REGULATIONS UNDER THE DEFENCE ACT 1903–1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903–1970.

(2.) Regulation 12 of the Military Financial Regulations is amended by omitting from sub-regulation (3.) the words “Fifteen dollars eighty-eight cents” and inserting in their stead the words “Sixteen dollars sixty-six cents”.

(3.) Regulation 12 of the Military Financial Regulations is amended by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation:—

“(4.) Subject to regulation 12f of these Regulations, the rate of pay of an officer who—

(a) holds the rank of Lieutenant or Captain;

(b)held, immediately before he was commissioned as an officer, the rank of Sergeant or a higher rank; and

(c) is included on the. Administrative and Technical Officers List of a Corps,

is the rate per day specified, in relation to his rank and his length of service in his rank, in the following table:—

(2.) Regulation 12d of the Military Financial Regulations is amended by omitting from sub-regulation (3.) the words “Five dollars sixty-eight cents” and inserting in their stead the words “Six dollars twelve cents”.

Rates of pay—officers appointed from the ranks.

6. Regulation 12f of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (3.) the word “Where” and inserting in its stead the words “Subject to the next succeeding sub-regulation, where”; and

(b) by adding at the end thereof the following sub-regulations:—

“(4.) The last preceding sub-regulation does not apply to an officer who is included on the Administrative and Technical Officers List of a Corps.

“(5.) Where—

(a) an officer included on the Administrative and Technical Officers List of a Corps was commissioned as an officer on or after the seventeenth day of December, 1971;

(b)the officer was, immediately before he was commissioned as an officer, serving in the Military Forces on continuous full time military service; and

(c)the rate (in this sub-regulation referred to as ‘the relevant rate’) per day at which pay was payable to the officer immediately before he was commissioned as an officer is higher than the basic rate for the officer,

the daily rate of pay of the officer is—

(d) if a raie higher than the relevant rate is specified in sub-regulation (1.) or (4.), whichever would but for this sub-regulation apply in the case of the officer, of regulation 12 of these Regulations in relation to his rank—the rate specified in that sub-regulation in relation to his rank that is next higher than the relevant rate; or

(e) if the officer was so commissioned but no such rate is so specified—the relevant rate.

(6.) Where an officer becomes entitled to be paid pay in accordance with paragraph (d)of the last preceding sub-regulation, the officer shall, for the purposes of pay, be deemed to have completed, immediately before the day as from which he commences to be entitled to be paid pay at that rate, the service in his rank that, but for the last preceding sub-regulation, he would have been required to have completed before he would have become entitled to be paid pay at that rate.

“(7.) In sub-regulation (5.) of this regulation, ‘the basic rate’, in relation to an officer, means—

(a)if the officer held, immediately before he was commissioned as an officer, the rank of Sergeant or a higher rank—the rate specified in sub-regulation (4.) of regulation 12 of these Regulations; or

(b) in any other case—the rate specified in sub-regulation (1.) of regulation 12 of these Regulations,

in relation to his rank and his service in his rank.”.

(4.) Regulation 190 of the Military Financial Regulations is amended by omitting from paragraph (b)of sub-regulation (13.) the words “Five dollars forty-six cents” and inserting in their stead the words “Six dollars forty-six cents”.

Continuous full-time military service.

8. Regulation 190a of the Military Financial Regulations is amended by inserting alter sub-regulation (3.) the following sub-regulation:—

“(3a.) In the application of sub-regulation (2.) of this regulation to and in relation to an officer who is included on the Administrative and Technical Officers List of a Corps—

(a)regulation 12 of these Regulations shall be read as if sub-regulation (4.) were omitted; and

(b) regulation 12f of these Regulations shall be read as if—

(i) there were omitted from sub-regulation (5.) the reference to sub-regulation (4.) of regulation 12 of these Regulations;

(ii) sub-regulation (7.) were omitted; and

(iii) in sub-regulation (5.) ‘the basic rate’, in relation to an officer, were to mean the rate specified in sub-regulation (1.) of regulation 12 of these Regulations in relation to his rank and his service in his rank.”;

Third Schedule.

9. The Third Schedule to the Military Financial Regulations is repealed and the following Schedule inserted in its stead:—

10.—(1.) The rates of pay provided for in the Military Financial Regulations as amended by regulations 1, 2, 6 and 8. sub-regulation (1.) of regulation 5 and sub-regulations (1.) and (2.) of regulation 7 of these Regulations apply to and in relation to the service of an officer in the Military Forces on and after the seventeenth day of December, 1971.

(2.) The rates of pay provided for in the Military Financial Regulations as amended by regulations 3, 4 and 9, sub-regulation (2.) of regulation 5 and sub-regulation (4.) of regulation 7 of these Regulations apply to and in relation to service of a female member of the Military Forces on and after the first day of January, 1972.

(3.) The rates of pay provided for in the table in sub-regulation (5.) of regulation 190 of the Military Financial Regulations as amended by sub-regulation (3.) of regulation 7 of these Regulations apply—

(a)in relation to service of an officer of the Citizen Military Forces on and after the seventeenth day of December, 1971; and

(b)in relation to the service of a female member, not being an officer, of the Citizen Military Forces on and after the first day of January, 1972.
