REGULATIONS UNDER THE DEFENCE ACT 1903-1970.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1970.

Amendments of the Military Financial Regulations!

Consolidated rates of pay— General Officers.

1. Regulation 11 of the Military Financial Regulations is amended by omitting sub-regulations (3.) and (3a.) and inserting in their stead the following sub-regulation:—

“ (3.)  The rate at which pay is payable to an officer who is a medical officer or a dental officer and holds a rank specified in the following table is the consolidated rate specified in that table in relation 10 the rank that the officer holds.

2. Regulation 12 of the Military Financial Regulations is amended by omitting sub-regulations (2.) and (3.).

3. After regulation 12a of the Military Financial Regulations the following regulations are inserted:—

Rates of pay—medical officers and denial officers.

“ 12aaa.—(1.) In this regulation, a reference to an officer shall be read as a reference to a male officer or a female officer.

“ (2.)  Subject to the next succeeding regulations, the rate of pay of an officer who is a medical officer or a dental officer and holds a rank specified in

6.—(1.) Regulation 190 of the Military Financial Regulations is amended by omitting sub-regulation (2.) and inserting in its stead the following sub-regulation:—

“(2.)  The rate of pay of a male officer or female officer who —

(a) is a medical officer or a dental officer;

(b) does not hold or perform the duties of an appointment specified in the table in sub-regulation (1.) of regulation 189 of these Regulations; and

(c) holds a rank specified in the following table,

is the rate per day specified in relation to that rank in the following table;—

(2.) Regulation 190 of the Military Financial Regulations is amended—

(a)  by omitting from sub-regulation (5.) the words “ the next succeeding sub-regulation ” and inserting in their stead the words “ sub-regulation (2.) of this regulation ”; and

(b) by omitting sub-regulation (6.).

 

Transitional provision.

7. —(1.) Where a female medical officer or dental officer was in receipt of pay in respect of service in the Citizen Military Forces as such an officer during the period or any part of the period from and including the sixteenth day of July, 1971, to and including the thirty-first day of December, 1971, additional pay is payable to her in respect of that service—

(a) if she held the rank of Colonel—at the rate of Seventy-eight cents per day;

(b) if she held the rank of Lieutenant-Colonel—at the rate of Eighty-two cents per day;

(c) if she held the rank of Major—the rate of Ninety-five cents per day; or

(d) if she held the rank of Captain—the rate of One dollar ninety-one cents per day.

(2.) Where an officer of the Permanent Military Forces or Citizen Military Forces was in receipt of pay in accordance with the provisions of sub-regulation (2.) of regulation 12, or sub-regulation (2.) of regulation 12D of the Military Financial Regulations in respect of service during the period from and including—

(a) in the case of a male officer—the sixteenth day of July, 1971; or

(b) in the case of a female officer-—the first day of January, 1972,

to and including the day immediately before the commencement of these Regulations, the officer is entitled to he paid, as additional pay in respect of that service, an amount equal to the amount by which the pay paid or payable to him in respect of that service if less than the amount of the pay that would have been payable to him in respect of that service if the amendments of the Military Financial Regulations affected by regulations 2, 3 and 4 of these Regulations had come into operation on the sixteenth day of July, 1971.

Application.

8.—(1.) The rates of pay specified in sub-regulation (3.) of regulation 11 of the Military Financial Regulations as amended by these Regulations apply in respect of service, by an officer who was a medical officer or a dental officer and held the rank of Lieutenant Colonel or Colonel, on and after the sixteenth day of July, 1971.

(2.) The rates of pay specified in the table in sub-regulation (1.) of regulation 189 of the Military Financial Regulations as amended by these Regulations apply in respect of service in an appointment specified in that table on and after the seventeenth day of December, 1971.

(3.) The rates of pay specified in the table in sub-regulation (2.) of regu­lation 190 of the Military Financial Regulations as amended by these Regulations apply in relation to service in the Citizen Military Forces of an officer referred to in that sub-regulation—

(a) in the case of such an officer holding the rank of Brigadier—from and including the fifth day of November, 1971; and

(b) in the case of such an officer holding the rank of Colonel or a lower rank—from and including the sixteenth day of July, 1971.
