitled to be paid an amount equal to the amount by which the sum of the pay paid or payable to him in respect of his service during that part of that period is less than the amount that bears the same proportion to the amount specified in the second column of that table in relation to that period as the number of days in the part of the period during which he held the appointment bears to the number of days in the period.

(7.) The rate of pay specified in the table in sub-regulation (2.) of regulation 190 of the Military Financial Regulations as amended by these Regulations in relation to the rank of brigadier applies to service of a male medical officer or a male dental officer holding the rank of brigadier otherwise than in an appointment specified in the table in sub-regulation (1.) of regulation 189 of the Military Financial Regulations on and after the first day of January, 1971.
