REGULATIONS UNDER THE DEFENCE ACT 1903-1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1970.

Amendments of the Military Financial Regulations 

1. Regulation 12b of the Military Financial Regulations is repealed and the following regulations are inserted in its stead:—

General rates of pay— Soldiers holding the rank of Corporal or a lower rank.

“12b.—(1.) Subject to regulations 12ba, 12c and 12g of these Regulations, the daily rate of pay of a male soldier, not being a soldier who is a recruit for the purpose of this regulation, who holds a rank specified in the Second Schedule to these Regulations is the rate specified in that Schedule in relation to his rank and the pay level appropriate to the class of soldiers in which he is included.

“(2.) The daily rate of pay of a male soldier who is a recruit for the purpose of this regulation is Six dollars forty-six cents.

“(3.) Subject to regulations 12ba, 12c and 12g of these Regulations, the daily rate of pay of a female soldier, not being a soldier who is a recruit for the purpose of this regulation, who holds a rank specified in the Third Schedule to these Regulations is the rate specified in that Schedule in relation to her rank and the pay level appropriate to the class of soldiers in which she is included.

“(4.) The daily rate of pay of a female soldier who is a recruit for the purpose of this regulation is Five dollars forty-six cents.

“(5.) The Military Board shall, by instrument of general application, determine the classes of soldiers holding a rank specified in the Second or Third Schedule to these Regulations to which the pay levels referred to in those Schedules are appropriate.

“(6.) The Military Board shall not determine as a class of soldiers under the last preceding sub-regulation a class other than a class comprising the members who have specified employment classifications.

“(7.) In determining, under sub-regulation (5.) of this regulation, the classes of soldiers to which a pay level is appropriate, the Military Board shall have regard to—

(a) the relativities among employment classifications recommended by the First and Second Reports of the Committee appointed in October, 1970, to enquire into financial terms and conditions of service for male and female members of the regular armed forces, and

(b) the nature of the duties and responsibilities of members having an employment classification and the nature of the duties and responsibilities of members having other employment classifications.

“(8.) An instrument made by the Military Board under sub-regulation (5.) of this regulation determining the pay level that is appropriate to a class of soldiers for the purpose of this regulation may be expressed to have taken effect from a day after the twenty-sixth day of August, 1971, being a day not earlier than two years before the day on which it is made, and, if it is expressed to have taken effect from a day other than the day on which it is made, soldiers are entitled to be paid pay ns if it had been made on the day on which it is expressed to have taken effect, it had come into force immediately it had been made and the amendments of the Military Financial Regulations effected by the Statutory Rule by which this regulation is inserted in those Regulations had come into operation on the twenty-seventh day of August, 1971.

“(9.) A soldier is a recruit for the purpose of this regulation if he holds the rank of Private and has not qualified in basic military skills at the tests in those skills conducted by the Military Forces.

General rates of pay— soldiers holding the rank of Sergeant or higher rank.

“12ba.—(1.) In this regulation—

‘the commencing day’ means the date of commencement of this regulation;

‘the prescribed day’ means the twenty-sixth day of August, 1971;

‘the prescribed table’ means the table in sub-regulation (3.) of this regulation.

“(2.) This regulation does not apply to a soldier who is a member of the Corps of Staff Cadets and is a student at the Royal Military College or a soldier who is a student at the Officer Cadet School, an Officer Training Unit or an Officer Cadet Course at the Women’s Royal Australian Army Corps School.

“(3.) The scale of rates per day in accordance with which pay is payable to a soldier who holds a rank specified in the first column of the following table is the scale of rates per day specified in the second or third column of that table, whichever is applicable to the soldier, in relation to that rank in the first column.

“(4.) Where a soldier is promoted to a rank specified in. the prescribed table, the rate per day at which pay is payable to the soldier is, subject to regulations 12bc and 12g of these Regulations—

(а) if the soldier is promoted to the rank of Warrant Officer, Class 1 or Warrant Officer, Class 2—the rate specified in. paragraph (a) (in the second or third column, whichever is applicable to the soldier) of item 1 or 2, as the case may be, in the prescribed table;

(b) if the soldier is promoted to the rank of Sergeant and is included in a class of soldier determined by the Military Board to be a class to which this paragraph applies—the rate specified in the paragraph (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table specified by the Military Board in relation to that class of soldiers;

(c) if the soldier is promoted to the rank of Staff Sergeant or is promoted to the rank of Sergeant and is not included in a class referred to in the last preceding paragraph—the rate in the scale of rates specified in item 3 or 4 (in the second or third column, whichever is applicable to the soldier), as the case may be, in the prescribed table that is next higher than the, rate at which pay was payable to him immediately before the promotion; or

(d) if the Military Board approves pay being payable to the soldier at a rate specified in a paragraph (in the second or third column, whichever is applicable to the soldier) of the item in the prescribed table that relates to the rank to which the soldier is promoted higher than the rate at which pay would be payable to the soldier but for this paragraph—the rate specified in that paragraph of that item.

“(5.) Where a soldier enlists in the Permanent Military Forces with a rank specified in an item (in the first column) in the prescribed table, the rate at which pay is payable to the soldier is, subject to the last preceding sub-regulation and to regulation 12bc of these Regulations—

(a) the rate specified in paragraph (a) (in the second or third column, whichever is applicable to the soldier) of the item; or

(b) if the Military Board approves, in accordance with sub-regulation (11.) of this regulation, pay being payable to the soldier at a rate specified in another paragraph of the item, the rate so specified.

“(6.) Where a soldier holds the rank of Warrant Officer, Class 1 or Warrant Officer, Class 2 and—

(a) the soldier held that rank on the prescribed day; or

(b) the soldier was promoted to that rank or enlisted in the Permanent Military Forces with that rank after the prescribed day but before the commencing day,

the rate at which pay is payable to the soldier is, subject to regulation 12bc of these Regulations, the rate specified in paragraph (a) (in the second or third column, whichever is applicable to the soldier) of item 1 or 2, as the case may be, in the prescribed table.

“(7.) Where a soldier holds the rank of Staff Sergeant and the soldier held that rank on the prescribed day, the rate at which pay is payable to the soldier is, subject to regulations 12bc and 12c of these Regulations—

(a) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be a class to which this paragraph applies—the rate specified in paragraph (b) (in the second or third column, whichever is applicable to the soldier) of item 3 in the prescribed table; or

 

(b) in any other case—the rate specified in paragraph (a) (in the second or third column, whichever is applicable to the soldier) of item 3 in the prescribed table.

“(8.) Where a soldier holds the rank of Sergeant and the soldier held that rank on the prescribed day, the rate at which pay is payable to the soldier is, subject to regulations 12bc and 12g of these Regulations—

(a) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be a class to which this paragraph applies—the rate specified in. paragraph (b) (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table;

(b) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be a class to which this paragraph applies—the rate specified in paragraph (c) (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table;

(c) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be class to which this paragraph applies—the rate specified in paragraph (d) (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table;

(d) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be a class to which this paragraph applies—the rate specified in paragraph (e) (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table;

(e) in the case of a soldier who was, on the prescribed day, included in a class of soldiers determined by the Military Board to be a class to which this paragraph applies—the rate specified in paragraph (f) (in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table; or

(f) in the case of any other soldier—the rate specified in paragraph (g)(in the second or third column, whichever is applicable to the soldier) of item 4 in the prescribed table.

“(9.) Where a soldier holds the rank of Staff Sergeant or Sergeant and was promoted to that rank or enlisted in the Permanent Military Forces with that rank after the prescribed day but before the commencing day, the rate at which pay is payable to the soldier is, subject to regulations 12bc and 12g of these Regulations—

(a) in the case of a soldier who was so promoted to that rank—the rate in the scale of rates specified in item 3 or 4 (in the second or third column, whichever is applicable to the soldier), as the case may be, in the prescribed table that is next higher than the rate that is to be deemed to be the rate at which active pay was payable to the soldier immediately before the promotion or, if the Military Board approves pay being payable to the soldier at a rate specified in another paragraph of that item, the rate specified in that other paragraph of that item; or

(b) in the case of a soldier who so enlisted with that rank—the rate specified in paragraph (a) (in the second or third column, whichever is applicable to the soldier) of item 3 or 4, as the case may be, in the prescribed table or. if the Military Board approves pay being payable to the soldier at a rate specified in another paragraph of that item, the rate specified in that other paragraph of that item.

 

“(10.) Where a soldier is in receipt of higher duties allowance immediately before his promotion to a rank specified in the prescribed table, the rate at which pay is to be deemed to have been payable to the soldier for the purpose of this regulation immediately before the promotion is the rate at which pay would have been payable to the soldier if the soldier had not been in receipt of higher duties allowance.

“(11.) The Military Board shall have regard—

(a) in making a determination for the purpose of paragraph (b) of sub- regulation (4.) of this regulation in relation to a class of soldiers— to the special skills required by soldiers included in the class of soldiers for the purpose of performing the duties of their positions and the nature of the responsibilities that they are required to exercise in performing those duties;

(b) in giving an approval for the purpose of paragraph (d) of sub- regulation (4.) of this regulation in relation to a soldier—to the continuous full-time service rendered by the soldier after the prescribed day—

(i) in the Military Forces in the rank that he holds or in a higher rank; or

(ii) in the Naval Forces or the Air Force of the Commonwealth, or in the Military Forces of another part of Her Majesty’s Dominions, in a rank that corresponds with the rank that he holds or with a higher rank.

(c) in giving an approval for the purpose of paragraph (b) of sub- regulation (5.) of this regulation in relation to a soldier—to the special skills or qualifications of the soldier and to any continuous full-time service of a kind referred to in the last preceding paragraph rendered by the soldier after the prescribed day; or

(d) in the case of a determination for the purpose of paragraph (a) of sub-regulation (7.) or a paragraph of sub-regulation (8.) with respect to a class of soldiers, being a class the members of which have Specified employment classifications—

(i) to the relativities among employment classifications recommended by the First and Second Reports of the Committee appointed in October, 1970, to enquire into financial terms and conditions of service for male and female members of the regular armed forces; and

(ii) to the nature of the duties and responsibilities of members having an employment classification and the nature of the duties and responsibilities of members having other employment classifications; and

(e) in giving an approval for the purpose of sub-regulation (9.) of this regulation in relation to a soldier—to the special skills or qualifications of the soldier.

“(12.) For the purpose of sub-regulation (9.) of this regulation, the rate that is to be deemed to be the rate at which pay was payable to a soldier immediately before his promotion is—

(a) if the soldier held a rank specified in the Second or Third Schedule to these Regulations immediately before the promotion—the rate specified in that Schedule in relation to that rank and to the pay level appropriate, by virtue of the first determination made by the Military Board for the purpose of sub-regulation (5.) of the last preceding regulation, to the class of soldiers in which the soldier would have been included on the commencing day if the soldier had not been so promoted; or

(b) if the soldier held the rank of Sergeant immediately before the promotion—the rate at which pay would have been payable to the soldier under sub-regulation (8.) of this regulation if this regulation and the first determination made by the Military Board for the purposes of the paragraphs of that sub-regulation had come into operation on the twenty-seventh day of August, 1971,

“(13.) Where a soldier is reduced or reverted to a lower rank, being a rank specified in the prescribed table, the rate at which pay is payable to the soldier is, subject to sub-regulation (4.) of this regulation and regulation 12bc of these Regulations—

(a) if the soldier is so reduced or reverted after the commencing day—the rate at which pay would be payable to the soldier if the soldier had, on the day on which the soldier is so reduced or reverted, enlisted in the Permanent Military Forces with that rank; or

(b) if the soldier was so reduced or reverted after the prescribed day but before the commencing day—the rate at which pay would be payable to the soldier under sub-regulation (6.) or (9.) of this regulation, as the case may be, if the soldier had, on the day on which, the soldier was so reduced or reverted, enlisted in the Permanent Military Forces with that rank.

“(14.) In giving an approval under sub-regulation (5.), (6.) or (9.) of this regulation in relation to a soldier to whom the last preceding sub-regulation applies, the Military Board may have regard, in addition to the other matters to which it can have regard, to the length of service of the soldier in the rank to which the soldier is reduced or reverted.

“(15.) Where a soldier who holds a rank temporarily is promoted to that rank at his substantive rank, this regulation does not apply to or in relation to that promotion.

General rates of pay— soldiers undertaking officer training

“12bb.—(1.) This regulation applies to a male soldier who is a student at an Officer Training Unit or an Officer Cadet School and to a female soldier who is a student at an Officer Cadet Course at the Women’s Royal Australian Army Corps School.

“(2.) The daily rate of pay of a soldier to whom this regulation applies is whichever of the following rates is the higher:—

(a) the rate specified in the Second or Third Schedule to these Regulations, whichever is applicable to the soldier, in. relation to a soldier who holds the rank of Corporal and in respect of whom pay level 1 is the appropriate pay level; and

(b) the rate per day that would be the rate of pay of the soldier if—

(i) the soldier had continued to serve in the Permanent Military Forces, otherwise than as a student of a kind referred to in the last preceding sub-regulation, with the rank that the soldier held immediately before the soldier became a student; and

(ii) in the case of a soldier who held the rank of Corporal or a lower rank—the pay level that was appropriate to the soldier immediately before the soldier became such a student had continued to be the pay level appropriate to the soldier.

“(3.) In the application of the last preceding sub-regulation in relation to a soldier who, on the date of commencement of this regulation, is a soldier to whom this regulation applies, the rate at which pay was payable to the soldier on the day immediately before he became a student of a kind referred to in sub- regulation (1.) of this regulation (in this regulation referred to as ‘the relevant day’) shall be deemed to be—

(a) if the soldier held a rank specified in the Second or Third Schedule to these Regulations on the relevant day—the rate specified in that Schedule in relation to that rank and to the pay level appropriate, by virtue of the first determination made by the Military Board for the purpose of sub-regulation (5.) of regulation 12b of these Regulations, to the class of soldiers in which the soldier would have been included on the relevant day if the relevant amendments of these Regulations bad come into operation on the relevant day; or

(b)if the soldier held the rank of Sergeant or a higher rank on the relevant day—the rate at which pay would have been payable to the soldier on the relevant day if the relevant amendments of these Regulations and the first determinations made by the Military Board for the purposes of regulation 12ba of these Regulations had come into operation on the relevant day.

“(4.) In the last preceding sub-regulation, ‘the relevant amendments’ means the amendments of these Regulations effected by the Statutory Rule by which this regulation is inserted in these Regulations.

“(5.) For the purposes of this regulation, a student who is promoted to a higher rank after commencing a course at an Officer Training Unit, an Officer Cadet School or an Officer Cadet Course at the Women’s Royal Australian Army Corps School shall be deemed to hold the rank that the soldier held immediately before the soldier commenced the course.

Increments.

“12bc.—(1.) Where pay is payable to a soldier in accordance with a scale of rates specified in sub-regulation (3.) of regulation 12ba of these Regulations, the soldier may, subject to this regulation, be paid increments of pay in accordance with that scale.

“(2.) Subject to the succeeding sub-regulations of this regulation, a soldier is not entitled to receive an increment of pay until he has received pay without the increment for not less than twelve months.

“(3.) The date from which a soldier is entitled to receive an increment of pay is not affected by the substitution of a new scale of rates of pay in accordance with which the soldier is to be paid pay for an existing scale of those rates.

“(4.) If the conduct, diligence, efficiency or attendance for duty of a soldier during the period at the expiration of which the soldier would, but for this sub-regulation, be entitled to receive an increment of pay has not been satisfactory, his Commanding Officer may, by order in writing, direct that the increment may not be paid until the expiration of such period, not exceeding twelve months, as is specified in the order and, in that case, payment of the increment shall be deferred until the expiration of that period.

“(5.) Where a soldier is, upon being promoted to, or enlisting in the Permanent Military Forces with, a rank specified in an item in the table in sub-regulation (3.) of regulation 12ba of the.se Regulations (in the first column), in receipt of pay at a rate specified in the scale of rates in that item (in the second or third column, whichever is applicable to the soldier), the Military Board may approve the soldier being, on the day that he is so promoted or so enlists, taken to be in receipt of pay at that rate for a specified period, being a period of less than twelve months, and the soldier is then to be taken to be in receipt of pay at that rate accordingly for the purpose of determining the data on which he is entitled to receive an increment of pay under this regulation.

“(6.) The Military Board shall, in giving an approval in relation to a soldier for the purpose of the last preceding sub-regulation, have regard to the continuous full-time service rendered by the soldier after the twenty-sixth day of August, 1971—

(a) in, the Military Forces in the rank, that he holds or in a higher rank; or

(b) in the Naval Forces or Air Force of the Commonwealth, or in the Military Forces of another part of Her Majesty’s Dominions, in the rank that corresponds with the rank that he holds or in a higher rank.

“(7.) For the purpose of determining the date on which a soldier is entitled to receive an increment of pay under this regulation—

(a) if, on the twenty-seventh day of August, 1971, the soldier held the rank that he held on the date of commencement of this regulation—the soldier shall, since the twenty-seventh day of August, 1971, be deemed to have been in receipt of pay at the rate at which pay is payable to him immediately after the commencement of this regulation; and

(b) if, after the twenty-seventh day of August, 1971, but before the date of commencement of this regulation, the soldier was promoted to the rank that he holds on that last-mentioned date or enlisted in the Permanent Military Forces with that rank—the soldier shall, since the date on which he was so promoted to that rank or so enlisted, be deemed to have been in receipt of pay at the rate at which pay is payable to him immediately after the commencement of this regulation.

“(8.) Where a soldier, upon ceasing to hold a rank temporarily, holds the rank that he held immediately before he was promoted to the rank temporarily, the soldier shall, during the period during which he held that rank temporarily, be deemed to have held the rank that he held immediately before he was so promoted and to have been in receipt of pay accordingly for the purpose of determining the rate at which pay is payable to him upon his ceasing to hold the rank to which he was promoted temporarily and the date on which he is to be entitled to receive subsequent increments of pay under this regulation.”

Rates of pay—female soldiers.

2. Regulation 12e of the Military Financial Regulations is repealed.

3. Regulation l2g of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

Rates of pay—certain soldiers whose rate has changed.

“12g.—(1.) Subject to the succeeding sub-regulations of this regulation, where—

(a) a soldier was serving as a soldier on the twenty-sixth day of August, 1971 (hereinafter called ‘the specified date);

(b) the soldier holds on a day (hereinafter called ‘the relevant day’) the rank that the soldier held on the specified date; and

(c) the rate of pay that was applicable to the soldier in respect of his service on the specified date is higher than the rate of pay that would, but for this sub-regulation, be applicable to the soldier under these Regulations in respect of the relevant day,

the rate of pay of the soldier in respect of his service on the relevant day is that higher rate.

“(2.) The last preceding sub-regulation ceases to apply to a soldier who holds the rank of Corporal or a lower rank if, after the commencement of this regulation, the soldier is, for a prescribed reason, included in a class of soldiers in relation to which a pay level is appropriate lower than the pay level that was appropriate to the class in which he was included on the day immediately following the specified date.

“(3.) For the purpose of the last preceding sub-regulation, each of the following reasons is a prescribed reason in relation to a soldier:—

(a) that the soldier has ceased to hold a qualification held by the soldier;

(b) that the soldier has been inefficient in or unsuited for duties to be performed by the soldier; or

(c) that the duties to be performed by the soldier have changed and the change was effected on the soldier’s own request otherwise than on compassionate grounds.”.

Conditions applicable to rates of pay.

4. Regulation 12h of the Military Financial Regulations is amended—

(a) by omitting paragraph (b) of sub-regulation (1.); and

(b) by omitting sub-regulations (2.), (3.) and (4.).

Special increase in pay.

5. Regulation 14 of the Military Financial Regulations is repealed.

Higher duties allowance.

6. Regulation 28 of the Military Financial Regulations is amended by omitting sub-regulation (1a.) and inserting in its stead the following sub- regulation:—

“(1A.) Subject to the succeeding sub-regulations of this regulation, where—

(a) a soldier holding a rank, being the rank of Corporal or a lower rank, for a position on the Establishment of a part of the Military Forces performs temporarily the full duties of the position; and

(b) the duties of the position are ordinarily required to be performed by a soldier included in a class of soldiers to which a pay level is appropriate higher than the pay level appropriate to the class in which the soldier is included,

an allowance, called ‘higher duties allowance’, is payable to the soldier.”.

Rates of higher duties allowance.

7. Regulation 29 of the Military Financial Regulations is amended by omitting sub-regulation (6.) and inserting in its stead the following sub-regulation:—

“(6.) In this regulation, a reference to the rate of pay that would be payable to a member if he were to be promoted to a particular rank shall, in a case where that rank is the rank of Corporal or a lower rank, be read as a reference to the rate of pay that would be payable to the member if he wore to be promoted to that rank and the appropriate pay level in respect of the member was the pay level appropriate to the class of soldiers in which he would be included if he were to be so promoted and were to perform the duties of the position in relation to which higher duties allowance is payable to him.”.

Rates of pay for members other than senior appointments.

8.—(1.) Regulation 190 of the Military Financial Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(3.) Regulation 190 of the Military Financial Regulations is amended by adding at the end thereof the following sub-regulations:—

“(13.) The daily rate of pay of a member who holds the rank of Private and is a recruit for the purpose of this regulation is—

(a) in. the case of a male member—Six dollars forty-six cents; and

(b) in the case of a female member—Five dollars forty-six cents.

“(14.) A soldier who holds the rank of Private is a recruit for the purpose of this regulation if the soldier has not completed a period of six months’ home training or has not attended an annual camp of continuous training,”.

 

Continuous full-time military service.

9. Regulation 190a of the Military Financial Regulations is amended—

(a) by omitting sub-regulations (3a.), (3b.), (3c.), (3d.), (3e.), (3f.) and (3g.) and inserting in their stead the following sub-regulation:—

“(3.) The last preceding sub-regulation does not apply to a member who is a soldier.”; and

(b) by adding at the end thereof the following sub-regulations:—

“(6.) The daily rate of pay of a member who is a soldier in respect of service included in a period of continuous full-time military service to which this regulation applies is the rate at which pay would be payable to the soldier in accordance with regulations 12b, 12ba, 12bb, 12bc, 12c and 12g of these Regulations if the soldier were a soldier of the permanent Military Forces.

“(7.) In ascertaining the rate at which pay is payable to a soldier under the last preceding sub-regulation—

(a) if the soldier commences to render continuous full-time military service to which this regulation applies on or after the date of commencement of this sub-regulation and the soldier holds, on the day on which he so commences to render continuous full-time military service, the rank of Warrant Officer, Class 1, Warrant Officer, Class 2, Staff Sergeant or Sergeant—

(i) sub-regulation (5.) of regulation 12ba of these Regulations applies as if the soldier had enlisted in the Permanent Military Forces with that rank on that day; and

(ii) sub-regulations (6.), (7.), (8.) and (9.) of regulation 12bA of these Regulations do not apply in relation to the soldier; and

(b) if the soldier was rendering continuous full-time military service to which this regulation applies on the date of commencement of this sub-regulation and held a rank, specified in the last preceding paragraph, regulation 12ba of these Regulations applies as if—

(i) references to a soldier who held a particular rank on the prescribed day were read as references to a soldier, within the meaning of this regulation, who had been rendering continuous full-time military service continuously since the prescribed day and held that rank on the prescribed day;

(ii) references to a soldier who was promoted to a rank after the prescribed day but before the commencing day were read as references to a soldier, within the meaning of this regulation, who had been rendering continuous full-time military service continuously since the prescribed day and was promoted after that day but before the commencing day; and

(iii) references to a soldier who enlisted in the Permanent Military Forces with a particular rank after the prescribed day were read as references to a soldier, within the meaning of this regulation, who commenced to render continuous full-time military service with that rank after the prescribed day and rendered that service continuously until the commencing day.

“(8.) In this regulation, ‘soldier’ means a member other than an officer.”.

 

Special increase in pay.

10. Regulation 191 of the Military Financial Regulations is repealed.

Second Schedule.

11. The Second and Third Schedules to the Military Financial Regulations are repealed and the following Schedules inserted in their stead:—

Transitional.

12.—(1.) In this regulation, “the relevant period ” means the period from and including the twenty-seventh day of August, 1971, to and including the day immediately before the commencement of these Regulations, or a part of that period.

(2.) Where the sum of the pay that would have been payable to a soldier in respect of his service during the relevant period if—

(a) the amendments of the Military Financial Regulations effected by these Regulations had come into operation on the twenty-seventh day of August, 1971; and

(b) the first determinations made by the Military Board for the purposes of the sub-regulations specified in sub-regulation (5.) of this regulation had each come into operation on that day,

exceeds the sum of the pay paid or payable to the soldier in respect of his service during the relevant period, the soldier is entitled to be paid, as additional pay in respect of that service, an amount equal to the excess.

(3.) For the purpose of the last preceding sub-regulation, the amount of pay paid or payable to a soldier in respect of his service during the relevant period includes any amount paid or payable to him by virtue of regulation 14 or 191 of the Military Financial Regulations as in force during that period.

(4.) In calculating the amount of pay that would have been payable to a soldier in respect of service during the relevant period if the amendments of the Military Financial Regulations effected by these Regulations and the first determinations made for the purposes of the sub-regulations specified in the next succeeding sub-regulation had come into operation on the twenty-seventh day of August, 1971, regulation 12ba of the Military Financial Regulations as so amended shall be read as if paragraph (b) of sub-regulation (6.) and sub-regulation (9.) were omitted.

 

(5.) For the purposes of sub-regulations (2.) and (4.) of this regulation, the sub-regulations are—

(a) sub-regulation (5.) of regulation 12b; and

(b) sub-regulations (4.), (7.) and (8.) of regulation 12ba,

of the Military Financial Regulations as amended by these Regulations.

(6.) For the purpo.se of applying this regulation in relation to a soldier who was promoted to a rank specified in the table in sub-regulation (3.) of regulation 12ba of the Military Financial Regulations as amended by these Regulations, or enlisted in the Permanent Military Forces with such a rank, after the twenty-sixth day of August, 1971 and before the commencement of these Regulations, the Military Board may give such approvals under paragraph (d) of sub-regulation (4.), or paragraph (b) of sub-regulation (5.), of regulation 12ba of those Regulations as so amended in relation to any such soldiers as it would have been authorized to give if the amendments of the Military Financial Regulations effected by these Regulations had come into operation on the twenty-seventh day of August, 1971.

(7.) In this regulation, soldier means a member of the Military Forces other than an officer of those Forces.
