Amendments of the Military Financial Regulations
“(5c.) Higher duties allowance is payable to a member in respect of a period of absence on recreation leave if—
(
a ) he was in receipt of higher duties allowance in respect of the relevant day; and(
b ) the condition specified in paragraph (a ) of the next succeeding sub-regulation is fulfilled, or the conditions specified in paragraph (b ) of that sub-regulation are fulfilled, in. relation to the period of absence.
“(5d.) For the purposes of the last preceding sub-regulation, the conditions in relation to a member's absence on recreation leave are—
(
a ) that he had been in receipt of higher duties allowance continuously during the period of twelve months ended on the relevant day; and(
b ) that he had been in receipt of higher duties allowance in respect of a period of twelve months, or periods aggregating twelve months, during the period of twenty-four months ended on the relevant day and his Commanding Officer has certified that he would have continued to perform duties in respect of which higher duties allowance would have been payable but for that absence,
“(5e.)Where higher duties allowance is payable to a member in respect of a period of absence on recreation leave under the last preceding sub-regulation, the allowance payable at the rate at which it was payable lo him immediately before the commencement of that period of absence.
“(5f.) In sub-regulations (5c.) and (5d.) of this regulation, ‘the relevant day’, in relation to a member's absence on recreation leave for a period, means the day immediately preceding the first day in that period.”

(2.) Where higher duties allowance would have been payable to a member in respect of—
(
a ) a period of absence commencing on or after the twenty-third day of September, 1971; or
(
if the amendment of regulation 28 of the Military Financial Regulations effected by the last preceding sub-regulation had come into operation immediately before the commencement of the period of absence, higher duties allowance is payable to the member in accordance with regulation 28 of the Military Financial Regulations as amended by these Regulations—
(
c ) if the period of absence commenced on or after that day—in respect of the period of absence; or(
d ) if the period of absence commenced before that day—in respect of absence during the period on and after that day.
(
a ) by inserting in sub-regulation (1), after the word “Signals”, the words “or Analyst Special Duties”; and(
b ) by omitting from paragraph (a ) of sub-regulation (4.) the words “his duties as a signaller in the Australian Military Forces” and inserting in their stead the words “duties as a member of the Military Forces that can only be performed in an aircraft while it is in flight”.
(2.) Flight pay is payable to a member who held the classification Analyst Special Duties at any time during the period from and including the eighteenth day of June, 1971, to and including the day immediately before the commencement of these Regulations as if the amendments of regulation 33Aof the Military Financial Regulations affected by the last preceding sub-regulation had come into operation on that first-mentioned date.
(3.) Where a member in receipt of flight pay by virtue of the last preceding sub-regulation in respect of a day in the period referred to in that sub-regulation furnishes to his Commanding Officer, within one month after the Commencement of this sub-regulation, a certificate under the hand of the member certifying that—
(
a ) during a specified period, being a period in which that day was included, a policy of insurance was in force in which provision was made for the payment of a benefit in the event of the member’s death by accident, or of his injury or disability caused by accident, occurring while he was flying in the course of performing duties as a member of the Military Forces that can only be performed in an aircraft while it is in flight; and(
b ) the amount of the premium payable in respect of that policy for any period was not less than the sum calculated at the rate of Fifteen cents for each day in the period,
the amount of flight pay that would, but for this sub-regulation, be payable to the member in respect of that day under the last preceding sub-regulation is increased by Fifteen cents.
“34a
a member holding the rank of Sergeant or a higher rank who is the member of the crew of—
(
a )the Army Ship John Monash;(
b ) a ship of the kind known as Landing Ships Medium;(
c ) a ship of the kind known as Landing Craft Heavy;(
d )an escort vessel, that is to say, a vessel capable of undertaking navigation for, and designed to protect, another army vessel or other army vessels on voyages overnight along the coast of a country or along a river; or(
e ) ships of the kind known as Landing Craft, Mechanized ALC 50,
appointed by his Commanding Officer to command the ship.
“(2.) Command money is payable to the member
appointed to command the Army Ship John Monash or a ship of a kind referred to
in paragraph (
(
a ) in respect of any period during which it is not undertaking a specific task but is liable to be required to undertake a task and is in such a stale of preparedness that it could commence to undertake any task within forty-eight hours after notice to undertake the task is given to the member in command of the ship; and(
b ) from the time it commences to undertake a specific task until the time it completes that task.
“(3.) Where an escort vessel is responsible for the navigation for, and the safety of, another Army ship or other Army ships—
(
a ) for a period in excess of twenty-four hours; or(
b ) overnight for a lesser period during which that ship is, or those ships are, travelling along the coast of a country or along a river,
command money is payable to the member appointed to command the escort vessel in respect of that period.
“(4.) Where a ship of
a kind referred to in paragraph (
“(5.) The last preceding sub-regulation does not apply to the member appointed to command an escort vessel in respect of any period during which the vessel is responsible for the navigation for, and the safety of, another Army ship or other Army ships.
“(6.) A ship shall not be taken to be undertaking a specific task for the purpose of this regulation unless—
(
a ) the Military Board or an officer authorized by the Military Board has directed that the task he undertaken by the ship; and(
b ) the task involves the ship travelling along the coast of a country or along a river.”.
(2.) Command money is payable to members of the Military Forces in accordance with regulation 34Aof the Military Financial Regulations as amended by these Regulations in respect of service on and after the twenty-sixth day of May, 1970.
4. Regulations 85 to 90 (inclusive) of the Military Financial Regulations are repealed.

(2.) Regulation 108 of the Military Financial Regulations is amended—
(
a )by omitting from paragraph (a ) of sub-regulation (3.) the words “the next succeeding sub-regulation” and inserting in their stead the words “sub-regulation (4.) of this regulation”;(
b ) by omitting paragraph (b ) of sub-regulation (3.) and inserting in its stead the following paragraph:—“(
b ) the sum of an amount equal to the fare by public transport reasonably available for travel to the destination and an amount equal to the travelling allowance (if any) that would, but for the provisions of sub-regulation (4.) of this regulation, be payable under this Division if he had travelled to his destination by that transport,’’;
(
“(3a.) For the purpose of the last preceding sub-regulation, the fare by public transport reasonably available for travel to a place shall be taken to be an amount equal to the cost to the Department of that fare if the member had travelled to that place at the expense of the Department in accordance with sub-regulation (1.) of regulation 76 of these Regulations.
“(3b
. )Where a member travels on duty in his own motor vehicle in the circumstances referred to in sub-regulation (2.) of this regulation and, by reason of his using the vehicle for travel on duty—(
a ) the fee paid for the registration of the vehicle under the law in force in the State or Territory of the Commonwealth in which the vehicle is registered exceeds the fee that would have been so paid if the vehicle were not used for travel on duty; or(
b ) the amount of the insurance premium paid in relation to the vehicle exceeds the amount of the insurance premium that would have been paid if the vehicle were not used for travel on duty,
the member is entitled to be paid an amount equal to the excess,
“(3c.) This regulation applies to and in relation to a motor car—
(
(
b ) if it is driven by an internal combustion engine—that is not driven by a reciprocating piston engine in which fuel is ignited by means of a spark,
as if the motor car were driven by an engine that has four cylinders or less.”; and
(
d )by omitting from sub-regulation (5.) the figures “5,000” and inserting in their stead the figures “6,000”.
“or (
d ) the period during which he attended a parade designated as a half-day parade or night parade under the Australian Military Regulations if he attended, on the same day, a parade so designated as a whole day parade.”.
(2.) Pay is payable to an officer of cadets in accordance with the provisions of regulation 224 of the Military Financial Regulations as amended by the last preceding sub-regulation in respect of service as such an officer on or after the twenty-seventh day of August, 1971.
“(
(i) if he holds the rank of Lieutenant-Colonel—Two hundred and ten dollars per year;
(ii) if he holds the rank of Major—One hundred and sixty-five dollars per year;
(iii) if he holds the rank of Captain—One hundred and twenty-live dollars per year; or
(iv) if he holds the rank of Lieutenant—One hundred dollars per year; and
(
(2.) The rates specified in regulation 227 of the Military Financial Regulations as amended by the last preceding sub-regulation apply in relation to service allowance paid or payable in respect of service on and after the first day of July, 1971.
“239.—(1.) An allowance, called ‘initial outfit allowance’, is payable to a female member of the Permanent Military Forces as provided in the succeeding sub-regulations of this regulation.
“(2.) Where a member is not required to attend as a student at an Officer Cadet School or to undergo recruit training upon her appointment to, or enlistment in, the Permanent Military Forces, initial outfit allowance of Forty-seven dollars is payable to her upon her appointment or enlistment to enable her to purchase hosiery and personal necessaries not included in the scale approved under regulation 234 of these Regulations.
“(3.) Initial outfit allowance is payable to a soldier other than a soldier referred to in the last preceding sub-regulation, as follows:—
(
(
(i) if the soldier undergoes recruit training—upon successfully completing her recruit training; or
(ii) if the soldier is a student at the Officer Cadet School and has not-received any initial outfit allowance upon completing her recruit training—upon the expiration of five weeks after she becomes a student at the Officer Cadet School.”.
(2.) The amendment of regulation 239 of the Military Financial Regulations effected by the last preceding sub-regulation does not apply to or in relation to a member appointed to or enlisted in, the Permanent Military Forces before the commencement of these Regulations.
(2.) The amendment of regulation 271 of the Military Financial Regulations effected by the last preceding sub-regulation applies in relation to the funeral of a deceased member held on the twenty-fifth day of May, 1971, or any subsequent date.
